Deeds are recorded at the county; it doesn't matter who is physically holding the document.

Plus even if one person isn't in title they would still have a marital interest in the property regardless of vesting information.

Bottom line the free attorney who provided the consult is full of shit, clueless about real estate, or your wife is lying which is the most likely answer.

Its my understanding that possession of keys to the property establishes residency as far as police officers are involved so unless she gives you a TRO she can't kick you out.

Potentially good advice: You can file a TRO before her and get her removed.

Women will say all sorts of irrational shit to you to get you off balance so you'll just throw the towel in and give them what they want. So many blokes literally walk out with just the shirts on their backs to get away from their toxic exes because relationships clearly mean way more to men than they do to women.

You need to talk to a lawyer and get them to articulate to you whether this is a real issue or not. I can't imagine it is, but America is weird so who knows. Arming myself with a knowledge of divorce law meant that ignoring my exes bullshit was easy.

Pre-marital assets stay pre-marital which includes a house. She gets a cut of the equity appreciation from date of marriage to divorce date though, so she will get something but probably nothing that you can't buy her out of.

I hope for your sake that you took that physical paperwork and locked it away in another location as soon as you posted this. She can legally keep legal documents away from you for MONTHS with no recourse, even when the court demands you file account numbers or taxes or leases or mortgages.

My ex used to do that take things that she thought were important to me and keep them from me. It is a control thing that they do. They want you to react and do something stupid so they can use it to their advantage. Another thing that my ex wanted was to take control of my house because she thought it would make me behave better. It is all fucking stupid. Some of these women are so fucking dumb in the way that they think about living their life. Even during the relationship they can get anything they want as long as they are dissent but no they act retarded and stupid and then get divorced and they are miserable anyways. An old man told me a joke once he said "all babies are born boys but when the doctor spanks them so they can cry the dicks fall off the dumb ones" and this was a guy that was married in the 60s
