Actually, apart from the lying about the age thing, my first thought reading this article is how it calls a man who "inappropriately touched" a girl sexual assault, whereas you have women having full sexual intercourse with boys this age and headlines more often call it "seduced", "sexual relationship", "affair", and "sexual contact" in the headlines and almost never rape or sexual assault unless it's in scare quotes

She knew exactly what she was doing, because she did it precisely to entrap him and then call sexual assault.

She is demonstrating clear understanding of the situation and intent to harm him.

Did she suddenly figure out age of consent laws and sexual assault in 24 hours? I really doubt it.

So, she actively misrepresented her age, then went to the police. Sounds like entrapment to me.

Maybe this problem needs another approach. She should be on a list, well publicized with illustrations, addresses and so forth. Not a "sex offenders" list, no, no, perish the thought! A list of ages.

Actually under Canadian law SHE is guilty of sexual assault, because under Canadian Sexual assault laws, it includes fraud, which she committed.

In practice it has to be serious fraud, like lying about ones HIV status to have unprotected sex, but this guy could go to jail so this qualifies in IMHO.

I hope she gets charged.

I find it pretty difficult to believe that a 12 year old could pass as 18, but I'm sure that there are examples out there. I feel like any guy who hooks up with a girl claiming to be 22 asks to see an ID or determines age due to other factors.

At this point, I don't blame men for carding a 28 year old woman. He has so much to lose for not being careful. I still get carded for alcohol, and I am way beyond 28.

Dating sites need to properly vet age.

If they list age they need to confirm it or they need to highlight specifically that the age has been confirmed or is not yet confirmed.

If she were 15+ then sure, it's reasonable to believe they are 18. But 12? No. Especially after she already admitted she lied (she changed 18 to 16).

He touched a twelve year old. They talked online and she said she was 18, but then they met in person and he still touched her. If he's that dumb I don't have much sympathy for him.

Would like to see some sort of addition brought to the criminal code for underagers misrepresenting themselves though.

He should be treated somewhat more leniently than someone who knew that the kid was 12. But really this doesn't seem like an honest mistake. He had a duty to verify her age.

He is at fault. She is unable to consent no matter what she does. Even if she makes up the most convincing lie with all the best evidence in the world, she is still 12 and thus her actions can NEVER count as consent. As such, assuming the man did actually touch her in a sexual way (something that will still need to be proven in court), it was done non-consensual and he is guilty of child molestation.

The only way to arrive at a different conclusion is to assume the sexual actions count as consensual because of the actions the girl took leading to their meeting up (lying about her age, unauthorized use of a computer network, etc.). But that means that a 12 year old could take a course of actions that allows them to consent, which is to say that a 12 year old can give consent (even if they have more hoops to jump through).

Either 12 year olds can give consent or they can't, and if they can't, it doesn't matter what the 12 year old does, the guilty is a child molester.

And this is why using age to determine consent is stupid, we should use mental maturity, and anyone who lies this much to get into a sexual situation is mentally mature enough to give consent.

First off, that guy has something wrong for not being able to tell she's 12. Second off, I think she should get larseny charges or something.
