According to the law in the U.S., it is possible for a husband to sexually harass his wife.

He can also be legally prosecuted for raping his wife (rape as in actual rape; i.e. forced penetration without her consent).

theres a lot of posts in this discussion dealing with physical touch, the thing i find shocking in the postcard is shes talking about him just SAYING sexually charged things to her, her HUSBAND!!

What's getting me is the importation of a cold legalism from the workplace into the marital home. How could a woman feel this way about her own husband?

If my H woulnd't stop grabbing my boob, he might be "being a jerk" right then, or maybe being inconsiderate, but "harrassment"?? I can;t get my head around it

While marital rape is a serious violation and downplaying it, or saying its not rape is disgusting, sexual harassment within marriage is an absurd concept. Never even heard of it. I think the woman in the post secret may be asexual or grew up extremely sheltered/prudish or something to consider her husband's sexually suggestive comments "sexual harassment".

It depends. Is the "harassment" within the bounds discussed by both parties and practiced for however long the relationship has been active? If it's not, it could frighten, disturb, annoy, etc. one party. For example, a husband might say to his wife in private, "I like that skirt" in a suggest manner and give her a slap on the butt. They both agree that's an acceptable thing to do and she's receptive to it. Similarly, she might just randomly grab his balls in passing.

If they both agree it's fine, then it's fine. Let's say, however, one of those actions is performed in absolute public and the affected party doesn't want that part of their relationship to be so public. Well, in a healthy relationship, he or she could say to his or her husband or wife, "Hey, not here." Or, "Just at home, please." Or, "Maybe later." and the other party will desist.

If the boundary-pushing continues, they may step aside and talk about it, or mention that they want to talk about such behavior once they get home. Obviously, if it continues and he or she keeps saying "No, not here." etc, then it goes to assault, rape, etc.

In a good relationship, they would talk it out and amend behavior, in a bad one, things can get abusive and stressful for the affected party. I think that's where the sexual harassment law comes into play.

If she tells him to stop and he keeps going, I suppose so. I think it depends on the woman's state of mind and the status of the relationship.

If the relationship is healthy and she isn't feeling pressured by him, then I highly doubt a bit of groping or whatever would upset her. If it's an abusive relationship though, then things change. Even within marriage, people are still autonomous, so I don't see why things like rape and sexual harassment would be considered nonexistent within a marriage.

No. Entering any physical/sexual relationship is a social contract to allow the second party access to your body. If, whilst your SO is horny, you come up behind them and give them a spanking, that is going to go very differently than if they're very upset with you...

It's a matter of context and whether the social contract is temporarily recinded, and in that sense, I do not believe it qualifies as legitimate sexual assault.

What we believe in the eyes of the feminized society is irrelevant. We have to wait for such a claim to be brought up in court and decided on.

If "stare rape" tier cases ever get off the ground in the US, I may have to seriously reconsider my feelings on Islamic fundamentalism.

Maybe they don't believe that it must occur 100% of the time, but they certainly believe that the responsibility for acquiring consent is on the male....... which is exemplified in "yes means yes" retardedness that got passed in California. Now the responsibility for proving consent is on the accused. (I'm assuming that they support yes means yes on account of their highly upvoted mocking of RP criticism of the law, which is the gold standard of BP proof when it comes to determining RP positions apparently.).

Your options under a Manginocracy: 1. Get enthusiastic consent, in written or verbal form by asking. 2. Hope to god she don't sue you with implied consent.

Been arrested a couple of times. Let me tell you from experience you can stretch the interpretation of the law to charge someone with just about anything. So yes i think they can be accused. Guilt comes down to the jury or judge if you live in a country that doesn't feel a husband or wife is entitled to unaanted sex or sexual contact

By the laws in the U.S. - yes. A man can rape his wife, so he can also sexually harass her. Depending on the state, but majority uses similar metrics to consent outside of a marriage.

Now what might happen since, you know, it's a marriage, is that two people will establish lines between what is acceptable and not acceptable. Some women have more barriers and some men have more barriers - it all depends on the person. When you are in a marriage it is up to you to compromise and find what is an acceptable arrangement for both partners.

The law and the judicial system is by default a 3rd party who will not understand all the nuances of communication and consent given in a specific marriage. This puts the judicial system at a disadvantage.
