They have her on domestic violence because that's what they know will stick and keep her in jail. They have to compile evidence before they charge her with either 1st or 2nd degree murder. As inflammatory as what has happened may be, keep a cool head.

Christ on a fucking crutch. It sounds like she was caught with the saw (since she had to make up a lie to explain why she had it), and he had cuts to his neck and shoulder. What the fuck more does the prosecution want in order to call it attempted murder?

Do you know what the difference in sentencing is for domestic assault vs attempted murder? Maybe there is some special sentencing in England (like a "hate crime" in America) which would warrant a harsher sentencing.

Secondly, the article doesn't say that the woman actually tried to cut off the man's head, it just quotes the man as saying that she did. If the DA doesn't think they'll be able to prove a charge, they're likely to go with a lesser one that they know they'll be able to make stick.

Edit: I stand corrected, this wasn't England.

I also love how the article doesn't identify her. If it was the husband who had done the same thing, his name and photograph (and probably with a picture of Leatherface placed right next to it for good measure) would be splashed all over the front page of every news outlet in the country.

It's a lot easier to hold someone on a charge of domestic violence, then escalate the charges later after the investigation unearths more evidence, than it is to charge with attempted murder right off the bat.

On the bare face of it, that should totally be attempted murder. Either she's schizophrenic, and should be locked up, or just plain mean, and should be locked up.

The only weird wording in the source article (HeraldNet) that made me pause, though, was that they said they found "no fresh marks" on the woman. That's an odd way to put it. So maybe her lawyer will argue that she was battered.

In any case, more details will eventually come out.

I wish there was a way to easily follow up on these stories to see what is said when all the evidence is gathered. "She was crazy" or "he tried to kill her" or something even weirder. I always wish I knew more.

Let's be honest here - the best case scenario is 'not guilty' on any charges for reason of insanity. Decapitation is a few steps beyond premeditated murder and well into psycho bullshit territory.
