A woman should definitely be allowed to sue a man if he cheats on her and then gives her an STD or worse. I've heard quite a few stories about women who ended up with STDs after their boyfriend/husband cheated on them with a prostitute.

This doesn’t make sense for a few reasons. (I’m an attorney who formerly specialized in family law and I’ve hashed this out many a time in the last decade or so)

There is no cause of action for suing the husband. AOA claims, where they’re still permitted, maintain that it must be a 3rd party, not the spouse.

If he’s your husband, any money getting paid out to you, comes out of your own coffers. There’d be no benefit.

In addition, the civil redress for adultery in a marriage is divorce and requesting a bigger division of assets in the dissolution. *ETA Criminal Conversation is also an option in the state of NC against one’s former spouse but again, these are two different forms to address wrongs.

But, as I’ve already stated throughout this thread...we do??? We penalize by lump sum (or periodic payments) at the end of marriage during asset division and/or by barring men from alimony claims if they normally would have been entitled to seek it.

That’s the recourse. We have it. Now we need to focus on hiring attorneys that are intelligent and savvy enough to use it.

1) just because something is on the books doesn’t mean that it’s ever prosecuted. There’s laws about not putting an ice cream cone in your back pocket but when was the last time you heard somebody get locked up for that?

2) a tort or civil wrong, is completely different from a criminal offense. I literally don’t even know the point that you’re trying to express here by saying that it’s illegal? Many things are illegal but that doesn’t mean that you can sue somebody for doing it; laws don’t always match up perfectly that way.

My point is that there are antiquated laws that are still on the books; that’s why your quote says “technically;” were a prosecutor to attempt to follow through, he’d be laughed out by the presiding judge. Same as the ice cream example, which ALSO hasn’t been prosecuted in many years.

The audacity of you to say “I’m pretty sure lawsuits are possible” when a person with an actual degree and license to practice law takes the time out of her day to explain something to you is absolutely appalling. Check yourself.

I was responding to you and everyone else in conjunction with this article. I’ve been explaining up and down this thread that AOA claims are a separate tortious wrong and that the redress against spouses is separate and under a couple of completely different legal theories.

I can see how you’d be confused if you didn’t know that the question wasn’t a hypothetical, but was instead Elle trying to open up a dialogue about alienation of affection claims.

I mean it matters because knowingly being the other woman is pick me bullshit and low value behavior. It’s throwing another woman under the bus for a subpar dick and a guaranteed NVM. Why on earth would anyone ever compete for a man? That’s your prize? Really?

Obviously the cheater sucks too. A betrayal from someone who is supposed to love you is really fucking painful, that’s on the spouse. There’s more than enough blame to go around though and that doesn’t absolve the affair partner IF they knew. The Obvious exception is a duped affair partner. Their defining moment in morals is what they do once they find out they were sleeping with a married man.

Also it’s never just cheating. Cheaters deceive their partners (gaslighting), degrade them verbally to their faces and to others, deny their partners informed consent, financially abuse their partners (gifts and hotel rooms are taken out of the marital fund), expose them to disease, and let them carry on making life choices and long term financial decisions they would not have made with a partner who has his head in another woman’s skirt and a foot out the door. Does that sound like a HVM? Is this what you want your own relationship to look like? Is that really behavior you’re okay with?

We are better than that. I will be absolutely floored if the mods here support being the affair partner because it flies against a good portion of the handbook.

It's just that it wouldn't make sense to sue the other woman when the husband is the one who broke the commitment and potentially endangered his wife.

I see it practically every time infidelity gets brought up and when comments that are similar to mine get downvoted. There are people here that react defensively whenever this topic comes up and scramble to justify cheating, just like any post about kink brings out the kinkmeishas.

The other woman also potentially endangered his wife and took part in benefitting from the financial abuse if she received gifts or hotel stays from the marital funds. While I personally would keep my husband accountable by divorcing his ass in this situation, I also would take full advantage of suing the other woman if my case applied. Divorces take time and there’s no point in suing someone you are still legally married to. I’d likely have to sue the other woman prior to divorce to divide the assets more in my favor during the divorce proceedings if adultery matters to the state, which is probably why you’ll see cases where the other woman was sued at the time of the report and not the husband. There are things you need to prove in an alienation of affection case to successfully sue (look at the reversal of the suit against Fantasia. Since she did not know he was married and thus didn’t intend to do harm, the lawsuit was reversed. To me that’s fair). If a case meets the standard why wouldn’t it make sense to sue?

