I was speaking to my work mate who used to work in the world of magazines and he said that most successful glamour models and porn stars had minds of steel because the ones that didn't just got taken advantage of and couldn't capitalise on their fame. However everyone of them knew how to act dumb because they knew they earned more with a non-intimating persona. He said he often saw them completely switch personality in a fraction of a second.

I am honestly curious to see what will become of this. There was that one case in Georgia where the guy took upskirt photos of women at like a target or something and he was not charged because 1. Georgia's laws are a little outdated (all laws governing technology are a bit outdated) 2. there was a debate over what constituted as a "private place" i.e. not up someone's skirt in a public setting like a store according to Georgia.

Taking secret nude photos of someone for personal use isn't ok, regardless of intent. Just because you 'intended for them to be between friends' clearly doesn't matter because surprise, they can get leaked. And you shouldn't fucking do it anyway.

The fact her story is they were accidentally leaked proves exactly why intent doesn't matter in these cases- the end result is the same. She clearly didn't have the control to keep it private, and therefore knew it was not a guarantee. Her intention was therefore one of sharing.

If that were true then people's private nude photos wouldn't end up all over the Internet. A sub like fatpeoplehate back in the day a lot of the time took photos of people in public and then put them on reddit to shame them, with the person maybe not knowing for ages and then I'm sure at least one time they discovered themselves being shamed. If you share it with just one person that's enough to get it out there and exponentially grow since you have no control over who they share it to and how many, and is already breaking the invasion of privacy law that she's being taken to court for

Intent matter in cases where the person does something neutral and it ends up in someone getting hurt. Example, I move this nonslip mat away from the doorway coz someone might trip on it. Someone slips and gets hurt instead coz it's raining. That sucks, but there was no ill intent.

I think you're right. The OP's article states as much. It says that she asked for leniency and the prosecutors refused due precisely to her refusal to admit wrongdoing or accept responsibility or do anything contrite or remorseful.

So I think the fact that it has gone this far is almost entirely her own fault. It was her fault to take the photo. It was her fault to send it to anyone -- whether just her friend, or her fans. This is so awful! I swim in the mornings and shower at the gym regularly. If you have balls and have never blow dried them, you're missing out. If you want to take it to the next level and achieve ultimate comfort, use baby powder or talc powder on them after blow drying. However, if the defense is successful, that will most likely be viewed as a pussypass, particularly if the legal defense was not that strong but she prevailed anyway because judge or jury were swayed by her. As far as I've seen, "allegedly" is used up until the court has made their final decision on whether the accused is guilty or innocent. This prevents instances of actually accusing a person, like slander, if they do wind up being found innocent by the court.

Is it followed in all instances? I wouldn't say so, but I'm assuming this is the general reason for the use of "allegedly" regardless of how much evidence is present at the time of accusation, arrest, and so forth... Because you simply never know (again, not related to this case per say in regards to evidence, but as a general rule)

Just to clarify, criminal courts NEVER find a person innocent. They may find a defendant "not guilty", but there is a very clear legal distinction between being "actually innocent" versus merely being determined to be "not guilty beyond a reasonable doubt".

I am not just saying this to be pedantic here, because it is something I think everyone should appreciate. The correct term if you have been charged with a crime is that you are "not guilty until proven guilty". There is a HUGE legal difference between being found "not guilty" in court versus being actually "innocent" of a crime (and you will notice that courts do not find defendants "innocent" at trial when the verdict is read and comes out in the defendant's favor). This is why, when a court verdict is rendered in the defendant's favor, the judge or jury will NEVER say "we find the defendant INNOCENT". They will always say "we find the defendant NOT GUILTY".

"Not guilty" just means that the prosecution failed to prove the defendant's guilt beyond a reasonable doubt in court. A "not guilty" verdict is not interpreted by the Powers That Be to mean that the defendant was actually innocent of the charges. Because of that, courts do not routinely seal or destroy an arrest record if you are found not guilty in court (because they do not interpret you as being actually innocent), and that charge and evidence can still in some cases be used against you, even if you were never convicted in criminal court of the crime.

They do it to fool you and pretend they (the state and federal government) actually believe that and will adhere to it! I am not kidding about that either! It is a totally bullshit statement to say "innocent until proven guilty", and countless lawyers will agree with me, because once you are charged and have to go to trial for a supposed crime you committed, you are legally no longer considered "actually innocent" of the crime until proven otherwise. The best you can get at that point is to be considered and judged "not guilty" by a judge or jury because the state/federal prosecutor (or Crown Attorney in Canada, where I am from) was deemed to be not able to prove their case "beyond a reasonable doubt".

