This happened in 2009 in Lincoln, Rhode Island at a casino, Twin River. The officers name is Edward Krawetz and he lost his job and was convicted of felony assault. He was sentenced to 10 years in prison but didn't serve any time.

In 2012 he petitioned to get his job back but if I remember right he never showed up to the hearing.

It was huge news here when it happened. So many people wrote letters to the police chief demanding he not be rehired.

BTW, the women was in custody for being drunk and unruly, refusing to leave the casino.

He chose to be a police officer. With that comes an inherent level of personal retsraint. He was wrong because he is supposed to be the professional. You lock the drunk up and go home to your family. You don't engage, you don't instigate, you don't react beyond personal protection. You don't teach people lessons, or pass your judgement. You uphold the law, outside of that you are wrong. You use only the amount of force necessary to control the situation. If you can't take the high road everyday then don't be a police officer. She is not a professional, she is a drunk and what she did is expected behavior. He is wrong because he is trained, and he didn't refer to his training. There is no second chances for professionals. If you can't accept that then do something else.

I think /u/SkoobyDoo is pointing out that what /u/PabstBlueRibbobSmear just said conveys the same message. Your message, while being very similar in the actual message, was much longer and more detailed. While some people may appreciate that amount of detail, others will not, and would prefer shorter messages. The ratio of the response to the first message was approximately 5:1, which of course is makes the original message about 20% as long as the response. If the response comment was 1 dollar in length, the original was around two dimes, or 4 nickels, but /u/SkoobyDoo is saying they have approximately the same value. So the money analogy can really only be applied to the length of the comment, and not the comments inherit value.

She deserved to get kicked in the head for assaulting someone, and the PO deserved to get fired, and maybe prosecuted. Thank fucking god we don't all get what we deserve. You are absolutely right, the police officer showed a lack of restraint. It's not the polices job to "give us what we deserve", it's the polices job to make sure the court system can give us what we deserve, whether that be innocent or guilty. If that cop had done nothing in that situation other than perhaps restrain her legs then she could have been prosecuted for assaulting a police officer.

There is a difference. A big one. With ANY Job come perameters and one of the biggest is guarding your temper in a drunk situation.

We don't know what triggered her to try to do a ground sweep from the ground with no shoes on and the unequal position of having her hands cuffed behind her back, much less the fact that it overbalanced her entire body and, if she tipped over, that she wouldn't be able to stop herself from crashing her face into curb or pavement.

But he didn't hold back at all. THAT was a BULLY Move, one he's done before to others, only this time he got caught.

And no matter how much I'm a sailor who fights for equal rights and responsibilities, you can't KICK a women or anyone upside the head without causing traumatic injury.

I think our defintion of "at fault" is different. If I flick you're ear, I'm an asshole. If you beat the shit out of me in retaliation, you're a criminal. If I intentionally, lightly bump your car with mine and you slam into me as hard as you can as retaliation, you're a criminal. This cop is a criminal and at fault.

Edit: I deal with drunks everyday. Some have tried to physically assault me. Never once have I needed to lay hands on them aside from a slight shove. Drunks are insanely easy to avoid and pretty terrible at landing blows. I've never had to deal with one in handcuffs but I assume it's a lot easier to deal with.

I don't think their safety is the priority. I think civilian safety is the priority with the cops safety being a close second. I meant they have billy clubs, mace, guns and are wearing a bulletproof vest. I know they put up with a lot of crazies and I feel for any officer harmed in the line of duty, but it seems it is more and more common for cops to resort to deadly force first. I don't feel one bit sorry for him. He kicked a handcuffed civilian in the face. It shows a total lack of self-control and I'm happy he lost his job because his next incident could be someone's execution.

I think most reasonable people are willing to cut police a fair amount of slack when a drunk, disorderly person kicks them (like you say, by kicking her in the thigh or shoulder - not technically OK, but not OMG! freakout inducing), but kicking a prone, handcuffed incapacitated person in the head is too far.

He is right, by the way. If someone says "I am prone to ___" they're using the definition you posted. If a person is described as prone, it is assumed they are lying prone, the position of being flat on the ground on their stomach.

Kind of how you can say "he is subject to bouts of depression", but you can't describe someone as just being "subject" and try to use the same definition.

I think that I've lived in an area that was full of these kinds of people and it's not about 1 incident. Cops deal with people like this everyday and I think the cumulative stress wears on them.

This is why we should be willing to invest money in our police. Instead of arming them to the teeth, we should be giving them more PTO, helping them deal with the stress, and providing them with top notch training. Since they rarely get any of those, I can see why this sort of thing happens.