Yep, I see it too. I've had people tell me I need to support the women who screwed my now ex husband because all women need to support each other. Those women were not supporting me when they were slurping on his fucking dick and spending what was supposed to be some of my retirement money. But I have to be nice to them?! They're my allies?! I'd bet my car there's a good chunk of women on here screwing married men because they're getting off on thinking they're better than his wife. Why is it that we are supposed to accept that affair partners don’t owe betrayed spouses shit because they didn’t make any vows to them, while simultaneously betrayed spouses are supposed to ignore any potential resource they could legally use to aid in a divorce or sue for otherwise they’ll be seen as petty or anti-women? Former family law attorney stepping in:

This isn’t about some poor sweet woman meeting a lying guy on online dating and the scorned, hateful wife decides to come in and ruin their happiness.

No. To prove alienation of affection, there has to be proof of the third party’s malicious actions, aka proof that he/she knew that the partner was married and made affirmative actions to continue and further the affair despite knowing that fact.

You literally cannot prevail on an AOA claim without that fact. There are plenty of other tort claims that fall along those same lines but for some reason, this gets people up in arms. Historically, it was men suing women’s friends and people she knew (not sexual in any way) for alienation of affection when they were helping a wife realize the husband was no good. But now that women have weaponized it, it’s suddenly being touted as fighting over a man? Nah. AOA lawsuits are essentially highly specific tortious interference with a contractual relationship suits and as FDS says, it’s paramount to remember that marriages are contracts that should benefit us, first and foremost.

They intentionally leave out information to lead people to the conclusion that they want, which is the eradication of AOA lawsuits in this case. My whole issue with this dumb article is that even if you can make a case for AOA, 99% of the time these women have no assets. You can't get blood from a stone, as my LV father used to say (about his child support, classy guy). What the hell would be the point in suing someone with no possibility of redress on the other end? You're just out time and money for what, a shitty man?

Get proof if you can, dump his ass, and pursue your divorce options with extreme prejudice. Then block and delete unless you have to coparent, may God have mercy on your patience.

There’ve been some pretty high profile cases, such as Fantasia’s. It doesn’t need to be used every time or even often, imo and it isn’t. Only about 200 cases or so are filed per year in the whole state of NC. But, there are plenty of torts that aren’t very common, like wrongful birth/life, that are still incredibly useful for recovery of damages when you happen upon a particular set of circumstances that lines you up for a slam dunk.

Were I in the wife of Fantasia’s boyfriend’s situation, I believe that I could have done the same thing. It ultimately failed, as the wife could not meet all of the elements of her claim, but the potential payout would have been worth it.

The mistress often doesn't know, and courts don't care to take it on case-by-case.

The only one who should be blamed is the one who broke the marriage contract - but then again, how many areas actually stipulate that a husband must be sexually loyal?

The entire marriage system is not set up to benefit women, and if we're thinking we have any kind of legal edge, we're incorrect in most cases.

There need to be legal repercussions against a man for legally entangling a woman with lies, that's for sure.

For a while some women were trying to get laws passed against "rape by deception." Basically, any consent given was based on fraudulent assertions and therefore invalid. I like the concept but the execution of this could be very tricky and even end up hurting women if men tried to use it against us. That's honestly the biggest issue with marital entanglements. It's not just a business partnership, and nobody is going to truly know who made the bad decisions from the outside.

Marry the wrong guy, and you go down with him in most cases.

Couple things here.

  1. If the adultery partner can demonstrate in their defense that they did not know that the spouse was married, there will be no recovery because the elements of the claim will not be met.
  2. The courts absolutely take things on a case-by-case basis, particularly in criminal and tort (civil wrong) cases, like here. A court has to hear the case to ensure that all of the elements are met prior to making a finding of fact. And that’s as a matter of law as these findings make the basis for appeals.

We can do better than spreading misinformation like this.

I’ll provide examples for you but please note that in your reply you didn’t bother to address the incorrect information in your original comment. Armchair attorneys run rampant and unchecked on Reddit and it’s important to me that FDS be a place that women can turn to and reliably get accurate information.

