This is why rape is such a clusterfuck to deal with from a legal perspective. It's one of the most heinous crimes and simultaneously the hardest to prove. Whether a rape has occurred depends entirely on the state of mind of one person during intercourse. Not an easy thing to prove in a court.

You could argue you were coerced into signing the contract even if it looked good on camera. You could claim he did things you didn't agree to in the contract. Of course there's holes.

No. Notarized contracts are a frozen moment in time and dont account for someone changing their mind.

The equivalent of, "Promise you won't get mad."

I would say video is the best way because then you have evidence DURING the act that it was consensual.

There would be more than holes in this. First of all, it wouldn't work. Sex is not usually preplanned, and it is often decided upon outside of normal business hours. Secondly, that contract is worth absolutely nothing, because consent is not forever. If a person changes their mind, then gets raped, the form would actually be evidence against their accusation.

The reason this consent question is so difficult is that the debate forgets the elephant in the room: common sense cannot be legislated.

If you don't intend on having sex with someone, don't get naked and get into bed with them. The best thing is to go home and sleep in your own bed. That beats any contract that you can sign.

Susan Brownmiller even thinks this positive consent idea is causing more trouble than it resolves. She said it puts women in vulnerable positions because they are not taught to use common sense.

The "solution" is to stream video and audio of the encounter to a secure server that can only be accessed by a court order. If there is an allegation of rape, a judge signs off and gets to review the evidence directly.

I know you're being ironic, but contrary to popular opinion, feminists don't want these insane standards for consent either. Feminists are attracted to dominant alpha males like any other woman. They go weak in the knees when their lover ignores this enthusiastic/verbal consent shit and assertively takes them. Why do you think women like muscles, getting picked up by guys, rape play, etc? These things all symbolize power and confidence. Some sniveling beta begging for explicit verbal consent is a major turn off.

So I doubt most feminists (except the ugliest ones and white knights) would actually want this stuff codified into law. It would lead to them being deprived of sexual pleasure too!

Yes there are holes big enough to drive a truck through. This whole idea is beyond ridiculous, it is impossible to implement or police and would lead to the end of the dating scene. The contract is pointless and easily revoked. Why didn't you withdraw the contract miss? "I felt intimidated by him, I was drunk, etc", now it is rape again. This is the worst idea I can think of.

Women want compensation for sex. It could be a promise of future friendship. Money. Attention. Something. If you fuck a chick, no matter how consensual, and then you completely ignore her, she will feel used, that's halfway to rape. Rape, for a woman, is sex without adequate compensation. Read any rape narrative where the charges are brought months after the fact. She was ignored. He ignored other women he fucked. He didn't return her phone calls. He's cut her out.
