They’re actually being very clever here, because ‘staring’ can’t really be proved in Court as well as the intent of the staring.

So what they are really saying by using the words “will act accordingly” is: “we will make a report of the incident and then file it away for when we need yearly sexual harassment figures”.

No one will ever be prosecuted for this, it is unenforceable.

they arent changing the law... its confusing, what they are doing is altering what they add to the "others" section of their hate incidents - NOT HATE CRIME! (see here: http://www.nottinghamshire.police.uk/sites/default/files/documents/files/FOI%20009062%2015.pdf for an explanation of what they record) basically before now "Any incident, which may or may not constitute a criminal offence, which is perceived by the victim or any other person, as being motivated by prejudice or hatred" was allowed under the others section with there being Disability, Race, Religion, Sexual orientation and Transgender nationally covered ones that have to be followed (under their own headings). whats changes is how they record "misogyny" related "hate incidents", its no longer under the "others" section but has its own fancy special little box (not that if you say hit a women for the sake of her being would you be prosecuted as a hate crime - as far as i know). (please note im only a law student i could be completely wrong about this.)

i think its best to split this about a little like the citizens advice site, basically they record hate incidents with the above mandatory categories (and their own local ones added on if they wish), but they arent hate "crimes". hate crimes are controlled by the "Criminal Justice Act 2003" specifically: http://www.legislation.gov.uk/ukpga/2003/44/section/145 and http://www.legislation.gov.uk/ukpga/2003/44/section/146 which causes the said crime to have a larger sentence. what they have done is fooled everyone into thinking it actually matters (as if said women would get a larger sentence because of said motivation - they might but then they always could its just not mandatory like other sections and the crime doesnt become a "hate crime" because of it either, its simply a possible aggravating factor), when in reality its only a matter of numbers not law (they add them to their own table and do nothing new).

Realistically though, the police are 100% going to use this change to abuse the general public. First it's going to be the lowest in society, but if they start fucking around with the upper classes, which they will, they're going to start losing huge sums of money through litigation and this practice will quietly disappear.

As you said, it is impossible to prove in court. It's scary to think about actually, you could potentially lock men up or have them registered as sex offenders (do they have that type of system in the UK?) for an imagined slight, for retaliation, or in a case of 'mistaken staring'. I've caught myself zoning out while standing in a line or whatever just to notice that I'm catching a dirty look because my eyes are pointing at a woman's bust. Wasn't looking, wasn't paying attention, but that could be criminalized. Further, it seems a system that could criminalize being un-attractive. "Calm down blunt-e you're over reacting" follow me here: Girls go to the pool in skimpy bikinis. Hot guy is checking them out, they're all for it, no crime. I stare at men's breasts all the time. I read what's on their T-shirt. Does this mean I hate men?

I don't stare at women's breasts because they usually have nothing interesting written on their T-shirt.

I don't understand how admiration is related to hate. If I stare at a Ferrari, do I hate Ferraris? People stare for many potential reasons. You can't know for certain if people stare out of hate, rather than something else, like lust, curiosity, or maybe they are zoned out and just looking through you.

My girlfriend never noticed people staring at her boobs. I've never noticed people staring and other people's boobs. If anything, people shame men for having man-boobs more often than shaming women for boobs.

I think that women look at other women as often as men look at women, but we ASSUME their intents are different. How can you tell what the person is thinking when they look at you? Are you psychic?

Claiming intent from a stare is foolish.

Maybe if a woman charges me for staring, I would charge her back for staring at me. I can say that she was staring at me first with intent to severely harm or kill, and I only stared back to look for sudden movements or to look for concealed weapons.

How can she prove that she didn't stare at me in a manner that shows intent to kill? If I feel my life is in danger, shouldn't I have the right to monitor my potential attacker?

Great, now I'm potentially able to go to jail if I get unintentionally distracted by a woman's pair of breasts. This actually happened to me once while I was driving and my mind blanked that much I actually forgot where I was and missed the turning I was going towards and ended up halfway down the road before I realised what happened. What are we supposed to do exactly if we simply end up glancing without meaning to? Martha was followed on to a tram by a man who was staring at her breasts. She didn't report the incident but the police hope she would now.

In some clothing I agree with you however if it's a really really hot day and a woman wants to wear something that's comfortable in the heat such as short shorts and a singlet top to cool down I don't really think they are to blame for being uncomfortable for being stared at. I mean I'm sure some men go topless when it's super hot and they aren't asking to be looked at; rather they just want to be comfortable. However I don't think it should be an offence- just don't ogle at her breast, you can still be discreet and not make her feel uncomfortable it's just having human decency.

