I’ve gone through hell with false accusations. I’ve had to deal with a judge, being enraged with the fact that I even had evidence.

Perjury isn’t the point. The last thing our overworked criminal justice system needs is people going through a divorce who lied being added to their docket.

The point is to make the opposing party seem untruthful to the judge if you go to trial. If they’ll blatantly lie about one thing it’ll impeach their credibility when testifying, which is 90% of your case in a divorce.

Typically not; most of this is done in a District Court (at least in my state) and no one cares about Perjury there. I did family law for 3 years, and was a prosecutor for 3 years. I can tell you as a Prosecutor, I just wouldn't return the calls when someone tried to bring a case for Perjury. No punishment, huge emotions, so much better things to do with my time than wade into that shit mess.

I looked up about 6,000 family law cases from my local county, not a single one had perjury mentioned, about 50 of them went into 'forced disclosure of assets', 2 of them involved a subpoena to a bank/financial institution and none of them had any punitive charges for hiding assets. Just goes to show you how much lawyers lie and how misleading advice you find on the internet is

My ex lied about cheating and did so through the whole process. I knew but for her she knew I couldn’t prove it. She slipped and I was able to submit evidence of her admitting to having multiple partners through our marriage. Her statement was along the lines of yes she admits to cheating but we’re so far in the process it won’t make a difference. I took it to my lawyer who took it to the judge. My 50/50 custody went to 100% and she was forced to pay my court and legal costs from the proceeds of the sale of our home. Spousal support was waived and there was a clause put in that prevented her from taking me back to court for any adjustments.

So 100% custody.

No child or spousal support.

No court or attorney fees.

The only debt I carried was what I owed on vehicles.

All because she lied about cheating.

Its a great question and I think everyone knows that perjury happens in family court as well as criminal court. Ultimately, its a district attorney who would file charges of perjury and for a family law case involving some relatively minuscule amount of money that's just not going to happen. I mean in California they don't even prosecute outright robbery and theft, can you imagine a district attorney chasing down something as small as this? Check out this post.

The large and bolded font perjury warnings are a feeble attempt at scaring divorcing couples into telling the truth. Realistically, as others have said the most you can hope for out of proving she is lying is a favorable outcome in the divorce decree.

In family court, it does not.

Case in point. Both me and my exwife had to fill out the "Affidavit of financial information." We both testified that ours were accurate and truthful.

But my exwife was playing the "too sick to work" card. So she put down that she hadn't worked in 2 years.

Well I did the previous years taxes as we were still married. So she wouldn't give me her W2, she send me a cell phone pic of it. But on the affidavit, she didn't put down that job.

So I entered it as evidence, that she can work, she was working, and she was just refusing to work because she wanted alimony. Neither she, nor her lawyer went over the exhibits we had, including a print off of that cell phone pic of her W2.

On the stand, my lawyer said, "if you'll see exhibit 12 there's a w2." Her lawyer stood up and said, "I object, we don't know whose W2 that is!". I pointed to my lawyer the SSN on the W2. My lawyer said, "in box 2 there's a SSN. In box 3 there's a place name. Is that her SSN and the place she worked at?" The judge said, "The witness will answer the question."

My exwife squirmed on the stand and then admitted it was her W2.

Repercussions for lying under oath? None. But in the end, because of that W2, she was denied alimony.

Ex lied in discovery, on the stand and in sworn affidavits. Punishment? She lost the hearing where we both testified on the stand.

We were headed for trial and our plan was to impeach her testimony which basically means nothing she says is credible. If you can show a pattern of lies then maybe just maybe the judge will question her credibility and intent.

Honestly, family court is a joke.

So to answer your question there is a penalty for perjury that my ex found out about. The key part that any judge will look at is intent. It’s sometimes a high bar to clear.

My story first then I’ll comment more on yours. Ex and I went through the courts system as far as we could go racking up bills because she was asking for the moon. We got to the final step, where you have to go before a judge and give testimony on everything under oath. My ex had several lies that were annoying but nothing too crazy until we get to childcare. The ex on stand tells a story of how I withheld funds from daycare that I was supposed to pay. In tears in her eyes she tells a story about how she struggled that summer to juggle work and somehow taking care of our child during her time. The problem was that none of it was true. There was one small billing problem that when I took care of I told the owner that any other problems they were to come to me. I would take care of.

So when my attorney crossed her we had digital receipts showing me paying for the summer in question. We also were able to get sign out logs with my exes signature all summer long on it at a later date. To see the judges (a woman) face when it became clear my ex was lying. Classic. I’m pretty sure the judge also put added weight to my side of the stories on some of her other lies. My ex also fudged numbers somehow showing she’d paid more than 30k in bills where she’d paid less than 5k in more than a year. That was before her mom also had loaned her 10k.

The punishment? Before then I was probably going to lose my house. I got a decision that my attorney said I couldn’t have hoped for anything better. So they won’t be thrown in jail but there is a punishment.

Back to you. Everything you e said right now is circumstantial. At the end they’ll look at the evidence provided by both sides to decide who makes what. She can say she forgot she had the retirement fund and be given the benefit of the doubt up to a point. Again the main thing a court is looking at is intent. Are they intentionally lying.