This is a topic that has been discussed quite a bit - usually amongst defense attorneys in particular and amongst regular citizens who have been found "not guilty" of criminal charges in court but still find out, even years later, that those charges that the court dismissed or found them "not guilty" of, can still come back to bite them in ass and cause issues.

Hell, I know this first hand, as back when I was 18 years old (many Moons ago), I was very wrongly charged with the crime of "dangerous driving" here in Canada by an aggressive cop who was a total lying, perjuring asshole. Thankfully for me, the evidence I had (video, audio, and eyewitness) was able to prove this, and the case was thrown out of court by a judge who saw the evidence and realized the cop was drastically overreaching - even to the point of the judge rather dramatically admonishing the police officer in the courtroom for charging me at all, let alone charging me with an "indictable" offense (basically meaning the "dangerous driving" charge in Canada is pretty serious, and carries the same weight as a "felony" charge in the USA). Yet still, to this day, if I try to visit the USA, I ALWAYS get questioned about that arrest. The arrest is still on my record even though I was found "not guilty" by the courts, and even if I was to go and try to get my record expunged and have that charge removed from my record, it would be extremely difficult (basically impossible) to have it removed from all the criminal databases it has already been shared with and spread to globally.

Basically, once you are charged with a crime, you can forget about the concept of being "innocent until proven guilty", regardless of what happens in court. The best you can hope for is to be found "not guilty", and the way many prosecutors, police, and border officials look at it when they run your record and investigate you, all that "not guilty" verdict means is that you somehow "beat the system" - and it does not mean that you are to be considered "actually innocent" of the crime you were charged with. Just food for thought to keep in mind.

Yes, you are indeed correct about the "double jeopardy" laws. However, the double jeopardy rulebook in criminal cases does not transfer over to civil cases, so you can be found "not guilty" in criminal court, have new evidence emerge later proving your guilt, and have that new evidence allowed by a judge to be introduced in a civil case if you are sued. Plus, in a civil case (where you are being sued for money as opposed to the state bringing criminal charges against you), a judge there can still allow criminal court evidence to be used against you, even if you were found "not guilty" previously in a criminal court action, because the "burden of proof" requirement is a lot lower in civil court than in criminal court. In a civil court setting, they only have to meet a "preponderance of evidence" standard (was it "more likely than not" that the person is guilty), whereas in a criminal case, the prosecutor has to prove you are guilty beyond the much higher standard of "guilt beyond a reasonable doubt".

So, just because you might be found "not guilty" in criminal court of a crime does not mean you will be found "not guilty" in civil court later if you are sued for damages from the same crime. The OJ Simpson case is a classic example of this - where OJ was found "not guilty" in criminal court, and then was forced to pay millions when sued later in the civil arena by Fred Goldman's family, as the civil arena courtroom has a much lower standard of evidence that needs to be met.

I think you are taking an incorrect tact here. I know a lot of this is subjective, but let's be fair: being obese aside from serious uncontrollable medical conditions, is a choice. However, trying to own up to it and correct is also a choice and a good one at that.

Shaming someone who is overweight and out of shape, but who is in a gym presumably to work at correcting it, is deplorable (arguably more so than shaming anyone for any reason). It would be like shaming someone for going to a doctor for a medical problem. Or going to a psychologist to work out a personal issue. Or a financial advisor to work out a money problem. Not sure what the title of the segment they did was, but she was definitely the person they would send out when girls would call in to catch their man "cheating".

The premise, for those who are not familiar, is that Frank would bet that listener's boyfriends would not be able to turn down Dani, a former Playboy playmate, if she approached them in public. So girls would call up and provide them info on where their boyfriend worked etc. and Dani would go out and hit on them (like a sting). Then a week later or so they would get the girlfriend back on the phone while on air to listen in while Dani called their boyfriend to see how far she could take the conversation. Then eventually each guy for the most part would talk about meeting up to bang and they would unmute the girlfriend and all hell would break loose. Frank would then die of laughter due to the naivete of these girlfriends calling in thinking their boyfriend would turn down a playmate.

There was one guy that knew what was going on and started talking about how he was just trying to work out and this older lady with bad breathe came up to him and started hitting on him. Dani was upset because she had never been ridiculed before. It was pretty funny, but then at the end he said he knew what was going on because he was a listener of the show.

It was a shitty thing for them to do, but it was hilarious listening to Frank die of laughter each time.

I'm sorry but the charges she's being charged with is not fair in my opinion, she should be charged with a felony. For Christ sakes she took a picture of an elderly woman naked without the person knowledge then preceded to post it on social media where everyone can see.

Not trying to defend this idiot more question the title. For the record body shaming is legal to an extent. So I wouldn't really refer to it as a body shaming case, it's more of a violation of privacy case. Maybe I'm being too nit picky, it's just when I read the title in my mind implied body shaming is illegal.
