Let's reverse the wording a bit and see how this sounds.

Current story: ...the Country Assistant DA ... said he believes the penalty is fair and just. "The question in this case is, the victim is a 16-year-old [boy], and she is a 38-year-old mom. So is prison the right call for her? Or give her a chance to prove she’s worthy of being back in society," [the DA said].

Hypothetical story: ...the Country Assistant DA ... said he believes the penalty is fair and just. "The question in this case is, the victim is a 16-year-old [a girl], and [he] is a 38-year-old [dad]. So is prison the right call for [him]? Or give [him] a chance to prove [he’s] worthy of being back in society," [the DA said].

My comment How many people would be clambering for the 38-year-old dad to be locked up and the key thrown away? The whole community (or nation) in my opinion. The man would be labeled a pedophile for life and would not be given a chance to prove he's worthy of being back in society.

The problem is - I don't get a lot of polite disagreement. I get a lot of "come on dude you know you'd have tapped that when you were 16" and if I keep pushing it's "lighten up already!"

That said, I'm pretty well convinced that the "high-five that kid" men actually haven't stopped to think past the "me male, me supposed to love sex" aspect and it's that contemplation I'm shooting for - because it opens the door for a discussion about traditional male roles & sex/stud shaming, which leads naturally into the rest of the men's rights agenda.

This is actually the kind of topic that can introduce a ton of good conversations and possibly bring other guys around to the MRA point of view, or at the very least open their eyes to the issues. But getting past that initial block of "teenage boys are walking erections, it should be okay for older women to prey on them b/c they'll like it anyway" is the piece I'm having trouble with.

In your original post you said "...but I'd say fully 75% of men just laugh and say "good for that kid!". I wanted to downvote you for that because I don't believe that's the case. I think the number would be much, much lower. However I understand much of what you just wrote and tend to agree with you.

We're all affected by biologically-driven imperatives but we all must learn to control those urges appropriately. If you are a man and you don't want to have sex then people automatically think there is something wrong with you (men and women included).

It is possible for men to control those urges but a lot of people would like to think that's not the case. That's why when a man goes in front of a judge for something like this, he'll get the book thrown at him (i.e. max punishment, he can't be rehabilitated, he can't return to society).

Women are assumed to be better able to control their urges so when something like this case comes up it's considered an outlier and the punishment is lesser (i.e. she can be rehabilitated and brought back into society).

Unless I'm missing something, this judgment came from a trial court. Trial courts do not set precedent ever. And they rarely even serve as persuasive authority. So, in a word, the answer to your question is simply, "no." This is because the trial court deals with questions of fact, and appellate courts deal with questions of law. To expand upon this, a trial court asks whether or not you committed first degree murder of your neighbor. An appellate court asks whether the judge should've provided a different definition for insanity when giving the jury instruction in relation to your affirmative defense of insanity. Because the first was fact-specific, one cannot readily draw guidance from the court opinion (where there actually is one, since at the trial level the juries tend to be the source of power). Conversely, in analyzing questions of the appropriate procedural and legal standards, appeals and supreme courts establish clear standards on which to draw upon in subsequent cases.