That being said, I guess the officer on this incident had a history of aggressive behavior and probably shouldn't have been put on duty.

it's easy to assume that our entire society is chock full of upstanding gentlemen like you and i, but police almost exclusively deal with the scum of our society, and if not them then people like us at our most desperate hour.

their pay is modest for the work, it's a psychological nightmare. you spend 60 hours a week realizing that there's no hope for mankind. you raise your kids the best you know how, knowing even then that it's entirely possible they wind up sucking dicks for crack rocks despite your efforts.

they probably shouldn't go around shooting everybody they see, but if some insufferable wench in a skirt and handcuffs decides to kick you, kick her in the fucking head. next time, since there's almost always a next time for people who attack policemen, she might not kick whoever has to deal with her bullshit.

i work in automation. ideally i never have to do anything. when i do have to do something, i have to do it well and do it fast. everybody is looking over my shoulder, wondering how long it will take, wanting me to hurry, making comments about production loss, parroting how much money our business loses every minute i spend fixing something. sometimes this happens often and the nagging does not relent.

during one of these times, one of my peers threw and broke a $5000 piece of equipment out of frustration. why on earth would somebody who professes in a logic-based field do something so illogical? he chose his profession, he is generally not supposed to break stuff. how could this have happened?

the human condition is irrational. robot programmers, cashiers, policemen, social workers, firefighters, salesman... they are all vulnerable to this weakness. i'm sure you could throw money into training programs to raise people's tolerance of bullshit, but the limit is always there somewhere.

he probably shouldn't have kicked her, but he wasn't necessarily wrong in doing so. if that makes any sense.

Honestly, I wouldn't last a day as an officer. Also, there are good cops who can do the job right, but we don't give the police what they need to hire ONLY those types of people. It's a high stress, low gratitude, mid-pay job. That's not exactly a strong sell to the patient and courageous.

It was unreasonable for her to make an aggressive action against a cop when she had no way to defend herself.

But criminals are criminals. And police officers are police officers. This guy turned from lawful to unlawful and thus, is a criminal and should be treated as one. The police is protected from legal consequences when they have to use force to do their job in some situations, but only if the force used meets the danger they were facing. A cuffed person, sitting on the ground barefoot, no matter if male or female, that tries to kick you, is a danger, but none that you need to subdue with a kick to the head. A simple step back would have been enough. Retaliation is not a cops job. Retaliation is not the laws purpose. And he needs to uphold the law while on the job and wearing uniform, what he does in his free time is completely different.

There is no context to this gif. Meaning anything could've happened prior. She may have fought, kicked, punched etc. being arrested. But then again the cop could have been overly forceful and arrest her for a shitty reason, causing her to kick out. But from what we see, it's a person handcuffed while an officer is writing out a report of the situation. He doesn't provoke her to kick him. When anyone, even an officer is being hit, they are allowed to retaliate in equal action, meaning if he were to pull out a taser or bat and start beating the shit out of her, it would definitely be police brutality. She kicked him, he kicked her back. I wouldn't expect anything less or anything more than exactly what happened.

In my country, resisting arrest (without harming anyone) and prison break (again, not harming other people) are not illegal. The legal argument behind it is, that the will to be free is so strong, any human will fight to keep their freedom.

An intoxicated person will probably lash out, and as a police officer, you need to be prepared for an arrested person to fight for their freedom. What you are allowed to do, legally and morally, is to use just enough force to regain control over the situation and prevent any harm being done to you or any other person involved, but no more than that. In this situation, stepping back or putting her in a car would have sufficed. Off the job, whatever you do is your thing, but as a police officer acting in the function of a police officer, you do not get to act unlawful. No matter what happened, retaliation is not a cops job, and it is not the laws purpose. Laws are made to prevent harm being done to the rest of society, nothing more, nothing less.

And even if he retaliated, a kick in the shin does not equal a kick in the head. One hurts, gives you a bruise for a few days and is annoying, the other knocks you unconscious, gives you a concussion and is possibly (and not unlikely) life threatening. If he pushed her away with his foot while making sue she is not going to hit her head, fine. But he kicked her in the head, which can have really (really really really really) severe consequences. This is excessive force, and the guy is on a power trip. It is disgusting, and he should never be able to ever work in a position where he has that much responsibility, because clearly, he doesn't honor it.

In my country, and most, resisting arrest is illegal and you will be punished for it. As is an attempted prison break. And I agree completely with both rules. I for one respect police officers and would never in my right mind even think about kicking one. I think this woman is very lucky the cop DIDN'T use excessive force to apprehend her such as a taser, which is more than likely what a male would have got in that situation.

I don't agree with police brutality, I'm totally against it. This however is justified. Nobody has the right to assault an officer, and no officer should go to work scared to use necessary force to protect themselves.

Police officers need to honor human life. Their sole purpose is to protect society and uphold the law. Society includes criminals. Society includes a lashing out cunt that got shitfaced and peed her own pants. They are there to protect everyone. They do not get to retaliate, they do not get to throw a temper tantrum, they do not EVER get to break any law. Necessary force, by definition, means just enough to regain control and prevent harm. Sorry kid, but that's not how that works. She's already restrained, any further assault against the officer is simply tacked on to her charges. Cops are not allowed to attack perpetrators. They are simply allowed to respond to attempted attacks in appropriate manners of self defense. She kicked him in the shin. He could have stepped out of the way or restrained her legs in shackles. The kick to the head was not only potentially deadly, but also unwarranted. It was not done to directly counter her kick to the shin, but rather to retaliate for the kick. Cops are not allowed to retaliate. There is no justification for an officer of the law employing any sort of retaliatory force.
