This idea is silly. -She can say that you forced her to sign it -She can say that she doesn't remember signing it. -She can say that what you did was outside scope -Potential to make you look creepy in front of a court

Not that I'm suggesting it but, technically, it is safer to say she consented to having your encounter recorded and somehow try to get that into evidence. Normally, it is unlawful to record someone without their consent unless the purpose of the recording is to use it as evidence that a crime has occurred. I suppose that could mean that the evidence wouldn't be allowed unless the witness perjured (which is a crime). Even then, you would hope that the presiding judge finds that the probative value of the tape will outweigh the danger of unfair prejudice.

But what the hell do I know? I'm not a lawyer. Just some dumb ol regular shmoe who barely knows crap about crap.

As much as I would think this has a good intent. It wont work for the variety of reasons as already mentioned. What if you sign it before hand and drink some booze before the sex? Or what if she claims she decides she did not want to do it after signing it? They can always use the "her consent can change at anytime before or during the intercourse."

I would say at least the last part of the card is good advice.

Don't talk to your commander especially after he reads you your article 32 rights, military equivalent to Miranda.
Don't talk to anyone in your chain of command.
Someone from your chain may call you up and ask you what happened? That person is an agent on behalf the United States Government and the convening authority. That person is in official capacity when they talk to you. You may think that they are just trying to get to the bottom of it. But anything you say to them can be used against you.
Don't talk to the investigator (AFOSI, CID, NCIS) at all without a legal defense council or a civilian hired lawyer. That agent is going to try to get you to give information that they will definitely use against you. Don't try rationalize, don't try to feel like you need to cooperate. They will want you to cooperate, so they can hang your ass. The agent will tell you he is going to do you a favor. He will tell you that he has been in this game, a loooong time and tell you how this all will play out if you don't work with him. Thats fine. All you need to say is that you invoke your Article 32 rights and want your attorney now. Don't care about trying to be hero. Don't try to think that if you fess up you get brownie points. Nope, keep your mouth shut! Even if they cuff you and take to the lockup. Better that, than surrendering your rights. You help in any way you will be probably locked up for much longer, with a punitive discharge.

Believe me when I tell you that the accuser has everyone on her side, the chain of command, the Agent in charge, the JAG, two cackling hens and the last but not least special sexual assault coordinators who are doing everything in their power to groom her testimony and shape the case against you. You have no one on your side except your lawyer.

It would need to have the signature of someone who witnessed the signing of the consent card. But once the door closes and the witness is no longer present, she can still say that while she consented to the idea at the 'consent meeting' she changed her mind once no one else was there and that the bloke refused to stop. So I guess the only thing to do is heavily promote orgies so that sex never ever happens without literally having witnesses present. Ridiculous !!!

A lot of you don't seem to understand how legally binding contracts work.

If one party claims "I was too drunk when I signed it" or "he forced me to sign it" or whatever, then the burden of proof is on that party to prove that any foul-play was involved.

As for whether this piece of paper is legally binding or not, it depends on the jurisdiction. For example, in some countries, even verbal contracts are binding. I would suggest using a signed affidavit instead. More official and definitely legally binding.

After 7 years in the Army and being an MP I think that things are good idea for Service Members. The DOD as a whole wants to look tough on sexual assault so they will crucify any male regardless of evidence or lack of evidence for an accusation of sexual assault. And as anybody knows thats been in the military there is a hell of a benefit to females claiming they were sexually assaulted, all kind of perks.

As an MP out of probably 200 sexual assault cases only two were valid that I ever dealt with.
