More importantly, how did they determine the child support schedule? I have yet to find an answer to that. Courts compare the gross income of both parties to a chart that determines the amount of child support that kid is supposed to receive. Who tf came up with that amount? I mean I want to see the formula and reasons behind it, because it's absurdly insane!

Sidebar: moving forward only focus on things in your control. Example: in the case of future promotions that will raise your income, factor in the total return value to you: is she working , what will the taxes be, who will supervise you and how much will you lose to her?

Case in point , myself : I passed on two promotions because I’d lose 30% to taxes, about 30 more to my unemployed ex, and have a headache of a new supervisor. My ex was salivating for that new cash but it never came to fruition for her. Wasn’t worth the total price for me

ETA: case 2: Buddy was DV’d a decade ago. Promoted three times afterwards and increased his income substantially. 8-9 years later, his remarried, employed ex was somehow able to convince the court he’d “underpaid” her, and he had to “pay back” thousands for about 18 months . Of course, before he moved up in salary, she made no such underpayment claims.

I was surprised to find out I had to pay child support and spousal support based on a salary figure that includes a bonus which isn’t guaranteed. Is that the same in the US when you talk about gross salary?

Thank the 2017 tcja. Before that person receiving the money would pay taxes on it. Mine was getting 63k per year for 3 years before the judgement, and now is getting 59k+ for 5 more years.

10 year marraige. 8.5 years of payments. No kids. Shes also getting ssdi for 1700 a month. Doesnt work but is healthy enough to have sex with randoms...

What’s even more shitty is how paid alimony can’t be deducted to your income now when filing taxes. So essentially Uncle Sam sees the divorced dad as a rich man, even though he is quite poor after everything. At this point the child support doesn’t scare me as much as the alimony and 401k payout she will get.

On paper the government doesn’t care how much we give to the ex. Just sucks balls. The system was designed to scare people into staying into shitty/toxic marriages no matter what. Meanwhile my broke ex will be bringing home more than me after deductions, get a huge $100k+ payout to reboot her life, get to claim the kid on taxes, and everything else. Divorce is horrible for men no matter how you look at it.

If it's any consolation, gross vs net doesn't really make much actual difference. Because the primary function of the CS formulas is to compare your income with your ex's and then arrive at proportional coverage for a given, formula-based amount of child expenses. So comparing gross to gross is basically the same as if they calculated net vs net, but without introducing the ability to fuck with numbers via deductions etc. And it's not like they're looking at her income or whatever they set as the total cost of X kids on an after-tax basis but charging you based on pre-tax dollars. It's just all calculated on the pre-tax side to avoid the complications/gaming opportunities that running the calculation after-tax would introduce.

Don't get me wrong: nothing about the paragraph above denies that CS generally is a fucked system for the higher earner. Equal overnights (for example) but the lower earner gets a general life subsidy (most often from the person she chose to bail on, contrary to her commitment) just because her ass earns less?? It's total bullshit, I agree 100% with that. The point above (which, again, I hope actually helps at least the "fuck, this is gross??" realization sting less) is that doing the same calculation on a gross basis vs net isn't what's killing you, even if the fraction of your check going to support very well might be (and that unfairness, again, I'm 100% with you on -- but that's just an objection to the welfare-for-lower-earner design of CS generally, not a problem with running the calc on a pre-tax basis all around).

The courts shift dollars to keep things basically at status quo. Most (all?) seemed to do this after the 2018 tax changes.

Here' an analogy. Local districts made restaurant service fees illegal. So the salmon went up a couple of bucks. Same thing.

Overall, alimony is evil.
