These are 13-15 year old kids. They are children themselves and are being charged for child pornography? At that age, they don't know any better because their hormones are acting all crazy. I feel like the charge is a bit too extreme for people that young. Heck I don't think they even know what child pornography is and that it is illegal.

Not sure how the law works in Canada, but if they took pictures using snapchat then you really can't prove that they did anything. The only evidence is a screenshot which proves that they're in a lewd picture. It doesn't prove that they took the picture or sent it.

OK Now I am comfortably at a keyboard I can expand on my initial coments.

The Specifics of the article

Who do i think should be punished? Every last one of them needs a good slap however not necessarily in the way of a criminal record especial for CP charges.

The article dose not state the girls ages however as it is noted that some are boyfriend and girlfriend it is safe to assume they are all of comparable ages. They also states that "They were asking these girls for sexually explicit pictures — sometimes with a lot of insistence." There is no mention of how they came to this conclusion there may be unreported proof of this however it could also be a simple case of "I'm in trouble I'm blaming someone else"

As we live in an imperfect world and CP charges have been raised my understanding that the photographer was considered the person who created the pictures and as has been stated in some of the comments here even if that photographer is themselves. They could and should also be considered the distribute because again as stated else where If they did not give these images to someone they could not make copies to show others. In an age when digital information is cheap and can be created on the fly which they themselves "put out there without a copyright notice" I'm not even sure copyright infringement would qualify. "thought they were safe because they were using the Snapchat app" This reads to me both fully complicit in taking the photos and distribution to another person. as often is the case ignorance is not considered an adequate defense in the eyes of the law.

I saw someone state that the decision making process is not so great in teenagers for biological reasons (which when I think back to my teenage years I completely agree with) however as it is implied all parties are around the same age ether all of the kids should be protected by this reasoning OR because the boys are capable of making sensible decisions and should reap the punishments ALL parties should be punished equally.

So anyway in conclusion they were all idiots and should be slapped but unless pictures ended up in the wild on the internet then yes whomever played that particular dick move deserves the full weight of these laws otherwise its just teenagers doing incredibly dumb things. ^please ^note ^all ^of ^this ^is ^opinion ^with ^no ^legal ^knowledge ^based ^on ^limited ^information ^contained ^within ^the ^article.

I also find it quite distasteful that the article attempts to "attach" the case to the Rehtaeh Parsons case.

Conversation on the way home from work

I share part of my journey home from work with some who identifies themselves as feminist and I often mention stories I see linked here to see what her take is and it often has interesting results. Her initial argument was the boys should not have taken the pictures even though I had mentioned snap chat. I have to ask her to explain to me what snap chat is because I dont feel the need to take photos of every uninteresting moment in my life and as a result did not know what it did exactly. As she is explaining to me what snap chat is it dawns on me that you have to take the pictures yourself. When I raise this her face changes to one of horror till she replies "yes but the boys should not have captured the image and sent to friends" I agree this point but add is it not just as illegal to send child pornogaphy to one person as it is to many. She agrees with another look of horror but adds there must be something in the case that's not mentioned to cause the pattern of arrests. After this she sidelines the discussion to one about a law that should tale into account of the ages if both are consensual but one is just under the age of consent and the other is just over. . Apologies for any errors I am writing this on a crap phone on the train so it is still fresh in my mind. I'll fix it when I get home

I don't understand how you can charge a teenager with child pornography when the "pornography" is someone of near the same age. I really wish lawmakers would stop pretending that teenagers are asexual beings that suddenly become sexual at eighteen.

Beyond the gender issue of all of this. The idea that it makes sense to charge a minor for possessing child pornography, of girls in the same age group is just silly and a waste of tax dollars.

I can't imagine how negatively this will affect the lives of the kids involved, and all because they are sexually attracted to people their own age. This is no more criminal than minors having sex with other minors.

From what I read it seems like the girls sent photos to their boyfriends for private viewing.

The boys were trading and sharing photos with other people.

If you're an adult and are caught with child porn then you're obviously a sick mother fucker and should face the full extent of the legal system. But how on Earth can children be prosecuted for child porn. They ARE children. How dare those boys be sexually attracted to girls the same age as them....

If those girls made that assumption then they did so on the basis of their own negligence and naive stupidity. The majority of the blame here should be distributed to the girls for the production of child porn because they're the ones who manufactured it by taking and sharing illicit photos of themselves in the first place.