I used to be very athletic (served in the Marine Corps and played competitive sports since I was a teen) and the kind of things that women have said and did to me would probably have you reaching for the fainting couch. If I went running shirtless (I lived by the beach and would often go swimming to cool off after my run) it was pretty normal for women to shout things at me or honk their horn as they drove by. When I worked a summer job as a pool boy, women old enough to be my mother would ask me to take my shirt off while I cleaned the leaves out of their pool. Women never just stared, they came up, made lewd comments, and touched without permission. "Oh I want to feel your abs" and next thing you know a random drunk chick at a bar is groping me. One time I was walking down the street with my date for the Marine Corps Ball and a middle aged woman flashed her tits at us. Another time, I had some crazy woman try to climb on the back of my motorcycle while I was stopped at a red light. Back in high school I probably didn't have a week where someone hadn't grabbed my ass in a hallway between class. Back then I dated this Hispanic girl and when I went to meet her family for dinner, her grandmother said to her in Spanish (which they didn't know I was studying in school) that if the girl didn't fuck me, the mom would. I once had a black girl walk up to me at a bar and ask me if I would ever date a black girl. When I said sure, why not, she told me that black girls have the best ass, turned around, bent over, and started shaking it. She was a student at an Ivy League school.

What are you complaining about, again? That if you flaunt your tits and ass and leave little or nothing to the imagination, that it makes you feel as if men might be looking at you? And it's men's responsibility to make you feel comfortable? Seriously?

You don't have a right to be comfortable. You can't restrict other people's access to public sites to make yourself comfortable. I'm not sure why you crazy-as-fuck people think that women deserve special rights, and that men's freedom should be restricted to give women special rights.

They argue alright, but you're right about not using facts. The problem with using facts in an argument is that they are solid. Facts don't change, they don't move, and sometimes they don't fit your narrative. Feelings, however, are fluid. They can do a 180 on a whim. Feelings can be altered, flow and fit whatever narrative you'd like them too. Feelings are much better to argue with because they are strong enough to be taken seriously, but not anchored like facts. So a person can -feel- unsafe even though the fact is they are quite possibly in one of the safest places on the planet.

What happened to the woman called Martha was awful. But, as Chief Constable Sue Fish said, Martha could have called police and they would have responded, even without the change in guidance.

What is really worrying about this, is that it's designed to be used to push the Overton window. By recording even non-criminal acts as "hate crimes", the police will create the impression of there being a massive problem. And Northampton surely can't be unique, so this problem must exist everywhere. So we should start collecting this data across the country.

This will, in turn, reveal that many women across the UK are subject to rudeness, now re-classified as a criminal hate crime, on a regular basis. And the only remedy will be more funding for feminist and biased anti-VAWG groups, more anti-male shaming in schools, and greater erosion of due process.

And that's before you even start on whether these acts are motivated by "hate" at all and how you can credibly record non-criminal acts as "hate crimes".

Just to be clear, in case it isn't, harassment of the kind described in the video — grabbing someone, stalking them, targeting them for verbal abuse — is totally unacceptable and should be prosecuted.

But once we get into "he stared at my breasts" then we're in another "he-said, she-said" situation. And we know how that goes. Successful prosecutions are rare, which leads to an outcry, which leads to calls for erosion of due process.

But this time, it's not even for a serious crime in which you at least have to be able to demonstrate that two people were alone together. All you need now, is a couple of your friends to back you up ("He definitely was staring at her tits".) or a Marvin Zuker of a judge, and you're in deep trouble.

I agree, but the last 50 years of history suggests that these kinds of practices can't persist. Ultimately the courts will respect charter rights/guaranteed freedoms and side with complainants. Really, it would be a lot better if this nonsense were written into law because then it could be challenged immediately in the high courts. Because they won't actually be bringing charges it's the civil courts that will have to put pressure on the police by essentially extracting money from them until they realize that this abuse is a liability.

Edit: Unfortunately, there will be a lot of people without the means to fight it that will be abused by this before anything has a chance to change.

A couple of days later she stared directly at my crotch. I thought I could grab this opportunity and did the same thing. For example, I go reasonably often to a local store that employs a dwarf. Well, now a dwarf is pretty interesting and you don't see one all that often. Should staring be a crime? Well, of course not, barring extreme repeated behavior which is better characterized as stalking. We already have a crime for that. However, not being a crime is no reason to throw out the baby with the bath water. Common courtesy is still of extreme value in a civilized society and should be observed. It is not polite to stare at any stranger for any reason. Most people learn that by age 3.
