If you crash your car and kill someone because you planned to do it ahead of time it would be considered worse than drunk driving and you would likely be charged with first degree murder. That doesn't mean that drunk driving isn't bad, just not as bad as premeditated murder.

Think of making a bad choice like rolling a save in DnD. You roll a twenty sided die, then add your current modifier. If you roll under a certain scenario's difficulty check, you fail and you make the bad decision.

The problem with alcohol is that, once you take it, your modifier gets worse and worse. Say your modifier is currently +5, and the difficulty check for taking another drink is 12. So, if you roll at least a 7, you choose not to take another drink.

But, after your first drink, your modifier becomes a +4 instead. Now you need to roll at least an 8 to resist the temptation to drink. And the problem is that in many scenarios, you will be constantly asked to drink. You have to make this roll dozens of times in a single evening.

So you're sitting there, and you roll a 12, then 15, then 11, then 9, and finally a 5, so you take another drink. That lowers your modifier to +3, so you need to roll a 9 to resist. You roll 11, 19, 14, 10, then 9, and take another drink.

You can kind of see where this is going.

As for why drunk driving fatalities are more harshly punished than sober fatalities (assuming neither person intentionally killed the people in question), that's because you are essentially committing two crimes at once.

The logic behind drunk driving sentencing is that the fault is presumed to be yours as opposed to being split between you and another driver, or, in the case of a cyclist or pedestrian, often on that cyclist or pedestrian.

The situation with cheating is different. The cheater is always at fault. No presumption is needed. There is no equivalent of an "accident" with cheating.

Better/worse-whatevs. Doesn’t absolve the person of what they did. They have to own up and live with the consequences. And for a lot if people that might mean they should stop drinking and get let their partner be mad and move on.

I don’t think it’s worse unless you think the person in question specifically got drunk on purpose in order to lower their inhibitions in order to cheat. Which seems like a thing that has happened but probably doesn’t account for the majority of cases.

Most of the time, the person involved intended not to cheat and had enough self-control to restrain themself in normal circumstances, but drunkenness made exercising that self-control harder and they failed. It’s not any better in that circumstance (because they knew it was wrong) but I don’t perceive it as worse, either.

The problem is the drinking but the thing is, they shouldn’t have gotten drunk in the first place.

Being drunk literally turns off the brain in a way, people might think “oh wonder what happens if I jump out of that window” and act upon it because they can’t think of it in context or consequences nor understand that it’s just a random thought. They don’t think, they just act. So yeah in a way drunk people make shitty decisions they didn’t even want to. They get personality changed. I would assume men are more suspectible to drunk cheating though since they more often think “that woman looks good”.

Don’t drink and cheat, but it’s like with drunk driving. A drunk person can’t make proper decisions so why get drunk in the first place?

It’s not an excuse because the person made the decision to drink, but drinking does change the mentality of people.

What if they were so drunk the sex wasn’t consensual and they didn’t know who the rapist was or would show up (could have intended it to just be their friends then a rapist intruder showed up).

Having said that I think it has to be a severe situation to excuse it and for it to be rape.

I don't think the analogy really holds up.

Crashing your car and killing someone is an accident (in the given context).
Drunk driving, crashing and killing someone is an accident that could have likely been avoided if the driver did not choose to intoxicate themselves beforehand.

Cheating with a sober mind is not an accident. You don't slip and fall into doggy style. Instead of drunk/sober driving, cheating could better be compared to murder instead. A drunk person is far more likely to have thrown their rationale in the wind, instead following emotion and instinct. However, if a sober person kills, they had the mind to know what they were doing was wrong.

Nevertheless: let's not compare. Cheating is cheating. If they cheated while sober, they knew what they were doing. If they cheated while drunk, they still knew what they were doing. If they were drunk enough to not know, then they shouldn't have gotten that drunk. There is no excuse for cheating.

Disagree. Cheating is bad, but at least being drunk gives the excuse of not being in control of yourself. In New South Wales, there's a new law where if you're so drunk you can't say "Yes", it's legally rape, and you didn't actually consent to the sex.

Full disagree. Drinking lowers the ability to act rationally and people give into temptations a lot easier than when you are sober. So is cheating while drunk okay? Of course not, but it’s more forgivable than sober cheating.

Two examples: a guy and a girl who are dating plan to go out for a 4th of July party. Girl has a headache, man goes without her. Man does shots and plays some beer pong. He is teamed up with an attractive girl. They hit it off friendly at first but the drunker they get the more flirty it gets. She asks him to go out to the car to smoke a joint, he goes, after the joint is smoker she starts kissing him and they fuck.

This dude wasn’t planning on this to happen. He was planning on going to the party with his partner. Now is it okay? No, a better person would just not drink that much if they know they can’t control their selves or just removed them self from the situation.

Situation 2: same scenario different people. Guy downloads Tinder and is talking for a few chicks, girl says she has a headache so guy goes make an appearance at the party has one beer then goes meet up with one of the Tinder chicks and fucks.

Guy two is waaaaaaay worse.
