Young begged the Magistrate court during court appearance to let her go on a 5-day holiday with her parents at Summerland Point on Lake Macquarie. But the court declined her request. The Court also declined her parents’ separate request to let her go with them.

I'm not sure about NSW but my state in Australia the age of consent for males when I was growing up was 14. That obviously ignores position of power abuses that have many other laws. It was 14 for boys, 16 for girls.

A piece of legacy legislation also made it so that you could not consent to sodomy (anal) if you were a girl until 18 and until the 2000s you couldn't consent at all if you were a dude. It was one of those gay panic laws that was still on the books from the mid 20th century that they had to fix. It was one of those things simply ignored unless someone said it during legal proceedings then when asked if they wished to rephrase or take back any statements, they declined.

We’d also have courts ruling guilty bs innocent, rather than what we do have which is guilty vs not guilty. The line is that you have the right to be CONSIDERED innocent until proven guilty. Errr. Is it at this point I should point out I’ve actually worked criminal defense? In order to qualify for bail, you have to first not be very likely to repeat your offense, see the two lawyers that firebombed a police car to see how you can become ineligible for bail for that.

You then also have to not be a major flight risk, which child molesters rarely is able to establish. And here’s the thing, bail is you having to convince the court of both these points. Bail hearings don’t work like a criminal trial and there is no standard of proof and there’s no specific bar that the prosecutor is required to reach.

And here’s something for you to consider perhaps, but during a bail hearing, you are presumed guilty, not presumed innocent. Or rather, everything the prosecutor says is presumed to be true, and that includes their most serious accusation.

So yea if you’re on trial for child molestation, your bail hearing is done under the presumption that you molested a child, regardless of what the truth is.

The presumption of innocence is NOT “in the eyes of the law” as you claimed. Police would not be able to arrest anyone if that was true.

No, the presumption of innocence is very specific and applies to trial courts and ONLY to trial courts. It does not apply to police, it does not apply to your bail and it does not apply to the public.

Lots of people do. As long as you can convince a judge that you’re not going to repeat your offense prior to conviction and you’re not too big of a flight risk. Just because you’re considered guilty does not mean your flight risk is unlimited or that you’re guaranteed to repeat your offense.

South Park had an extremely popular episode, wherein a teacher has sex with toddlers. The officers response was to simply say 'nice.'

If you go into any thread of any female paedophile, you will find this comment, dozens or hundreds of times, often upvoted to the top.

When you go to the actual articles themselves, you can find no mention of rape, simply that they had sex.

To pretend South Park hasn't made this particular thought more common, or acceptable as a form of joke, is laughable. So yes, they absolutely started the trend of people openly saying 'nice.' and wishing they were the child that was raped. Its extremely popular media that shapes popular narratives and opinions these days - one episode, done in satire, can have the opposite effect intended and cause people to agree with the satire, missing the joke.

Another great example of this was Chris Rock's comedy routine which has a name that i won't say here, or i'll get banned. Anyways, Chris Rock ultimately retired the routine, because genuine racists were quoting it as an excuse to be racist towards black people. In this way, a stereotype/shock comedy routine, intended to be nothing more than laughed at then brushed off, ended up having racists nodding their heads in approval, who would go on to quote it as a defence for their racism.

The difference between being allowed to work near kids or not. A rapist will never be allowed to work around kids, yet a woman like this who does 6 months house arrest looking for employment will have no such restrictions on her life.

I could go on, but the words and labels used impact societies view of the incident, and that impact is possible to be equally as severe and long lasting as any government imposed punishment (or lack of). We must fight for the labels to be applied equally!!
