The problem is how most state laws are worded. They say that to penetrate without valid consent makes one a rapist, to be penetrated without valid consent is to be a rape victim. So, if a man and woman are drunk, invalidating consent, then the man is by definition a rapist and the woman a rape victim, even though they both consented under the same conditions.

This really needs to change.

Consider this scenario:

a woman goes to a bar and does 12 tequila shots and gets angry drunk, smashes a glass in the bouncers face. Leaves the bar and buys a $1000 purse, calls her boss and quits her job, then steals a car, runs over the owner, drives drunk hitting several parked cars, drives to her ex boyfriends house where she climbs in through an unlocked window, gets in bed and initiates sex with the sleeping man.

In this situation, the woman has comitted multiple felonies, made large purchases, and bad decisions, and she will be held responsible for all of them because we hold drunk people to the same standards as sober. but then she was raped, because she was unable to legally consent.

where is the logic here that for literally everything else, drunk people are responsible for their actions, but not sex...and only for women. the script flips 180 degrees when drunk women get horny

If both are drunk it’s not rape, if one of them is drunk and the other person is not and takes advantage of the situation it’s rape, doesn’t mater if it is a man or woman. But the child support just shouldn’t happen if you didn’t want a baby, unless abortion is ilegal in that country and all of the emergency contraception failed, then the burden should be with both of you since you both had sex even if you don’t remember

“A couple get drunk” I firmly believe that if both people are intoxicated and they have consensual sex then no rape was committed. However, if one party is sober and the other is heavily intoxicated or incapacitated and they have sex that’s where it seems more rapey. I’ve never understood the sentiment that all drunk sex is rape. Drunk sex can absolutely count as rape but not all the time or even most of the time.

If a woman drinks and has sex, she can avoid all consequences of her actions by claiming she was drunk at the time and the man is solely at fault.

But if a woman drinks and then decides to drive while intoxicated, she's liable for all she did.

I'm not sure why our society says she's entirely liable for her actions (while drunk) in one scenario, but not in the other.

It's not for many reasons 1) because the woman would never win that rape case legally. 2) men should be obligated to financially support their child. If you dont want to pay child support, use birth control or dont have sex. 3) Maybe if all the baby-entrapment minded men were as obsessed with using condoms as they are with women being baby entrappers (they're not, they either dont take the precautions to be in control of the chances of pregnancy or "cOnDomS dOnT feEL goOd" )it wouldn't be an issue?
