This story is so typical at this point. Boy meets girl, boy and girl have sex, everything is just fine. Then when the guy sleeps with a different girl, the first girl gets jealous and decides, gasp! "She was raped!"

Fucking sickening that people do this. Not just for ruining this guy's life, but for undermining ACTUAL sexual assault victims.

The retrial itself is unconstitutional. No matter what "new evidence" comes up, the person cannot be retried after being found not guilty.

Why are these not handed off to the authorities in the first place. A school has no business investigating a crime. If the guy is found guilty, the school can then decide how to proceed with his enrolment; if he's found not guilty, or no charges are filed, then the school does nothing...other than hold a disciplinary hearing about the false allegation.

It is possible for there to be evidence that an assault occured, without there being enough evidence to procede against an individual. In that case I would assume that nobody suffers disciplinary action.

Just so people understand the legal framework here. At a public school, a student has a property right in their education. That right cannot be deprived without due process of law. That is what these lawsuits are about--whether public universities are depriving male student of their right to an education without due process. The "re-trial" here was an administrative appeal not a "new trial."

Before people rape me in the comments, I am not at all defending the practices here. In fact, I am involved in 2 of these lawsuits on behalf of clients. But the comments here show a major misunderstanding of how these proceedings work.

I watched a documentary yesterday called "The Hunting Grounds". It was screened about the same time I started a sub here called /r/pussypassdenied. A sub I started as a joke response to some comment I have long forgotten. Circa mid to late 2014.

In my tenure of being a PPD mod I have watched it become massivly popular and hated, depends where on the feminist spectrum you sit. I am well past university age and do not know anyone personally that is so polar on being a sexist either way but the number of stories I see day in and day out is just scary sad.

A very big chunk of the target people in the documentary have since been proven, 'liar liar pants on fire'. The only reason I have even the slightest clue on any of it is because I modded hundreds if not thousands of posts on a very big chunk of the situations covered in the documentary.

My opinion is fuck rapists regardless of gender. However one of the points raised in the documentary which I whole hearted agree with is that Universities are employers. The kangaroo courts they use need to go.

It is simple. Males should be taught not to engage in sexual activities with females until their degree is finished. Avoid sexual encounters. Sex is good and all, but not being thrown out on a whim is even better.

I find it insane that private or non judicial public bodies have the ability to run such proceedings on criminal matters. Is that not why we have a court system. Rape is terrible, but it isn't just rape that this shit happens on campus with. Get caught drinking under age and a state court clears you of the crime. Well you still have to deal with universities bull shit because you were accused in the first place. I experienced this first hand. Got caught standing near a bottle of vodka (not drinking yet as I just arrived), got charged uneraged possession, went to court and got it dismissed because not a single person was breathalyzed, university still expects me to do the work as if I was actually guilty.

Universities are in a bind. On one hand, you have the entire circus atmosphere in which academics and students advocate for ideas that would never survive the scrutiny of the real world and on the other you have over-reaching Title IX recommendations from the federal government. They have no choice but to over-estimate & force the courts to decide through lawsuits.