Long attorney ramble:

Well, in the years that I’ve practiced, where there was infidelity, we did request a higher percent when calculating property division and it was consented to in lieu of going forward with either a bench or jury trial (I live in one of the very last states to still allow jury trials for divorce actions.)

In one of the bench trials I second chaired, we drug the former mistress in, had her testify to knowing he was married, had her detail the surgeries he paid for, and how they went about hiding the trips and shopping sprees from his wife. The judge didn’t take too kindly to that and he was penalized in property division as well as barred from claiming alimony (she was the breadwinner) as a matter of law in my state.

Bad acts are 100000% calculated in the calculation of assets and alimony during the dissolution of a marriage in every state I can think of and likely most countries in the world. Abuse, adultery, and abandonment are the three that come to mind as being frequent fliers in divorce matters. Look up your state code and I promise you there is a non-gendered law on the books that will indicate how it plays out; it’s up to us to get attorneys that are knowledgeable and will advocate for us on every possible basis.

Just because you lack the personal experience does not mean that it doesn’t exist or doesn’t happen. It’s common as all get-out. Just type into google “How does adultery affect my divorce in (insert state)” and you’ll get literally dozens of law firm websites with exacting, nuanced answers begging for a chance to help you out.

I'd say it's a 50/50 toss up, ESPECIALLY when the woman is younger.

But there is one party who ALWAYS knows the man is married, and that's the man.

I'm not saying the man isn't responsible, he 100% is every single time and deserves to absolutely lose his ass in court. But this entire post of people rushing to excuse these vile women who fully know what they're doing makes me uneasy. In my own experience, everyone also rushed to support my ex's affair partner(s) and alienate and isolated me because I was "being negative all the time".

As a society we let Other Women off the hook way too much, and I think it massively contributes to Pickme culture. There's nothing more Pickme than being the Other Woman and knowing it.

another thought: the way they villify this mistress is the reason single women start being excluded as their friends marry and get older. They frame her as 40, single, "running out of time" to have a baby and husband, so she decides to steal another woman's life out from under her. (This is a dude who posted revenge porn of his ex wife, I wouldn't say he's an innocent and upstanding man that was manipulated by another woman.)

The idea that older single women are desperate and will steal a husband results in single women being ostracized from social groups and it's so wrong.

Part of the reason why I was using dating as a way to find friends (something which I only later realized I was doing, and that it was harmful for me) is that I lost all my female friends when they coupled up. Some flat out told me they weren’t comfortable with a single woman being around their family. After years of friendship!! They act like single women all want their shitty husbands or like being single is such a shameful state and it’s contagious.

Being a single woman of a certain age is very isolating. People are afraid of you, or they pity you, or both. They’re suspicious of you. They think you’re weird or crazy. And yet despite all this they resent you. I think it might even be worse if you’re considered attractive or a good catch because then people can’t point to some “reason” why you’re single.

I’ve stopped trying to make friends of men, because I realized I was doing that and that they didn’t want to be my friend anyway. The only friends I have now are lesbians.

I’ve developed a pretty thick skin about it. Pre-Covid I’d go to fancy restaurants, concerts, vacations or whatever I wanted to do, by myself, and I’d just ignore the smirks and whispers. And I’ll do all of it again. I just wish people would get the fuck over it.

That's a good point to bring up. I'm 32 and it's started to happen to me. My mom got divorced from my dad when she was around my age and was ostracized socially as well.

This happened at the church she attended, in neighborhood/mommy groups, and even her best friend who was also recently divorced basically married another guy real quick and ditched my mom so fast.

Neither of us are the type of person who would ever DREAM of "stealing someone else's man."

If the woman involved clearly KNEW he was married to another woman and yet continued to pursue the fling with the man, yes she should also be sued. Its negative value for a woman to be getting with a man she knows is married too, and ultimately she still doesn't get picked.

I remember being in a relationship when I was young and stupid and several other women clearly knew I was dating him and still were throwing themselves at him, aggressively trying to hookup with him. Why were they chasing after a man period let alone a man thats taken? Its low value behavior- ladies NEVER bother with a married man.

