Do NOT have any financial entanglements post-divorce. Sell the house and divide the profit, or loss, equally, and have this all spelled out in your final divorce order / decree / settlement.

Post-divorce, no financial entanglements. No property, no houses, no cars, no accounts, nothing. You want everything separated, divided, and owned by the ex spouse and you free and clear. Else you run the risk of years of post-divorce litigation which will cost you a fortune.

File first and list. Be aggressive on price and take the L as quickly as possible. Remember you’re only taking half an L, half of it is hers. Housing is seasonal and you’re already heading into the price slide unless you want to wait for the spring. I know Zillow is being bullish on the market and I guess they have to be but this all looks very 2006/2007ish - prices on existing inventory could slide well beyond a year.

I wouldn’t hold this asset and rent you’d be amazed how quickly they go from amicable to scorched earth during the divorce process. Once they realize they don’t get to just keep everything something in their brain breaks.

File for divorce before you start taking big financial actions. Then get court permission/order to list and sell the house, specifying value, agent(s), minimum price, date of listing, asking price, method for stepping down asking price, appraiser, inspector, disclosures, requirements to sign things, etc. Leave no space for either of you to stop, slow down or interfere with the process.

The market could tank in a year and you’ll be further behind. Can you afford to keep the house? (if there’s no equity then the shouldn’t be a spousal buyout- she can just sign her interest in the property over to you) if not, sell it and split the loss.

I was similar to you. My wife cheated and then left within a year of purchase. My question for you… Can you not afford the home yourself? If there’s any way you can do that it would be the best solution. Since the home is just purchased there is no equity. Nothing to buy out there. It actually goes down as a debt as far as the court is concerned so it helps you with negotiating your other finances. Your argument should also be that putting it on the market now and selling loses you the funds that go to realtor. It’s a sacrifice for you to take over the loan.

My ex actually forced an appraisal of the home. Thankfully it came back right where we purchased it. I’d probably be paying the same cost if renting an apartment. You should really try and stay if possible.

I had the same hapoen. Bought a 5 bed/6bath and that summer, she wanted 'separation'. I found hundreds of texts to another number on our cell bill and put 2 and 2 together. I had to refinance at a higher rate to get her off and kept the house. Cut your losses and get rid of that house unless you can comfortably afford it. Good luck bro.

You don't say how long you've been married, or if your wife's name is on the Mortgage or house Deed.

The very first thing, and do this right now, separate your finances. Open a new account, move half the money there, and have all future Direct Deposit going there.

Then ask the wife if she would be willing to sign a Quit Claim on the house. In exchange for a promise from you that you will remove her name from the Mortgage. Try to get her to sign the Quit Claim immediately. You can use the martyr tactic that you don't want her to suffer from the short sale on the house. Once you have the Quit Claim signed you file file it with your County Court house. Then you can rent the house and not have any entanglements.

You can use Lawdepot.com to create the Quit Claim.

So my ex dragged out my divorce for 7 years.. i had to pay her half of the value of my mortgage payments.. plus youd prob have to pay her half the rent you make. Thats besides the point that the value may go down. And the current interest rates are ridiculously high.. you be better off likely selling.

Not sure about if you could pull it off.. but maybe you can guilt her into being responsible for more of the debt.. if you sell...or maybe just signing over the house... then doing rent...

Happened to me. I bought her out and kept the house. It didn’t cost me too much because there wasn’t too much equity. If that’s not a possibility for you right now, I would sell and cut your losses. You don’t want to have to deal with her later.
