This is so far off it's not even funny. Mental hospitals have free reign are are usually inclined to abuse you, restrain you, and then jack you up on Thorazine any time you complain about it. In addition to that you're around disturbed people that don't follow any rules of sanity and have psychotic episodes. Its pure hell. Prison is far better.

No one gets out early from mental hospitals, they almost always do a lot more time than sentenced.

About the podcast? Just like I said, the two points they're giving on how the story seems a bit weird is that how the hell he managed to get hard and get pictures.

Eventually one of the guys imagined how the things went and said something along the lines of:

So she broke into the house and waited for him, wanted to have sex with him when he arrived and he was like "Sure, why not". Sucked him off for five minutes and then she started riding him. It’s a matter of law and how rape is defined. In the UK a woman can’t rape a man, as rape is defined as penetration with a penis, but a man can. I believe that’s also the case in some US states but not in others. Whether you agree is altogether a different subject.

In most places sex crimes are based on state laws, and in most states rape is defined as "the carnal knowledge of a female, forcibly and against her will." Which literally means the woman is always the victim.

So literally women cannot be convicted of "rape", it is usually convicted at the lower charge of sexual assault, and punished no where near equally.

So there had been a big push to get the newer definition made by the fbi in 2012 put into current laws. But it is still way behind. Since it has to be changed state by state.

You don't want to go to prison in the US. The only places that i would say prison is worst is probably Mexico, China or North Korea.

Prison in the US is about making money. There is very little in the way of rehabilitation. As a man you literally have to be on guard all the time so you don't get gang raped. If you have ever seen an american drama about what prison is like, it is only a little dramatized. It is a true shit hole and most people who go in, come out worst than before due to the conditions and treatment.

Unless you are wealthy and go to a cushy white collar prison.

They stay there until they’ve been found to be better which may never happen; those who fake it get stuck there and being treated for psychopathic tendencies. This might be a little controversial but having read the article I really think the judgement fit in this particular case.

First of all, this woman is completely unstable. She has some very serious mental health issues and frankly the thought of putting a time bomb like her in general population at a prison just seems like a really bad idea.

20 years for what she was charged with is also the maximum punishment her state has and while I am the furthest from an expert on the subject, she was criminally convicted. I would think the conviction would remain public record as the fact that googling her name will bring you to this story.

As someone who wants mental health issues to be taken as seriously as men being raped I have to get behind this sentence. She needs treatment and she's gonna get it for the next 20 years while keeping her away from society.

Yep. Started seeing a girl just after I graduated high school without getting to know her first. She was clingy, too clingy. If I wasnt at work or sleeping, I was spending time with her or on the phone with her. If I tried to leave her house to go home/get off the phone she would throw a temper tantrum causing me to stay for an hour to 3 longer then I intended. Every time I tried to break up with her she would start sobbing and trying to manipulate me into feeling like an asshole and stay with her. After a couple weeks of that I had enough, I was exhausted, and I broke up with her and blocked her number. She ended up calling my job, convincing them to give her my emergency contact info (very illegal btw) and called my mom. When I got home I took the phone and she told me she had a razor blade to her wrist and was going to do it(wasnt the first time she used this tactic but it was the first time I didnt back down). Wrote my mom a note, telling her to call the cops and what to tell them while I kept her on the phone. She got Baker acted, and was in for like 6 days. A week after she got out her grandpa showed up at my house and when I went out to talk to him he shoved the muzzle of a shotgun against my chest and threatened to kill me right there because I ruined his babies future. I told him, "I was sorry that this might effect her future, but when talking about suicide you have to take that at face value. If she had killed herself that would have been on my conscience the rest of my life". And If it was just an empty threat, she'll fucking think twice about gaslighting someone like that again.

I don't want to seem like I'm disagreed with you but in today's day and age prison is pretty much the same as a mental health facility.

Prisoners spend their time mostly in classes and courses that are similar to the one's that mental health hospitals offer. Hell they are fighting to get in these classes. Completed classes means shorter time. I would say prison classes are easier than mental health facilities. Although, I only have experience with the latter.

It's a step in the right direction, but I understand your concern about letting her get out of punishment, but just take slice in the fact that no matter where she is, it will be bad, it'll be hard, and she will never escape it.

