When my Ex filed end of July '24 after 20+ yrs of marriage, I went thru our phone records and bank statements to find out why I came home to a half empty house with a note 6 weeks prior. I found 3 separate charges for local hotels on dates when she said she had stayed at a friend's house cause it was a girls night and she didn't want to drive home drunk. I looked back on our phone records, and during the month before she filed, I saw 731 texts and picture msgs to a single phone line. To which I traced it to a man that lived in another town. I told my lawyer this in Idaho and he said It'd be tough to prove, could cost a lot of money (I had already paid him $8K for a retainer) and it could drag out the divorce process thru the court for more months and possibly years if I wanted to go that route. I didn't want to go that long still being officially married to her. I got my wish 3 months later in Oct '24 when the judge made me an official single guy once again. It could harm you financially in the long one is what I'm saying.

Asking for phone records from post-separation is harassment. If she has already harassed people you have called you have an argument to quash. Otherwise you’re likely stuck even though it’s stupid.

After separation it means nothing. Hell, even during marriage in most states it means nothing

In my experience, attorneys rarely issue subpoenas. In my personal cases (civil litigation, child custody&CS and now DV) exactly zero attorneys have issued a subpoena to anyone. Meanwhile, I have issued 5 as a pro se.

Regarding your case, subpoenas must be issued for a lawful purpose. Your phone records will demonstrate no wrongdoing and therefore are basically useless. A subpoena issued to you for them is done to needlessly harass you and you should protest it.

Cheating isn't a crime, unfortunately. It doesn't matter what you're doing with other consenting adult women.

A formal subpoena is different than asking for records in discovery.

You will need to file a written motion to object to the subpoena or file a protective order with the court to keep the information from being released by the cell carrier.

Cell phone carriers will comply with the subpoena if you don’t object or file protective orders.

Redact information in Adobe. Send PDFs of bills but take out dates locations. For phone bill redact what you need let them complain and petition.

It's just harassment unless you.legit blew 200k in Vegas in marital funds w some girl.

So harass them back and refuse delay or redact

What about before date of separation. In a no fault state, phone records showing the start of an affair wouldn't matter, right?

In discovery, you have to provide. It doesn’t have to be readable or useful, especially for something that isn’t going to help your side. You are providing the information, not interpreting it and making her case for her. For example, provide a bank statement. That doesn’t mean print out the bank statement. It could mean all the transaction data, pasted it into a janky useless excel spreadsheet that makes it very difficult and time consuming to associate the date of the transaction with the recipient or what was deposited or withdrawn, then print it as an image that can’t be searched. She can then decide if an MTC is worth it, or struggle to see if there’s anything useful in there.

Also, she can subpoena anything she wants. Company is likely to send her a long list of objections to the subpoena, and some worthless tidbit of information, like confirming the last 4 digits of your account.
