My husband used to date a girl for about a year and they broke up.

He mailed a few things of hers back to her address.

The cop showed up to our home and served him papers.

She filed for a restraining order saying that he sent her an unwanted package which counts as harassment apparently.

She got the restraining order after she took him to court on video chat and now that video chat of him in court is public record for anyone to see on YouTube making him look like a stalker when all he did was mail something back to her that belong to her.

The judge was a woman and wouldn't even let him talk.

Guys,

This is for any man that reads this small post from me. I went through all of these false allegations. Kicked out of my home, kids taken from, labeled an abuser. TOP put on me by my STBXW. This all happened right before COVID hit. Courts closed down, the world shut down. My case went in to a hold. Fast-forward to now. My case was dismissed and TOP vacated based on no findings. There's more to this but not going to discuss details. I had a great team of lawyers to pull me out of this.

Here are my recommendations. If you get served with a TOP because of false allegations.

The very 1st thing you MUST do is get a good lawyer ASAP!!! Read reviews online. That is a MUST!!!

2- DO NOT AND I MEAN DO NOT violate that TOP. Even if the allegations against you are 10000% false.

3- Once you get your lawyer. Provide every piece of documentation that supports your innocence. Videos, pictures, texts.... ANYTHING!!!!

4- Never EVER bad mouth her over voicemail or text. EVER!!!!

5- Follow that Order to the T.

6- Do NOT lie to your lawyer. He/she must know everything! They need to know how to build the case to get you out of the pile of shit you have been put under. Any information you withhold from them can be brought up in court and your lawyer is not going to be ready for it because you never said anything to them about it.

7- Listen to your lawyer and their advice. If you don't agree with it, then speak up as to why you don't agree with it.

8- When the lawyer starts to talk lawyer language. All the legal terms you may not understand. Stop them and tell them to speak in plain English. You need to be comfortable with what they say to you and you MUST understand it.

9- Stand your ground. There are going to be times you may bump heads with your lawyer and that's expected. But always stand your ground.

10- This is very important. Your intuition...if you feel in your gutt you have a good lawyer. Keep them. If you feel you have a shit lawyer, toss them ASAP!

I just came out of the darkest point in my life. I made it out alive. Huge family and friend support system.

But my lawyers were the ones that fought for me and protected me to the very end. Once things came to an end I told them. That I have gained two new friends at the end of this disaster. They were my lawyers.

I'm glad the case was dismissed.

But let's be fair there is a court order that bars him communicating with the women or her dependants. Sending a birthday card to his daughter can be considered communicating with her so he has breached the court order.

You wouldn't think it is enough to go to court for but all depends on the context of why he is barred from communicating to begin with.

He did something that he was expressly prohibited from doing though. The woman had a court order prohibiting him from contacting her or her dependents including their daughter. What is the issue here, is sending a card, birthday card or not to someone that you have a court order from communicating with not contravening this order?

I'm probably going against what the sub will think about this, but I'd say dismissing the case was a mistake if we take things at a face value.

IF we assume that the safety order is there for valid reasons (we can argue about that, but that's an entirely different conversation), then I think any breach of it should be treated as a serious matter.

Not because sending the birthday card in itself is bad, but because it establishes the precedent that a safety order can be acceptably violated. IF that order is there for a reason, then we shouldn't create the expectation that it can be broken because that's the kind of things that can escalate.

Again, I am assuming its validity. Arguing about that point is a completely different conversation.

Its not enough to just fight the legal fight for men's rights but also provide them with social support by educating men on how to deal with situations at home and help them learn how not to depend too much on women for emotional support. For that on a societal level some platforms needs to be created where men can fulfill their emotional, mental needs. A place where they won't be judged for being man and having masculine needs. For example a recreation space where they can pull away from overwhelming situations in life or a club where men can discuss their issues with like minded people.

The case may be complicated in law - we don't know the details - but the children will know of this gesture. The point is, the mother tried to deny the father even this gesture. The gesture was allowed, thank goodness, and the children can make their own minds up in future.
