No, we shouldn't be putting a random man on the financial hook for supporting a child. If it's his, then sure (although I also support financial abortion, a recent change of view for me). If the state wants to make sure a child is financially supported, then the state should do that through tax dollars rather than conscripting some random man to do it.

I'm a femenist and I see absolutely nothing wrong with paternity tests for the same reason I don't think men should have abortion rights, which would be biology.

Biology is at play here, and while a woman will always know if she gave birth to a baby, a man cannot normally be certain if a child is his because he does not carry the child. Plain and simple.

However, you're going to have to deal with the severe offense you could cause if you turn out to be wrong in your suspicions of infidelity. Nothing's ever perfect of course.

There was a recent thread on /relationships about paternity tests. The overwhelming concensus was that it was totally reprehensible and showed absolute lack of trust and was an instant deal breaker. Either relationships or purplepill (or both) are not in line with the general sentiment of the population.

I mean, I'm not going to pretend I know shit about this law, but the idea of forbidding a man from asking for a paternity test is certainly absurd. Provided we're talking non-invasive tests for the child.

That being said, the state monitoring the results of this paternity test does kind of make sense to me (although, again, I'm not going to claim to know how they do things in other countries). I mean, if they're going to make a guy pay child support, they kind of have to monitor the results of a paternity test. The consent of the mother should be irrelevant though.

Does performing medical treatment, procedures, and testing on minors legally require consent of both parents? If so, it's at least consistent to extend that to paternity testing. If not, it doesn't make any sense. I don't actually know the answer to the initial question.

The reason paternity testing is illegal is not to screw men over, it's to safeguard the privacy of people's genetic material. The privacy laws in France and Germany are really far more sophisticated than they are in the US, and that includes genetic privacy as well. You will recall that Germany had bit of a kerfuffle midway through the last century that had a lot to do with ancestry and so forth, and they don't want to repeat that little incident, so they passed laws stating that your genome is yours, and yours alone. France did something similar, for the same reasons as Germany.

It's a damn good idea that I completely support, but it does have some unfortunate side effects, such as preventing men from determining the paternity of their children on their own.

I don't think it's ok to force a paternity test on a man if he's unwilling, without a court order.

I do think it should be easy to access a paternity test since it's totally not invasive. I see no reason a court would ever have to be involved.

Feminist blue pill here - I don't think that's fair either, at least not in cases where the man demanding the paternity test has taken or is being told to take some responsibility for the child.

I could envision a convoluted scenario where a man who doesn't pay child support drags a kid to get tested without the mom's consent - like, maybe the man refused to accept responsibility for the kid at birth but now he's changed his mind and wants the male legal guardian - who did assume responsibility - to step aside. That wouldn't be cool.

Or maybe a man going through a messy divorce proceeding requests that all five of his children with his soon-to-be-ex-wife recieve paternity tests - he's 99% sure they're his but he's looking for ammunition in the divorce court proceedings. That seems like a cruel thing to put five children through. But, again, this is a rather convoluted hypothetical scenario.

Anyway, I'm not opposed to some regulations to paternity testing, but I don't think the mom should be the deciding factor. You'd want laws that also protect the interests of the children and the men involved. Family courts are beholden to the family's best interests, not the interests of any one individual family member.

I think people misunderstand the French (& German) ban. The intention is not done to hinder paternity tests per se. It’s to protect the genetic integrity of the individual - i.e., the child. You are not allowed to take genetic material from others and subject it to scrutinization, or for any other purpose (sperm jacking, insurance companies requiring genetic investigation). It's to protect against genetic information theft. It's also illegal to take some of stray hairs of some stranger person, and subject them to genetic tests. The law in Germany I think, was initially sparked due to a magazine having done that to some poor dude.

Although a good (but unenforceable) law, I obviously think it should be allowed to do on your own children.

I saw a comment from a French guy who studies law on this subject and he said that he's never seen a man ask for a paternity test and the judge not allowing it. I think you're making a bigger problem out of this than it is.

If you actually look into why France closely regulates Paternity tests, you'll find that the state decided, based on the advice of psychologists, that 'fatherhood is determined by society, rather than biology' and it's part of an official desire to preserve the peace within French families.

So the reason has far more to do with traditionalism, than Feminism. Of course, that depends if you take the French government at their word.

Personally, I don't think paternity tests should be regulated like that. Who did the deed, ultimately, matters. Someone who isn't the biological father of a child shouldn't be on the hook for it. The one who is, should.

Do you have a breakdown of who is applying for these tests? Where I live, only a potential father can do a paternity test; and there are a lot of issues with sperm donor children requesting paternal identity.

Is it fair? No not really, but it also isn't fair to force something on someone without evidence. If there is evidence of needing a paternity test for either party it should be allowed.
