She got taken in by EMS after neighbors called 911 during a recent drunken rage at home. She then got arrested a few days later for drunk and disorderly, trespassing, and resisting arrest for pulling the same antics in public (she has a long history of alcohol abuse, exacerbated by untreated post-partum mental issues).

She (and mostly her mom) have concocted a plan where I move out and her brother moves in (to help keep her accountable and support with childcare for our 1 y/o) for the near future while she gets herself established with therapy/counselors that they found together last week.

I prioritize my child's safety over all else, so I am skeptical of this plan. But also, I worry that they might be scheming something, so I am afraid to appear as an absentee father.

Assuming child's safe, any advice on protecting myself from a legal perspective, while working toward marriage repair?

We currently live together (although she is currently out of state at her mom's) with child in NY.
