Depends... remember when the NYPD raped that guy in a bathroom with a plunger? While forensics can only show that a plunger did in fact perferate his intestinal tract, it is easy to see without reasonable doubt that this was not consensual.

I don't know how to define fair in cases such as these, but we shouldn't go overboard with punishment. I can imagine a nightmare scenario in which a woman gets raped but won't report the crime for fear that she can't provide sufficient evidence; opening herself to false accusation charges.

There's got to be a good line somewhere, though.

That is a common feminist fallacy because they do not (or act like they do not) understand the legal system. A lack of evidence does not mean someone is lying, it just means you have a lack of evidence. In a case like that no one gets charged for anything.

You need to have evidence they LIED (text messages, video, confession etc.) in order to charge them. No rape victim is in danger of that.

Remember — she plead guilty to end the case early and try to get less time. had she gone to end of trial she would have lost easy. Trying to also lie about the cops proved a failed maneuver & probably angered the court.

Actually this trial and many others very much have to do with the sitting president(s) and their respective administrations, and the policies involving sexual assaults on campuses and how they are handled. The Obama administration empowered the Office for Civil Rights to aggressively tackle campus sexual assault, and in letter issued in 2011 lowered the bar for colleges to act on reported sexual assaults to a less rigorous standard, one that was below the legal standard. The Trump Administration (his Education Secretary Betsy DeVos) is reversing this. IMO, based on his speeches Obama drove the initial change himself, and Trump, well, Trump picked DeVos out of a hat because she's conservative and loyal and he was probably playing golf while she made these decisions, but given his history of payouts to gabby sexual conquests who have regretted their liasons, and his obsession with reversing anything that has Obama's name on it and peeing on mattresses he's slept on, its very possible that he is orchestrating this. Well this is was on the tail end of the Obama era SJW “rape culture” histeria.

If I remember correct, a lot of girls were crying rape for even after-the-fact consent removal! And getting away with it in some cases. (Remember, mattress girl?)

It is definitely possible to appeal both negatively and positively during sentencing. I've done it twice, for people who did something stupid and wanted the judge to know that they are not total habitual scumbag criminals. However, the person has to have some reason to have an opinion or say on the matter. A random person just saying that they think the sentence should be harsh would have little to no effect. Someone saying that they know her personally and speaking to her character would have a lot of weight.

Good idea in concept, but 1. There's no way to know exactly how much time either of them would have been sentenced to and 2. If false accusers start getting 8 to 10 year prison terms, it might deter some false accusers, but the majority will just never admit they lied, they'll just deny, deny, deny while their victims rot away in jail....or get kicked out of school if it's a Title IX campus tribunal. It's an all around shitty situation for men -because of the false "college sexual assault!" statistics and the #metoo movement. Men are just presumed guilty. Especially frat guys and athletes. The most warped thing is that the college Title IX sexual asssault cases, which have much lower standard of evidence are punishing black men more than anyone - so President Obama, whose administration initiaited the whole process is now responsible for ruining the lives of dozens of innocent black male students.
