She can claim anything she wants. Without proof, though…….it’s nothing but claims. Be careful that she’s not baiting you into saying something untrue. She’s likely recording every conversation.

Wow, this sounds familiar. I was a contractor during some troubled times. Like others have pointed out, if she files (or you file) a "no-fault" divorce, then no one is blamed; it's right there in the name: no fault.

For some bizarre reason, plenty of women file no-fault divorces. But then they come to court with a long list of complaints for the judge ("My husband is a cheating narcissist; an unwashed and unemployed drunk with an anger management problem! And he kicks kittens!"). Then she cries for effect and expects special treatment from the judge. None of this matters in a no-fault divorce. It's amazing to me how many women want their proverbial "day in court" when the judge won't care about any of it.

Anyway, that should be central to your defense: You've never been charged with a crime, and misconduct was ONLY alleged during a high-conflict no-fault divorce. If OPM ever reviews your case, you can be sure they've seen clearance holders before who went through high-conflict divorces. The fact that accusations of misconduct are contemporary is in your favor. That is, the accusations themselves are very recent, even if they reference an old event. It shows that she's merely using them now in a divorce to discredit you. But it really discredits her.

If you're a contractor, you may want to speak off-the-record to your company's security officer, like a corporate FSO or someone like that. If you're active duty, find some crusty old Chief or Sergeant Major who works in S-2. They've seen all that shit before and can probably guide you.

Lastly -- and I love this bit of advice -- you can FOIA the notes from your last review. Let's say, for example, you have a TS/SCI and had a periodic review last year. In that case, OPM would have reached out to several people to ask about you.... including your wife. Notes were taken at the interview. And they're yours to review.

My wife (at the time) had nothing but glowing regard for me when I got my TS/SCI. She affirmed I was a swell and trustworthy guy. She knew that if I got the clearance, I'd get a better job. But a year later, under oath, during our divorce, she insisted I was completely untrustworthy. So under cross examination, my lawyer threw my OPM file in her face and caught her totally off-guard.

It showed that she lies when it suits her.

Hey man, I’m sorry you’re going through this. You really need to confront this from a business standpoint and think about your future. Fight that sexual abuse charge because this is now your past! Your entire future literally hangs in the balance of this charge. Relationships, jobs etc… Also secure your financial future regardless of what she says. Whatever feelings you have towards her are no longer relevant and the sooner you realize this the better things will start to look up for you. You no longer owe her anything and you can provide a secure living for your kids if you have any. I also live in Utah and can provide you with a couple of names of top lawyers that helped me with my divorce. Feel free to reach out.

OP I also have a security clearance. The best thing you can do is self report right now. Just tell them you are having marriage issues and it is probably headed for divorce. That is what I did and there was no punishment on my end. It is what they encourage you to do. If you think that she is going to claim some type of abuse the best thing you can do is record everything when she is around. If this is headed for divorce then you should file now and get ahead of this thing. (Edited grammar)

Divorce won't affect your security clearance, but a felony charge might, depending on your clearance level. Key word here is "charge" and not arrest or conviction. Just being charged with a felony can be a clearance issue, conviction may in some cases bar you from a clearance.

And, as others have already pointed out, there's no such thing as an amicable divorce. You got like maybe a 1 in 500 chance of that. Once you start trying to split assets, the amicable just poof!!! disappears. I started off being friendly and trying to be amicable, but once she started talking to other divorced people, she started bashing and trashing.

Honestly, I read these comments and thought to myself I bet this guy is going to be just like me and keep thinking I know her and she would never. Let me tell you she would never can change to she might and she did real quick. I knew her 15 years, turns out I didn’t know her at all. Sucks because I did love the person I thought she was and it’s real hard to separate that from the person she actually is.

Questions about your clearance are probably best addressed within that world. You are not going to be able to hide a divorce, if you do try be assured that would impact your clearance. If you have periodic background checks they will be contacting your ex at some point.

So if she is already claiming sexual abuse and is stating she wants people to know they will eventually hear it.

Assuming you are innocent here then you need to protect yourself and get a lawyer and stop assuming she will not attempt to lie however to screw you over. Therapists are all over the place - plenty of therapists tell clients go ahead cheat make yourself happy you deserve it girl. You already went to one said the exact opposite. A lawyer is going to give you better advice.

If you did it then expect it will come out in a future background check when they talk to her. Also best to get an attorney to advise you and not a therapist.

My experience with divorce and clearances was via someone else, who temporarily had their clearance suspended due to a RO.

While I was never legally married and have the joy of fighting over my daughter with my ex, I have a clearance and havent lost it.

I wouldnt be too terribly concerned if you do lose your clearance because you'll get it back... and you can always sue the NNSA if they dont restore it. Every person I know who's resorted to suing the NNSA has won. While a clearance is a privilege, they must be explicit in describing the reasons for revocation and they have to be valid since you are likely to experience damages.

Thanks everyone for the replies. I don't remember if she was interviewed when I got my clearance, but it would have been after the incident. So I'm more confident that it won't affect my clearance. Obviously I still expect to talk to security at work. But in general I have a lot to think about and am feeling less doomed for the future.

Unless you get arrested and get a conviction on your record, I don't think your clearance is in jeopardy. Having said that, it depends on the investigator who does your renewal. Your side of the story will come through in your interview. Source: I used to work for the clearance office of a federal agency, but I was not an investigator.

If you can find a lawyer in your state (besides hers!) that would agree to allow this without vehemently protesting and advising you, in writing, against accepting this - and without possibly threatening to withdraw as your lawyer if you chose to proceed against advice - I'll buy you a beer.

Women claim a host of sins you committed when they serve you divorce papers. They'll ask for the sun, the moon and the stars too. It meant nothing in my divorce. However, if I had a security clearance at stake, I wouldn't wait for her to serve me. I'd serve her first.

DEAD SERIOUS. clearances ofc take in to account the whole-person concept so it may offset you doing this or that but in my case, i had a previous employer straight up lie and say i was fired when i 100% was not. i left because they were being stupid difficult. and guess what..... it was a he said she said. still dont know if ill get my clearance. people are lying pieces of shit and you need to gather any proof you can.

As an FSO (facility security officer) about to go though a divorce let me give you a piece of advice. 1.Report everything to your security rep. 2. There’s a difference between a statement and a charge. A charge is mandatory reporting that goes on your record. I’d still contest the statement, but it might not be as dire as you think. 3. In the world of clearances there are plenty of people who have been divorced, made mistakes, and gotten into legal trouble. What kept them in their clearance was honesty and early reporting. It might be uncomfortable to discuss with your security rep, but I guarantee it’ll help you in the long run. Wish you the best man and stay strong.
