Info: STBX thinks she’s getting $$$

Update: She figured it out that this Trust account was set up to avoid being a marital asset. She was only half right. The Trust account was required because the funds from sellers side is made out to the name of the Trust, not to me. But now this account is non-marital and the money can sit there for months until it’s distributed.

And she knows she has to buy me out/refinance to keep the house.

She was expecting that I would take the check from this sale and put it in our joint account. That would make it a marital asset and she’d get 1/2 or more. Her idea was that when everything was split, she’s take her half of assets and use that to buy me out. So I’d end up with maybe 3/4 or less of my inheritance and technically no equity $$ because when she eventually sells she keeps 100% of profit. And she’d still have over 80k in liquidity now.

She’s upset that I get this inheritance (which she thinks she’s entitled to) and the equity payment and she “will have nothing” and knows she can’t afford the equity payout. She had a breakdown and cried because of this ‘having nothing’. Sure, cry over not getting my inheritance but never shed a tear or show emotion about ripping my life apart.

She gets the house, to stay with the kids majority of time, 50% or more from all assets/accounts. Hardly nothing. While I have to find a new place that has at least 3BR, furnish it from scratch, and still pay spousal and CS.

Her first option was to waive spousal. Not happening because it would be at least 10years of spousal to “pay” the equivalent. And if she gets married, spousal stops so my equity “credit” would stop while she can sell the house and keep 100% of profit. I lose again, she wins again. Her 2nd option is that I waive my share of equity and just let her have the house because I have all this extra money. I lose again, she wins again. I. Don’t. Think. So. We’ve paid for the house and everything in it for 10 years and we did that because I made 2X what she did. I’m not waiving my equity share.

Why did you disclose this trust to her? Family courts are courts of equity and not courts of law, therefore even if the law says 50-50 judges have discretion to hand over more than 50% of marital assets to the wife. If you disclose the trust and claim a lot of separate assets, the judge may hand over all marital assets to your wife. The only way to win the game is by hiding assets

I highly recommend you cease and desist telling her anything. Although the trust isn’t community property…..nothing good can come from talking too much.

Same here. While I was divorcing my exwife, she was convinced she’d get sky-high alimony and full custody with maximum CS $’s. Plus half of all assets.

She and her boyfriend planned a Mexican cruise. They got passports.

When the divorce decree came in after trial? $0 alimony and 50/50 custody. Plus I kept all of the assets. I heard from the kids she screamed and cried non-stop got 2 days.

I'm going through something similar (in Texas), except she knows she's screwed and has successfully alienated the kids (16M, 14F) against me. She'd been threatening divorce for years but was always waiting to "get her ducks in a row" before filing. After my Mom passed and she gave the kids the okay to skip the funeral, I told her I was done waiting and she needed to find employment NOW because I would be filing soon. A few weeks later, she found a job, got a cheap lawyer and filed. I was ready with my own lawyer, which pissed her off. She somehow thinks she can keep the house (that she can't afford) plus over half of our long term savings because I have my inheritance waiting (which I will not touch until the divorce is finalized). She even had the audacity to even tell me that it's money that I am getting for "doing nothing". Anyway, the way I expect things to go is we split everything (house, savings, etc), I then claim my inheritance which should put me back in a house and then I have to do the hard work of de-brainwashing my kids.

have you talked to an attorney about this yet? depending on where you live and how long you are married, she may be entitled to half of this property.

Be careful! watch for lies or other shenanigans that she may conjure up to take from you. When my STBX started talking to lawyers they told her she'd get alimony, cs, etc.. We are both high earners she just legit doesn't want to work, even said in her filings. When reality hit, she decided to try and alienate me from my kid in an effort to maximize cs (the lies and other shenanigans i mentioned). Protect yourself and guard against the bs!