I think this law could be a useful deterrent for

  1. "Other women" who go after married men intentionally
  2. Meddling in-laws who intentionally create divisions in a marriage (this happens more than one would think).

Honestly the number of comments on here sympathizing with the other woman is surprising Yes, the man is the one who is married and he should be the one primarily held responsible via the divorce and any other legal avenues available to the wife. But that doesn't make the other woman blameless.

I've seen situations where women targeted married men- often due to money or sometimes just for the fun/attention of it. Classic Pickme/Sugar Baby behavior that we talk about often on here. These women pit themselves against other women and get off on hearing about how bad, unattractive, and mean the wife is and that she isn't "meeting his needs." This doesn't mean the scrote husband is not responsible. BOTH the cheating parties are responsible.

In the case that the other woman was tricked and lied to, of course she is not responsible for that and she is also an aggrieved party in the situation. I don't think she could be sued in that case and she is a victim of deception.

I would like to sue for the money they knowingly took from him out of my marriage. I'm not going to lie. He was claiming money was going into his 401K and it was going to women who knew about me, some who knew me and pretended to be friends with me, and they gleefully took money from me and my son. I basically worked to hand money to horrible, nasty women who screechingly laughed about hurting me and my child behind my back while they smiled to my face.

I absolutely think that the scorned spouse should be able to sue the other woman if she's aware of the relationship. I feel like there's a lack of nuance regarding OW, and while many aren't aware of what's going on, I think there needs to be an understanding that 1. There are women out there that have no problem steamrolling over other women for their own ends and 2. OW behavior leads to MORE, not less, LVM. OW that know what's going on have agency, treat her like an adult and hit her ass with some consequences.

Getting rid of AOA laws in many states mainly serves to benefit cheating scrotes and the pick-mes that will fuck over another woman for attention.

After reading that, I think a law like this is a really bad idea. It seems like yet another way for a misogynistic society to victimize women using other women, while diverting responsibility from men. I haven't looked into it, but I'd bet a lot of money that in the last 50 years this law has been primarily used by women against their husband's mistress(es). How would you even prove the 3rd party deliberately and maliciously worked specifically to break up the marriage? The only examples I can think of that would remotely come close are from Disney or soap operas.

This tactic has been used by LVMs forever...the object of the game is to reduce the amount of anger at him by getting the woman he cheated on to blame the other woman and not him. Don't do that. The best thing you can ever do is hold him solely accountable for his behaviour and then walk away.

This story right here is probably the number one reason I won't date men with kids - who wants to find themselves in the middle of a disaster like this? Not me.

You make a good point about the LVM tactics- even if there are some circumstances where I think it could make sense to use this law, most divorcees would probably just do best to hold the husband accountable and walk away... for the sake of their own peace and well-being.

The exception might be where it truly is a case of a third party coming in and attempting to break up the marriage- for example, I have heard of women getting calls/texts from an affair partner or a woman going after a well-to-do man on purpose, and other soap-opera type stuff. If that's the case where someone has evidence that the OW knew and actively participated, I see nothing wrong with seeing if this law applies.

Either way, the man belongs in the garbage and is the most responsible for stepping out on his wife.

While I would never condone a woman sleeping with married/taken men I have to point out that it wasn't her who promised commitment to you. Sure, to shag someone's man is extremely low-value but that's her standard for herself and at the end of the day we can't expect others to be gatekeepers of your man's moral code. Any form of straying should be punished on the spot. Personally to me, wondering eye is already a dealbreaker, leave alone if I find a man chatting with female "friend", ogling Insta models, having an "old" Tinder account, etc

Here’s the thing: if we agree that affair partners don’t owe anything to the betrayed spouses because they made no vows, well, the logic follows that betrayed spouses didn’t vow to give up their right to sue over alienation of affection for the affair partners benefit.

Personally I dump men if I even suspect infidelity, but if I lived and was married in a state where alienation of affection torts existed I’d sue the other woman too if my case applies. It’s extra evidence for division of assets, and infidelity usually comes with a helping of verbal and sexual abuse, and financial abuse that the other women profited from. Why shouldn’t any betrayed spouse look after themselves and take advantage of any resource that could give them legal or financial benefits? Her husband and his affair partner got theirs, why shouldn’t the betrayed spouse get hers?
