NO no no. This whole article is B.S. They say that she won't face charges so that people in similar situations won't be discouraged from coming forward, but guess what that means? It means that people who want to lie about rape won't be discouraged to do so. False accusation is a crime, woman or not, and of which this is a major count. This disgusts me.

I agree that we need to do everything possible to encourage rape victims to come forward. But it doesn't seem like there's any facts backing up the idea that they would actually be discouraged if we started enforcing perjury laws: it's just a myth propping up the bias in the courts.

It seems to be "common sense" that women and men might be more hesitant to report legitimate rape, but "common sense" reasoning is getting exposed as bullshit every day.

You could make the same speculative case that if perjury laws were enforced properly, women and men would be more willing to come forward to report rape, because the social presumption that they're lying would be alleviated - i.e. "Actually, s/he's probably not lying, because they actually charge you for lying now..." instead of "S/he's probably lying because it's so easy to lie about rape." People with legitimate cases would have an air of legitimacy, rather than the stigma of possibly being a liar - encouraging, rather than discouraging, the report of rape. Just a thought.

I knew a guy named Larry that this happened to. His daughter was manipulated by her mother into making false claims against him. When she came to court to try to tell the truth, the district attorney's people did their best to scare the shit out of her so she wouldn't tell the truth. She eventually gave up. I can see why in these cases we shouldn't punish the children who lied because it would discourage other children from coming forward to tell the truth. The state was so determined to uphold their false conviction even after Larry had spent years in prison for a crime he didn't commit.

The father should be rich. Not only for the lost time, but for the tarnished reputation. None of that can be returned. He should have the means to go anywhere he pleases and start a new life. After reading the "whole story" and learning what type of life this girl has experienced during his time in jail... well Schadenfreude.

This story will get worse. When he's ordered to pay backdated child support, when he can't get his job back, when his friends and family disown him, if this man shows any anger, resentment, or frustration at what's happened, he immediately becomes walking proof that men are violent, hostile creatures with no respect for women or their families.

There's an old Zizek story that comes to mind. In the first half of this century, a little boy's father would try to get him to come visit his aging grandmother. When the boy didn't want to, the father would say "Doesn't matter, come on, Timmy, we're going." But in this half of the century, the father says "Timmy, you should want to go see Grandma. Now come on." What was just physical coercion becomes an attempt to use guilt to alter and pacify the child's psychology.

That's what's gonna happen to this guy (and happens to men all over the place). He'll be expected to accept what's happened. Showing any sign of dissatisfaction will start the "Man, what a deadbeat dad, maybe he should have been locked up after all," dialogue.

I really don't think that she should be charged(though she deserves it). There are plenty of psycho false accusers that regret their lies later in life and while they deserve prison, they will never admit their lies so long as they get sent to prison for it. False accusers should be jailed when they are proven to have lied and DID NOT admit it before being proven to have lied. When they step forward themselves, they should be granted immunity. This is the only way to release the maximum amount of innocent men from prison.

Better a hundred guilty people walk free than 1 innocent unjustly suffer. Lets not become like the feminists in demanding the opposite.

"Won't face charges" is a complex outcome. I'm not up on the facts of the case, but there could be any number of reasons why prosecutors believe they could not win a criminal trial. Could be that the witnesses against her would have serious credibility issues, the evidence against her doesn't rise to the level of "beyond reasonable doubt" or that she would appear too sympathetic to the jury.

When public anger over a matter as complex as this drives prosecutor policy, you get Casey Anthony-type verdicts. That case should not have gone to trial until/unless it was winnable. When it went to trial, it should have gone up as a voluntary manslaughter and not murder charge. No way no how were they ever going to convict for murder.

None of this precludes the father from suing her. That's entirely up to him.
