I agree but I don't get why a cop was called in the first place. These are people trained to believe they responding to threats to public order and peace. People are so quick to call the police when they feel annoyed or inconvenienced but they don't think of themselves as dealing with those kinds of problems.

Just because a teacher may be wrong, doesn't mean you can refuse to leave class when told. And even if the teacher was wrong, doesn't mean you can resist a police officer telling you, lawfully, to come with them.

You may have a point about "blind obedience", but the woman in OP'S post does not deserve that defence. She wasn't "being different"; she was being a disturbance to everyone who was there to learn by not leaving when told.

Refusing to leave did not justify that result under the continuum of force. That was unnecessary, brutal and disproportionate.

Refusal to leave led to the calling of the authorities for trespassing. Completely valid.

Refusal to accompany officer when asked led to being arrested.

Resisting arrest led to being taken down physically.

I do know this because there is a well established rule regarding how an officer can escalate a situation. This use of force continuum is the same reason it would not have been acceptable to just pull out his gun and shoot the girl. It is not the minimum needed to effect the arrest. In this case what he would have been justified doing is applying a pain compliance technique, i.e. grabbing her arm and placing pressure on the joint until she complied with the order to stand up. If his actions were considered reasonable by the sheriff he wouldn't currently be on suspension pending an investigation. When the sheriff saw that it was clear that this was not a reasonable and proportionate escalation, if it was there would not have been a suspension. Automatic suspensions only occur in cases where firearms are used.

I'll believe there was excessive force when I see anything that shows that the girl sustained damages from the altercation. The officer grabbed her to get her to stand up. You see her react and grab the desk to prevent the officer from lifting her. The officer used force to get her to let go of the desk.

Looks dramatic, but I doubt it was as brutal as you seem to think. Again, I could be wrong, and she could be hurt. But I doubt it.

Clearly the Sheriff thinks his actions were not reasonable - there is a reason he was suspended pending an investigation.

When a teacher asks you to leave their classroom, you pack your shit up and leave. If they were in the wrong, you have a conversation about it with administration. Sitting in your seat when asked to leave is just stupid.

When a police officer gives you a lawful order, you follow it. Resisting arrest because "my teacher is in the wrong" is plain stupid.

There is a time and place for civil disobedience as a means of protest, if that's something you are into, but this doesn't even remotely resemble such a situation.

That is your house and your property, you have the right to protect it and if someone won't leave you have the right to do it by force.

Since government property is under the same laws as personal property the officer had every right to protect that building by using force.

When they asked her to leave, legally she was trespassing. If I invite someone into my home, and then ask them to leave, and they sit on the couch and say "no". It's the exact same situation as what she did. If someone enters my home without my authorization and refuses to leave that's breaking and entering AND trespassing, two separate crimes, but one of the crimes is the same as hers. You've assumed that breaking and entering + trespassing was a single crime when they are not.

She was legally required to be there... Until they asked her to leave. When they asked her to leave, they authorized her absence from compulsory education. Same as how students who are suspended aren't considered Truant.

Don't make assumptions about me. What the officer did was extreme. But it was also in the moment and a reaction to her starting to hit him in the head, Then he threw her on the ground. She wanted to start a fight, and he ended it. (in case you didn't see it, her right arm just as he puts his hand around her neck to pull her up. She hits him once and is about to hit him a second time when he starts to throw her on the ground.)

You're defending someone who's depriving everyone else in that class an education because she doesn't want to give up her phone for the rest of class. She's effectively taking away their right to an education. Her right to an education is dependent on her actions. If she doesn't follow school rules, if she doesn't do her homework, she's not taking advantage of that right. But when she has a negative effect on the rights of those around her, she needs to be removed from class. Have you ever had a class with someone like that? One of those people that has specific plans to go nowhere in life. Now imagine they dragged you down with them? You wanted to go to be an engineer? Too fucking bad, that one asshole decided you didn't need to learn math. You wanted to be a doctor? Too fucking bad, that one asshole decided you didn't need to learn biology. You wanted to be a writer? Too fucking bad, that one asshole decided you didn't need to learn proper sentence structure that day.

The officer who was fired was known as "officer slam," and was a repeat offender of breaking protocol in a violent manner while making an arrest on a minor.

Being fired is an underreaction. That man should be behind bars.

There is absolutely no justification for his behavior. Defending it is, quite frankly, despicable.

I think that there's a lot more going on than in the video.

They have some crazy laws passed in that state from what I've been hearing it's a crime for a student to "be disruptive" in the classroom.

Her refusing to get off of her cell phone was deemed by the teacher to "be disruptive" enough for a campus cop to be called into the classroom.

