What are your thoughts on a graded consent system?

Most states already have this. They are known as Romeo and Juliet laws.

These are called Romeo and Juliet laws in the US and I believe most states have them, although I can’t say for sure how many. I am in favor of them. What we need IMO is to prevent child porn laws that end up being used to prosecute teens who have either received or taken pictures of themselves. A teenage girl should not be prosecuted for the creation or transmission of child porn because she texted a picture of her boobs to her teenage boyfriend, and neither should he be prosecuted for receiving it.

Some states (from what I have heard) will make an exception under the principle that the law should not criminalize those it is intended to protect, but my understanding is that this is something overzealous law enforcement will still do. Someone can correct me if I am wrong.

There should just be a legal age of adulthood. Past that age, you’re a responsible adult who makes his or her own decisions.

If you can vote for president and serve in the military and your parents can kick you out legally, the idea that you can’t drink or consent to sex with whoever you want is silly. I don’t want people who are too immature to consent to sex voting for president or firing guns.

Or you could stop being a fucking creep and just date people your own age. An 18 year-old that can't find other 18 year-olds to date is a personal problem. It's not necessary to change the laws so they can commit statutory rape instead of improving themselves.

Makes sense. Teenagers are going to have sex -- that's just the way it is. Criminalizing teen sex is insane.

In California a crime is committed every time high school kids do it. Technically both participants have committed statutory rape and can be forced to register as sex offenders for the rest of their lives. Its a crime that's seldom prosecuted when both participants are young but its crazy to leave that to the discretion of overly zealous prosecutors.

14 and 21 still seem like a very big gap. But I do think "hard limits" are idiotic, teens (idk, 14-15 and over?) Should be able to consent to sex with someone close to their maturity level. But as far as I know this is in practice already the case (not always, but usually), in situations where criminal charges happen there's a big age difference.

A 21 should be able to sleep with a 16 mininum. Then we have 16-14 and 14-12 (not a law, just socially imposed). Prepubescent kids should learn how to not be completely retarded before thinking about sex.

Sounds like a very good idea. The whole point of having the age of consent is to protect teens from being taken advantage by much older people. Nobody should be criminalised for having consensual relationships with their peers.

Makes sense. I honestly don’t feel attraction to teenage girls, idk whether it’s the fact that it’s been so long since I’ve been a teenager, or maybe they aren’t doing it for me anymore, or maybe I just feel creepy going after a chick so young, but it’s just not for me. Hell I’d even have reservations on dating an 18 year old, and I’m 27.

what does the age of the other person have to do with consent?

if a 16 year old girl is truly competent to consent to sex with a 16 year old boy, then she is also competent to consent to sex with a 99 year old man.

you may believe that a 16/99 sexual relationship shouldn't be allowed but a 16/16 sexual relationship is ok, but it doesn't make sense to base that distinction on consent.

the fact that you think that teens need to be protected from adults means that you think teens aren't really competent to consent. and if that's true, why is it ok for a 16 year old boy to have sex with a 16 year old girl? surely you don't believe that no 16 year old boy will be abusive or manipulative or grooming girls?

Depends on how you plan to explain and prove consent in a court of law, and what the repercussions are of a legal system that doesn't empirically follow the written law that you plan on implementing. Consent is a useless concept, it's a cop-out that allows a woman to accuse any man of a high-tier crime while putting an impossible burden of proof on the person accused, not the person doing the accusing. How can you prove consent when discussing an intimate interaction where there were only two people who were present, and where the two people disagree?

So, to answer your question, I think that having this discussion is like talking about going into outer space without first discussing how we are going to put together the funds and the expertise to accomplish the task.

I personally don’t think the German system makes any sense. Why would a 22 year old be any different from a 21 y/old? I think consent should be based on child labor laws, in case a teen pregnancy occurs. In the US, you can drive and work at 16 so that’s what the age of consent should be.

Age of consent shouldn’t be based on some nebulous concept of when an individual is physically or mentally ready. It should be based on when an individual is realistically able to deal with the consequences of their actions. A 14 year old can’t legally support a child so 14 is too young to consent.

I have better proposition: no age of consent for boys at all; girls from 15 to 18 can have sex with guys under 18 only (no 21 is way to high here) and girls over 18 can have sex with whomsoever they want.
