Odd article really, this is what the criteria for a false allegation is wanted to be.

The problem that I can see is to have it as unfounded would require the accuser to face the 95%/beyond reasonable doubt of being false, and face prosecution themselves. By this definition, unfounded can only mean that there is no prosecution possible against the accuser. Not unfounded being defined as being insufficient evidence to prosecute the defendant.

The literature seems to always have the bias that:

There are not enough prosecutions against men
False allegations are over reported.

Bizarrely enough there seems little literature about non hetrosexual sexual assaults and false allegations.

Essentially the allegation can only be deemed false if there is an investigation that would have enough information to be able to prosecute the accuser.

It's great, but won't make a difference in the aftermath. Just being accused means the end. No one will remember that a man was accused falsely. Everyone will remember that he was accused. Full stop. That's is. It's all you need. For the rest of your life you will live with weird looks, non communication, rumours that grow tails etc. You lose your job, business, friends, even family. If it was someone who was raped, accused their rapist, there wasn't enough evidence to convict (because c'mon, how many witnesses are there to the average rape) and the court turns around and goes "well we couldn't prove it happened, so it didn't happen, so that was a false accusation", it ain't something I'd cheer over.
