Ohio is a 50/50 state with an option for no-fault, but also treats divorce like a business transaction when it comes to assets. It assumes you shared all resources freely and equally, so it doesn't matter who paid how much of what. If the house was purchased during your marriage, Ohio sees it as a marital asset, even if one of your names isn't on it. Without a glaringly obvious reason why it shouldn't be, it will be treated as such, meaning 50/50. She'll have to buy your share of the equity, or barter her half of the other assets for it.

The forms are available online via state website. It outlines spousal support based on yrs married and such. Also what child support would be if you know the income numbers. You are also entitled to 50% of marital debt. Something to keep in mind. Also 50% of her 401k stocks or other investments made during marriage. Also 50 of savings accrued during marriage. And vis versa. 50/50. Really you should settle for nothing less. That is what the court would decide if all documents have been provided. She may say this and that but it's all hear say. The REALITY is 50/50. You may want to retain a forensic accountant if you feel she will or is hiding money. Good luck. Stand up for yourself. If she proposes anything other than 50 of everything tell her to kick rocks. There can be a discussion that makes it equal by doing this and that but do not give up your right to your marital assets. She would do the same in your position.

Yes I have an attorney. I have filed and she should get served this week. I kinda did some attorney shopping to be honest. I ended up with a fairly new female attorney but she works for a very established firm in my area. I quess I just like to think out loud so to speak.

Divorce of course is her idea. We both let each other down in many ways during our marriage though it also still had good times and affection up to the end

For me at least. She was apparently just gritting her teeth for the last 5-10 years out of 24 married (30 together)

My advice is to remember that this is now a business transaction.

Keep emotions out of it.

No anger, no being a "nice guy", no crying or feeling sorry for her.

Don't take advantage, and don't offer to do more, or to do less.

Be strong and ensure you get your fair share, for you and your children.

If you’re fine with her keeping the house she’s going to have to buy you out and pay half the equity which is rightfully yours.

I’ve skimmed your post history and would recommend getting a good divorce attorney. She apparently doesn’t think you’re entitled to anything and thinks you should just walk away with nothing. Do not under any circumstances fall for this and when she figures out that’s not happening it will probably get very ugly very quickly.

50/50 split of everything. Custody, home equity, retirement accounts should be balanced to 50/50 along with all of your other financial and physical assets. And yeah if she makes double your income she’s going to owe you child support and spousal support.
