From another article: “Minnesota is among a majority of states that treat intoxication as a barrier to consent only if the victim became drunk against their will. As of 2016, intoxication provisions in 40 states did not include situations where someone chose to consume drugs or alcohol, according to Brooklyn Law Review.”

Yet another reason why women in the US WILL NOT get justice for being sexually assaulted. The law is literally designed to blame victims.

So why men were so outraged when Cardi B claimed she used to steal her clients belongings after they got her to come to their hotel rooms and then would get voluntarily intoxicated and fall asleep. If it's ok to rape a drunk woman it should be ok to steal from a drunk man 🤷🏼‍♀️

Please someone make this make sense to me!

For example- If I’m out for dinner with girlfriends and have wine, can I man in Minnesota literally choose to rape me because I’m voluntarily intoxicated, and by extension, volunteering to have sex with anyone and everyone??!

(Note - only using this example because it’s relevant to me, eg yesterday when I had a long lunch with a school friend, not because there is any wrong or right situation to drink alcohol as an adult- any situation shouldn’t have a bearing on your “openness” to rape).

And that’s just looking at the logical extension of this argument. There’s so much more that’s unfair about this.

So if someone was mugged when drunk, who's to say that drunk person didn't willingly give their money and credit cards to someone else? If choosing to drink and therefore ending up drunk means I automatically consented to sex, why doesn't it mean drunk people automatically consent to any action someone commits against them when drunk??

Pretty sure someone who signed a contracted while blasted would have a judge rule in their favor to declare that contract null and void. But raped while drunk? No, sorry, being drunk doesn't prove you couldn't consent, try again!

This shit makes me angry but it's nothing new. It's what happened to Brock Turner's victim, and has been and will continue to happen to women for ages. There is a bill in my state assembly to "amend the definition of "mentally incapacitated" to include persons who are voluntarily intoxicated" when it comes to sex crimes, but this is the 2nd time it's been introduced (don't know if it got down voted or what last year), here's hoping it gets passed and most states pass something like this (although w/ the way the US gov moves it will probably be 5 to 10 years before more states have something like this...) (would like to see the white house release a directive or whatever encouraging states to pass these kinds of things and protects women's rights but I won't hold my breath)