Sorry, but there's a whole lot wrong going on here and that the teacher should have handled the whole incident differently. The low grade cop should have NEVER behaved this way. He clearly doesn't understand how to use authority to get the kid to leave the classroom with him.

and Finally, the whole issue with him muscling the kid to where she's sliding on the floor - as the police chief pointed out, that's a "loss of control of the perp" and against their training.

She didn't have a chance. He was far too forceful and didn't realize that the method he was using to try and pull her out of the desk was causing more resistance because she was caught up in it. His force caused the desk to fall backwards, not her flailing; her flailing was the result of the natural human response to grab at something when your center of gravity has been unbalanced. Watch closely; the officer was not punched in the face. Like at all. Let's also not forget that this is a police officer - not merely a security guard - supposedly trained in keeping the peace. Too many people want justice against criminals, but that is for the courts to handle, not the cops. The cops are supposed to neutrally mediate situations, using restrained force only when necessary, their tasers only when being threatened or left without choice to apprehend a runaway, and their guns only when their lives are at risk. Society's view on cops is skewed, they are meant to be protectors and preservers, not violent offenders "in the name of justice". People are dying unjustly because of it, and this girl herself is very lucky she didn't suffer from a dislocated joint or head trauma as a result of this man's actions. She was being a brat, probably running her mouth, and certainly deserved consequences for her actions; but this? Nah. She didn't deserve this, nobody does.

Physical presence,

Verbal warning

Strict warning with, threat or promise, of physical action

Physical removal (in the case of a nonviolent crime)

subdue the suspect(in the case of physical resistance often via the use of pepper spray or tazer)

the use of nightsticks

finally guns.

Violence is a logical step, but only once the previous steps have been adhered too.

Bouncer comes over and says you need to go several times, you say no. He grabs you arm and says time to go. You should go. If you don't, then he gets to physically remove you. he doesn't just body slam you then drag you out in response to you saying no. That's my opinion.

But on the other side, this may be a repeat offender so that could explain it as well. But currently I'm leaning towards the former.

I know I'm in PPD but that's fucking bullshit. The cop needs to use his words and understand that dealing with a child may require some patience. She may be under extraordinary stress and a few minutes may be enough time to talk her out without a fight.

I'm distressed that temporary defiance is seen by too many police as if it were literally a physical assault. Passive resistance needs to be treated with a reasonable amount of passive coercion. In this case 30 seconds is an absurdly short period of time to begin initiating force.

I know the retort is "well if she just did what he said blah blah" and my answer is that maybe she would have done what he said with a little bit more patience. I'm not talking about a 1/2 hour of pleading, I'm talking about 5 minutes. Enough time to explain to her that she has to come with him and what the consequence will be if she doesn't. Force should be a reluctant last option, not the very first go-to option.

If someone was being disruptive in my school, you were either put in the hallway or taken to one of the department heads for detention or whatever.

I did. See, if she wouldn't stand up in the class and the officer just pussy-footed around her and dragged her into the hall, she thinks she won. She has control over him. Now she doesn't want to move because she's already exerted power over the officer and thinks she can continue to control him. So now she just sits there and the officer has to force her out of the desk anyway, but now he's tired because he just dragged 150 lbs 15 feet.

Sometimes children show off when they have an audience.

Sometimes kids need a reminder of what happens if they want to be little shits. If she gets away with just a talking to, what's to keep the next kid from doing the same thing? "She disrupted the entire class and got away with it. I don't want to take the this test today, I'll do the same thing." all the sudden... You have this happening more often. Look at that, one incident turned into four... which turns into twelve.

Here is the issue with being a police officer. When you are an officer and have to remove someone from some place like we see here, often times the subject is belligerent and unwilling to follow simple commands or orders. In situations such as these, the officer must gain control over the subject in order to carry out his or her task. This involves a fair amount of man-handling, to a varying degree depending on how complacent the subject may or may not be. Often times, the subject is aggravated by the contact involved in this action, and tends to fight back. Because the officer must carry out his or her task, the officer must show enough force to neutralize the subject and force them into complacency. (The whole face down on the ground, pulling the hands behind the back and cuffing them thing)

The officer here grabbed her by the arm to entice her out of the desk, and when she wouldn't come, she was forced out. The amount of force the officer used was what he deemed necessary in order to force the subject into complacency. How he reached that decision is unknown to us because, as often times is the case, we don't have the full context of the situation. We are not at liberty to say that he used too much or too little force, since we do not have the full picture. Was she a threat to him? Doubtful, but a subject does not necessarily have to be a threat for them to be on the receiving end of forced complacency. They simply have to show enough disobedience to warrant it.

