One could argue that the classic marriage contract was designed for a time when divorce was very difficult if not impossible, so even if divorce is not 'unfair', the contract now is. There is social pressure on you to not have a prenup, and asking for one can cause problems with your significant other because of the signal they may think it sends.

The related issue is child custody and support. This seems to be where things can become more unfair to men, but one has to also realize there are no good solutions when most marriages breakdown. Joint custody is often a disaster. Despite the theory of gender equality and there being no preset gender roles or differences, in reality most kids are better off with their mothers, even if both parents work full time. As bitter as divorce can get, maybe men have to remember that this woman is and always will be the mother or his children. Don't say things to her in anger that cannot be taken back, no matter what she did. If you make it so that joint custody is unworkable, it will be unworkable and the courts will have to choose.
