First a bit of backstory: My son is in kindergarten, and I and his mother have never been marrried and have been separated nearly his entire life. We have been managing custody and support issues ourselves, as we do not have court orders in either respect. My son lived with me for the entirety of the last school year while he was going to preschool -- his mother had asked me to take him so that she could "get her shit together" (her words) as her new marriage had failed after only 6 weeks and she was trying to figure out what to do next. We live in different cities now, separated by about a 40-minute drive.

I registered my son for kindergarten in my city, and he attended the first three days. This was not acceptable to his mother, who was adamant that he should be living primarily with her and going to school in her town. After those first three days, I returned my son to her for the weekend, and she has been preventing me from seeing him ever since. She enrolled him in a different school in her city.

Yesterday was the end of the second week at the new school, and I decided I would pick him up at school, because I'm not able to see him any other way and I am within my rights to do so. What happened blew my mind.

I presented my ID and proof of my paternity to the front office, who proceeded to tell me that unless I was listed on the "emergency contact form" they have, I could not take my son. I argued for a while, asked if I could submit an emergency contact form ("only the person who has registered him for school can do that," they said), etc. and got nowhere. I asked to talk to the principal.

Before I was able to talk to her, one of the office aides called his mother and proceeded to tell me that "mom doesn't give her permission for you to take him." Note again that there is no custody arrangement with the courts, meaning I have every right his mother does in choices of upbringing, custody, and so on. So I talked to the principal, and was denied my child again. "Sorry, it's the law," she said once, and "sorry, it's district policy." I didn't feel that making a scene would be to my benefit here, so I left without my son and looked up the law.

Turns out, both the Code of Federal Regulations (34 CFR 99.4) and the district's official policy explicitly say that both parents have the right to release of a child unless the school has legally binding documents indicating otherwise. Needless to say, I feel very violated and angry. I want my son and I want justice. I am considering talking to some attorneys to see if they are interested in this situation.

I wanted to ask MR, though, what would you do in this circumstance? Has anyone here been through something similar? Any advice for this angry dad?

TL;DR: School violated my rights when they refused to let me pick up my son. What's the next step?

Edit: I'm definitely consulting multiple attorneys on Monday. I'm quite anxious about it as I have never needed one before and I have no idea what to look for or how to judge a lawyer. You have made a big difference in my demeanor today, if nothing else. I can't describe the rage that has coursed through my veins lately. Fortunately I've been able to keep it there --- no explosive bloodbath, yet.
