Lets do some critical thinking on this for a moment.

If one out of every two people are black in a metropolitan area, being around black people would be quite normal. If solely being around blacks made her feel uncomfortable, and was worthy of calling the cops over, then she'd be calling the cops all day long.

I feel like i'd be more inclined to believe you if something like that was the norm, but it's not.

People like to pretend that the shit that happens to black men is simply due to racism, but black women aren't the ones filling up the penitentiaries, they aren't getting pulled over for DWB, they're not the ones getting stopped and frisked, and they aren't being subjected to police brutality at anywhere near the same rate as black men.

I'm not gonna pretend that race isn't an issue in some, if not many of these cases, but the fact is that black men are subjected to this type of shit mainly because they're men, the color of their skin is just an aggravating factor.

I still feel like race is the more deciding factor in this scenario. I also admit my example was flawed. Black women are still discriminated against and there have been pretty good examples of that in the news recently. I only meant to draw focus on the matter being a race issue more than a men's rights issue. However, I do agree because the person this happened to was a man was a huge contributing factor in them thinking they could use more force than was necessary.

This isn't a very good comparison. It the case you cited, the court ruled the stop was legal because the driver had a damaged tail light that wasn't working and that it is reasonable to assume that the law required two working tail lights to be in compliance with safety regulations. It would not, however, be reasonable to assume it is illegal to stand near an atm, as the atm is located in a public space, accessible by a public sidewalk. Standing in a public place is not sufficient to generate RAS or probable cause to detain a person.

Technically they can detain anyone for a limited period of time based on "reasonable suspicion". Unfortunately reasonable suspicion is open to interpretation and can be used to defend many wrongful arrests as it likely will with this one.

Basically even if you're being arrested illegally it's still on you to comply with police orders. It's just another way the system can fuck you for standing up for yourself.

Reasonable suspicion could be driving under the speed limit (because criminals wouldn't want to be pulled over), driving exactly the speed limit (because criminals wouldn't want to be suspicious), or speeding (because that's breaking the law).

Yup. When I was 19 I drove a shitty beat up old white Buick Skylark. I got pulled over multiple times while driving under the speed limit in a nearby upper class area for "suspicious behavior". I was just commuting back to campus from my night job at a pizza place across town.

A crime or intent to commit a crime.

Any "suspicious" behavior can be construed as "possible intent to commit a crime" in the mind of an officer, so it's very open to abuse.

The issue we are discussing and that you are now trying to get out from under is the underlying charge for resisting arrest. Suspicious behavior is not a crime. Therefore, suspicious behavior of the intent to commit a crime is not a crime and cannot be the underlying charge for resisting arrest.

Police officers respond to calls for "suspicious behavior" all the time. I'm not talking about their actions actually holding up in court, I'm explaining the reasoning used by officers to press charges like resisting arrest without any other charge for arrest in place. It's often legal in cases when the perpetrator responds with physical aggression or resistance to legal detention. I don't know if that would fly in this particular case.

It is legal to detain someone for a specific amount of time without charges under reasonable suspicion. An officers suspicion isn't always actually reasonable, obviously.

That's just not true. The police can arrest people without underlying charge. E.g. if the police wants to scan your body for weapons and you resist, they will just arrest you and then scan your body. The same goes if you are just in the way and refuse to cooperate with the police.

Having too many people around is dangerous in some situations and the police will try to defuse these situations by asking you too leave or arresting you if you don't leave.

Of course, without a charge you'll be freed a few minutes/hours later when the situation is resolved.

The police doesn't do this for fun, but only if it is neccessary to ensure the safety of police officiers. No police officier want's to arrest people needlessly because that will cause paperwork for them, and I am quite sure they hate that.

I've had problems understanding the wikipedia because it's too complicated Enlish language for me. So I found this, which is way more detailed anyway.

It states clearly that once you have been arrested, resisting is illegal, even if the arrest was illegal itself.

"Probable cause is established through factual evidence, and not just suspicions or hunches."

"Probable cause can be established through observation alone (sight, smell, sound, etc), and includes observations that create suspicion based on a familiar pattern of criminal activity, such as when an officer sees a car circling around an area repeatedly or when someone is flashing their headlights."

"Probable cause can be based on information derived from witnesses, victims and informants."

These three points in combination allow the police to arrest him, probably (we can't know since there's no footage of it).

