Why would they do that... given that it's the police admitting that they don't have enough evidence? Will the police be saying that it will keep their names out of the press... and how is this anything other than a mockery of justice.

This is ridiculous for many, many reasons.

First off, it's supporting the idea that "Some rapists simply don't know better". Wrong. Rapists know what they do is wrong, and will continue to do it regardless of what you tell them.

Second, this is one step away from police intimidation. They literally have no evidence that the person they're going to be visiting has actually committed some sort of crime, but they're going to waste money to go visit him and walk them through what rape is. So any guy who has had a woman accuse him of rape without any evidence is potentially on the list of people who needs to be visited. Kinda ridiculous.

If you read some of "Ms Raphael's" quotes it's scary how little respect she has for due process and innocent until proven guilty. Someone with those attitudes has no bushiness leading any sort of task force.
Like QC Brian McConnachie, who has defended and prosecuted rape cases, was quoted at the bottom of the article . "There is a risk that this could be abused. You know what communities are like, and word can quickly go round the police have been at somebody's door. The police should focus on gathering evidence for a prosecution. I should have thought interviewing somebody under caution would have a much more chilling effect than visiting them. So I don't see the point."

We've been told that false accusations of rape should be treated as false accusations of any other crime. Alright, let's treat rape like any other crime then. It doesn't follow that rape is horrific but lying about rape is mundane. So since lying about rape is mundane then clearly rape is mundane. Why treat it differently?

Not really an expert on scottish law (it is different from english law) but fairly sure you can legally not invite them into your house and refuse the "warning", since you are Not under arrest and they don't have a warrant.

I like this because it gives police an option besides throwing someone in jail. I can see this being particularly useful as a "slap on the wrist" kind of thing when some parents freak out about their 16 year-old daughter banging her 18 year-old boyfriend. They can't be accused of ignoring the problem, but they don't have to ruin a person's life either.
