They actually prosecute false rape accusations in the UK routinely, there are hundreds of cases. It's very common that it is prosecuted.

Completely ignoring the false accusation that wasted thousands of dollars, all the work of the police, detention of two innocent individuals, and the cost of bail plus the wonderful fees associated with all of that - what about her state of intoxication? I'm not from London, but isn't cocaine illegal? Isn't its use looked down upon? Do people of "good character" use it, especially mixed with alcohol?

If she's using the police as a proxy for violence against an innocent man, I see no reason why she shouldn't be accountable for everything they do to the victim in reliance of this lie. Charges for (in this case attempted) false imprisonment and kidnapping would be appropriate, which when combined with perjury would add up to a morally adequate custodial sentence. This is before even considering the civil liability.

I think this would legitimately harm the interests of justice. Setting aside any ethical debate about proportionate punishment for now if such a high sentence was allowed it would harm the reporting of crimes. Now I get that the whole "if you did nothing wrong you have nothing to fear" argument but sometimes the courts have an inquisitorial purpose to serve and the possible threat of a not proven/guilty verdict being used as evidence in a charge of false accusation with such a high penalty would, I think. genuinely discourage the employment of the legal system.

The biggest problem with it all is when someone falsely claims a crime they are pulling resources from actual crimes.

Next the accused usually has their name released by the accuser now it's stuck with them for the rest of their life even after they where found to be false.

This is why the false accusations should be held at the same level as if they are true but only if they can't corroborate the story, that way people who have it actually happen to but harder to prove don't get falsely imprisoned.

If her accusation had only wasted police time (ie made the police search for non-existant people with a vague description of them), then a 1 yr sentence would be sufficient.

However she directed a false accusation against two very specific men, that shows a clear degree of intent and maliciousness. Putting her on a sex offenders register and a 5-10 year jail term would be far more appropriate in this case.

If I hired a hitman who turned out to be an FBI agent, I'd be put away for a very long time. Maybe not quite as long as if I'd hired someone who followed though, but a long time, nonetheless.

She "hired" the government to kidnap, imprison, and enslave these men for what likely could have been 10-20 years each. Her punishment should be pretty severe for such a violent and inhumane act.

Never said she shouldn't be seriously punished, and I understand the sentiment to want her punished as severely as a rapist would... but it's clearly not as black and white as that.

The way I look at it is, if her false claim never substantiates, there is still the potential for everyone involved to avoid seriously damaging outcomes. That isn't the case for an actual rape, where no matter what results of the accusation a woman or man will have still been raped and will suffer both during and after that experience for the rest of their lives. Again, presuming there was an actual proven incidence of rape.

It comes down to what you are punishing the perpetrator for; if a person is raped you don't just deserve consequences for the act, the pain/suffering of the act, and the threat you now pose to others... but you deserve consequences for the continued pain & distress you have inflicted on that person. Not that there are no remaining effects of being falsely accused, but that they are not to the degree of the experience of being physically raped.

If a person falsely accuses another of rape and is quickly outed as a liar with minimal effort, the person accused of rape won't continue to suffer from that experience remotely as much as actual rape victims. Because of that I cannot bring myself to believe a false accusation deserves the incredibly severe consequences that committing an act of rape does.

To me, really, it's less about punishment and more about protecting people from her obviously sociopathic character traits while also presenting her as a figurative head-on-a-pike to deter others from similar transgressions. Punitive incarceration doesn't usually make anything better for anyone involved.

While "authorities" may not "believe" any further rape claims...that doesn't stop her obviously poor character from negatively affecting the lives of everyone around her in other toxic ways.

That said, I don't think what she did is akin to successfully-perpetrated rape. It's more akin to attempted rape or attempted murder. She attempted to violate others using the violent force of the state. She's no less dangerous simply because she failed her goals.

The thing is, if you catch her in a false accusation once, her chances of doing damage later are severely limited because her sociopathic behavior relies on a response from law enforcement to do her damage... yet she now has a record of false accusations so she has forfeited her female privilege. Whereas a sociopathic rapist can only be caught after the fact thus presents a much greater threat.

While neither person is remotely defensible, there are absolutely differences in the consequences of their acts & threats they pose, which deserves differences in punishment.

I'm sure she's deemed attractive enough in her circles to accomplish violence-by-proxy without relying upon government agents...and she wouldn't be the first to accomplish such a thing.