We have the information derived from witnesses (A person standing in a position (right at the door to the ATMs at a bank), that is unusual and lets him observe people using the ATM). This could very well be a "familiar pattern" that was used by robbers before. Him standing at a strange position and acting strange otherwise could be both factual evidence and a familiar pattern. This means we have no base in judging the police with the information we currently have.

Killing on only legal in self-defense. Self-defense needs you to be in immediate mortal danger. Arresting does not put you in immediate mortal danger. If the officier does put you in mortal danger, he's basically not arresting you, but attacking you.

But it's true, a charge is not neccessary, but "probable cause" as I learned just now. I was wrong that the police can just scan your body for weapons, they can't do that unless they have reason to arrest you.

However, if the police arrests one person and askes you to keep distance and you refuse, you are obstructing a police officer which is illegal, which means they can arrest you.

They don't need a reason to arrest you too scan your body. They need Reasonable and Articulable Suspicion. This is a level of evidence below probable cause but above just a hunch or "gut feeling". This is the level of evidence needed to DETAIN you. There is a difference between a weapons pat down and a search. A weapons pat down they are not allowed to go into your pockets to look, they basically just have to pat down on top of your clothing. You are not allowed to resist this, and upon resisting can be arrested for whatever charge they deem appropriate. The reason resisting arrest usually is mentioned in these situations is it is one of the easier ones to understand. It might not be that one in the end. It could be something like obstruction of justice.

The video doesn't show anything. It shows them after whatever provoked this incident happened. Whatever happened to provoke it, he is resisting arrest which may or may not be an appropriate arrest. We don't know though because the video conveniently starts when he is resisting arrest.

Things like this are why BLM are such a joke. Police were called in for an incident. The call was for someone that may be attempting to mug people at an ATM. Suspect was likely hostile in regards to the accusations whether they were reasonable accusations or not. Police do what they need to do to neutralize the situation. Resisting arrest ensues. This is what police are supposed to do. Its their job. They didn't just walk up to him and start doing this. I would put money on it. You know how you don't get in this position? Don't act like an asshole to cops when they show up responding to a call. If he was calm and polite we wouldn't be seeing this. Its not a matter of race. Its a matter of knowing how to talk to people in a respectful manner.

I'm a hispanic man in LA and I've had two encounters with the police. Both times, I've been able to tell that the officers are initially on edge and trying to get a feel for the situation. They have their guard up because they don't know if I'm a threat.

Both times, I stayed calm and respectful and the cops ended up being nice in the end.

I'm sure if I were used to disobeying authority figures and I opened by yelling "Man why are you bothering me! ? I didn't nothing!" then I would have had a worse time.

There ARE asshole cops who abuse their power every step of the way but I also think the vast majority of these abuse scenarios are caused by the initial aggression from the citizen.

Let's be honest here, that's not how you act towards the police. Shouting and opposing is just not a good strategy, just stay calm and be cooperative, even when they arrest you wrongly.

If black people often act like this towards the police (I don't know if that's true), then I can understand why the rate of police shooting of black people is high.

A policeman is always in a bad situation and could always be attacked. The first priority of anyone, including the police, is to ensure your own safety. If you, as a police officier, let people in a critical situation be in a higher escalation level than yourself, you are in immense danger. That's why you always need to be on a higher escalation level than anyone. If someone pulls out a knive and is in some distance, you pull out your gun. If someone pulls out a knive and is very close or pulls out a gun (or anything that looks like a gun), then you shoot. If someone resists, you arrest him and ask questions later. That's how it works. Lowering the escalation level is only possible, when you outnumber the people around by factor 2-3, and even then only to some degree.

Of course I don't know how he behaved before, how he came into this situation, but that's exactly why we can't decide that this is shocking. Maybe the video of what happend before is shocking and the police behaved unreasonably, but without that info, I just don't know.

People always seem to forget that policemen act like that to protect themselves, which is their right. The police is the authority for good reason.

If you want to stay safe, keep calm, don't move suddenly (it may scare a policeman in some tense situations), keep your hand palms casually visible, show your face, be polite and cooperative.

I know that stuff, because I learned such things in the military service. When we practiced arresting people, we where always much faster and less careful than these cops (and we practiced on each other), because speed is important in these situations. When you are not many people and two of them are busy by arresting one person, the situation gets more critical and dangerous. The safer the situation, the more time you can take for arresting, and the less it will hurt. Unless you try to restist, then it will hurt intentionally until you cooperate.
