Assange is innocent, the charges against him were already dropped due to a lack of evidence, and taken up again by a politician with close ties with the US embassy, and a different prosecutor. The senior prosecutor of Sweden decided that there was no case. One of the key pieces of evidence was a condom which was discovered to contain no chromosonal DNA from either Assange or the plaintiff. This, it appears, is fabricated evidence. There is also deleted evidence in the form of tweets, which showed the plaintiff enjoying her time with Assange, and a picture of Assange on her bed. The new prosecutor has also not revealed the details of the case to Assange and his lawyers, breaching Eu and Swedish law.

When you weigh up the evidence it appears to be clear that Julian Assange is innocent, and the case against him is nothing more than a witch hunt from the USA against Wikileaks.

In answer to your question, no, neither instance qualifies as rape in my opinion.

Assange isn't guilty of rape. It's a honeypot trap, and the accuser is a CIA operative. Wired did a piece on how ridiculous the charges are.

The allegation is a bit more serious than that, and he's not charged with rape, but sexual assault, they are different crimes in Sweden.

There's effectively two claims:

The first is that he penetrated one of the women while she slept, without wearing a condom, even though she had repeatedly made it clear she did not want to have sex without a condom.

The second claim is that he held one of the women down and tried to penetrate her without a condom.

I don't think we will ever know what happened, but to claim the charges are that his condom just broke is nonsense.

Also, the comparison with hormonal contraceptives is not completely equivalent because condoms protect against STDs. You're not going to catch HIV from a girl because she doesn't use the pill.

Assange is not wanted for rape 'because a condom broke'. I know that's the meme currently going around the internet, but it simply isn't true.

The real allegations against him include:

Pinning one woman down using "a firm hold of the injured party’s arms and a forceful spreading of her legs whilst lying on top of her and with his body weight preventing her from moving or shifting" in order to force her into sexual activity without a condom, when she had already refused consent.
Having intercourse with another woman in her sleep.

I have no idea whether these allegations are true or not - that's what the process of law is supposed to find out. But misrepresenting what the allegations are and pretending that Assange is wanted over a broken condom doesn't help anyone.

Condom breaking is not the same thing about lying about being on contraception as a female.

Condom breaking = contraception pills not working for some reason. Lying about having a vasectomy = lying about contraception pills.

The problem of the condom breaking is also the 'fault' of both the sexes, while a female could have been incorrectly taking contraception.

Jesus Christ. Nobody answered OP's question and every post in here is an Assange circlejerk. Having the top comment say it is all a CIA plot to get Assange just destroys and credibility of this sub has and gives people an excuse not to take this sub seriously. Crazy conspiracy theories belong with Birthers and Truthers...not here.

To answer OP's question. I don't think they should be guilty of rape. The law is wrong and making another wrong law won't make it any better.

If a woman lies maliciously about birth control, then yes, I believe she removes the ability of a man to be an informed, consenting partner. It's not "rape" per se, as much as it is reproductive abuse.

I'm all for fighting fire with fire, but in this case making women criminals for that isn't the answer IMHO. We need to focus on getting rid of inane laws against men. This is a great analogy to do this with however.

Rape is forcing someone to have sex with them against their will. Whether your partner was lying about being on the Pill or not, you still agreed to sex with her and it was consensual. I don't think a woman should be made a criminal because of that, though if you wish to sue her if she gets pregnant by you and you've got proof she was saying she was using contraception but not doing that, I believe that should be allowed.