The fact of the matter is that police officers have a job to do, and that job very often involves getting a subject under their control. If the subject believes they have done nothing and that the officer's suggestion otherwise is offensive and unacceptable, then the officer is going to have a tough time, as with this girl, bringing the subject under control so he can do his or her job. An easy way to avoid this is to listen to the officer, do as he or she says, and sort out the details later. If you have done nothing wrong, then they will let you go. They just have to keep you in one place until they can confirm that, just for simplicity's sake.

IMO the amount of force appears to be excessive. Any use of force can look to be too much in many peoples eyes, and its very difficult to look at something and make a determination.

This cuts both ways as people see either a person resisting and most cases of force are justified by the viewer, or people see overly abusive officers avoid using minimal force when subduing people.

In my state (New Mexico) every school has uniformed officers on campus and they are basically security for the school. They are generally older officers about to retire unlike this one obviously. But they are there acting as security and have the powers of the police. To get them involved is no more than a simple radio over to them, usually just parked in the parking lot, and they are there right away. No way this teacher actually called 911, and it was probably told to him by the principal to call security if a situation arose. After everything that has happened in schools these days do you really fault (or call incompetent) a teacher that goes to a trained security guard to handle a disruptive student? And I will say again this guy was absolutely in the wrong for what he did! I'm just saying the teacher is not in the wrong.

I mean I understand some people are difficult to deal with but from what I see in the video there were no steps taken to try and de-escalate the situation. Like I mentioned before in my workplace we have staff that is trained to approach a student and calm them down. So force won't have to be used. So the student can avoid being in trouble with the law. Who knows what that girl was going through. Maybe she's having problems at home? I'm not saying it's not justified for her to act that way but she's a kid. She's still learned on how to deal and control her emotions.

That's really my point though - once you begin a physical confrontation, you don't know how it will turn out, so it is best to avoid that and find different ways to handle the situation. Too many cops are not trained in the slightest to do so - their go-to approach is to intimidate to gain compliance.

It really comes down to this: Do people care more about the result or the justification? In other words, if we care about the result, then we hope that all interactions end peacefully to reduce risk to everyone. In this way, it doesn't matter if someone is a dick, we still have the one goal of ending it peacefully, because if we don't, the police officer's life is in more danger. That doesn't mean we don't sometimes have to use violence, but this girl was posing no threat to warrant it. On the flip side, if we care more about the justification, then we say it is ok for the officer to do whatever he was doing because she was being disrespectful. Therefore, the police are justified, which is all we really care about. But with that line of thinking, we have more risk to everyone.

It's laziness all around. The parents are too busy to raise their kids right, so they dump the responsibility on schools. Schools are too lazy to treat kids with dignity and teach them properly, so they reduce freedoms and treat kids like criminals, but with even less agency. Everyone acts surprised when kids act like rebellious little shits. Then we're too lazy to deal with it right, so we call in cops, who are too lazy to de-escalate the situation so it only gets worse.

The public in general is too lazy to tackle these difficult problems so we end up with some silly, easy to tweet positions on complex problems. People pick sides like it's a football match: We should just listen to cops or cops shouldn't use force.

We break it down by race because that's the hot button of the day, but meanwhile parents and schools are failing kids of all colors. Sure, it started first in poor black neighborhoods but once the country saw how easy zero tolerance was, how easy it was to put a police officer on campus, how convenient it is to implement stricter rules and harsher punishments, it spread everywhere.

Plenty of people are willing to place blame here or there, on her or on the cop, sometimes maybe on the teacher. Sure, she should take some responsibility, but I wish more people would recognize that she got failed by a whole lot of people long before she got to that classroom, and there are no simple solutions to that.

Do you see the volume of overly aggressive tactics from other developed countries? Nope. Because they are trained in other ways to obtain compliance. It is a ridiculous argument to say that since she didn't immediately comply, it is reasonable to do just about anything to get her to comply. There are other strategies to gain compliance without a physical altercation that could easily escalate the situation. What if the other kids hadn't sat there quietly? What if they came to her "aid"? Then you have a much bigger problem where the officer might feel his life is in danger, and he might feel the need to use deadly force. That's not an unrealistic progression of events. That means that by using excessive force, the officer has actually increased the risk to himself.

Look here is my issue, I'm from Europe living in America. I remember when my kid started middle school and I went to the open house. First thing I seen was a cop car. I asked my kids mother, what's which the Cop car? Out reach or some shit like that? Nope she said, school always has a cop present.

Most schools in USA have an officer assigned to the school. They may not be at the school 100% of the time, but they are responsible to respond if needed.