I can't say that's getting off light. 20 years is a long time to be around almost exclusively insane people.

I worked in one of the best mental hospitals in the U.S. I have also worked in the one of the worst, the one where they sent Lorena Bobbit (the bitch who cut of her bf's dick).

It's not called parole but you can still get let out early.

They have judges that travel around to different facilities to make rulings on cases where people were court ordered to be there. Happens all the time as a lot of suicidal patients get "green warranted" aka Court Ordered to spend 72 hours in a facility until the high stress situation calms itself down. So the judge is there basically every single day at a large facility. Longer terms are just another case on the docket for them.

To keep it real simple all that needs to happens is the Staff on the Unit and the Doctor need to sign off than you good to go and you're gone. The Hospital Judge isn't going to completely go against the will of the Sentencing Judge, but if they feel like "you've done enough time" then they can release you.

If this cunt keeps her nose clean she could be out in 7 years with a lenient Judge. And NO, she won't go to Prison after. The Mental Facility is the only thing she was sentenced to.

I'm not sure how I feel about this one. The prison system has and is being used for situations and people that it isn't and wasn't designed for - there are a reason mental hospitals exist, prison shouldn't be used to house the mentally ill, the correctional staff isn't trained for it and they shouldn't be expected to handle inmates that should be treated by mental health professionals.

This chick is obviously mentally disturbed and extremely dangerous. I know that people that aren't legitimately crazy try to play the insanity defense quite a bit and I can't honestly remember a time where I didn't read about it getting dismissed and the case proceeding as usual. We only have a small glimpse into what this chicks brain is like and after being thoroughly evaluated the doctors deemed her sick enough to give her 20 years in an institution instead of prison, so I'm guessing she's really fucked up in the head.

Normally I'd think this was/is a right step in the right direction for the criminal justice system here in the US, but I can't until a man in the same circumstances receives the same sentence. Sadly though, I can't see a man getting the same sentence and that's what makes me agree with the others that this is a pussy pass. The mentally ill who commit crimes should be sentenced to state institutions, not prison, women and men alike so they can get the help they need while taking a huge burden off of our overcrowded prisons. Also forgive me if I'm wrong here, but if someone gets a prison sentence, the warden can't arbitrarily decide that you should serve more time because he thinks you need it, as long as you don't get more charges while in prison, once you serve your time you're free to go. I'm pretty certain that a person in a state mental institution however could be found unfit to be released back into society by psychiatrists and stay longer/indefinitely depending on how severe their issues are, which would be a great thing if a person is as dangerous as this woman is. (I know that a 5150 72 hour hold when you're a danger to yourself or others can be extended past the 72 hours if the psychiatrist deems it necessary - I only found that out recently as a friend ended up staying 20 odd days on what was supposed to be a 72 hour hold - it stands to reason they'd be able to keep someone past their 20 year sentence if they can do this).

A lot of laws are outdated and really need to be changed or updated to meet modern standards. The main reason women hardly ever get charged with Rape is becauase most countries the law states 'he', so legally it can only apply to men, if it said 'the person' or something like that, then it would apply to women.

I'm a little fuzzy on the mechanics of female > male rape, and I can understand why it has not generally been taken very seriously (even though, of course, it should).

Even when the woman is forcing the act at gun or knife point...that covers the issue of "force" only. It doesn't really cover how the act is carried out.

Alright I'm just gonna go there...a hole can fuck a pole. But how is a hole going to fuck a noodle? If she is threatening him with physical harm or death, that's not going to get most guy's standing at attention. She can't force an erection via threat of violence, therefor what is there for her to fuck?

I realize there are many, many ways in which sexual abuse could occur here without this conundrum being a real problem...but it also means that actual sex can't really occur in the same way it can for male > female rape. I’m not confident in my ability to explain things of this nature, so someone else may want to follow up on this one.

Basically, no. Erections are essentially natural, uncontrollable reactions to external stimuli, and from what I’ve heard, sometimes they can occur for little to no reason at all. A man cannot control an erection as much as a man or woman can stop an orgasm. Just because a man has an erection does not mean that they wish to have sex, and they cannot simply decide not to have one.
