My wife came in with 100k of debt. I didn't know the amount until we were almost engaged. Honestly, has been fine because we both work (her debt was from her nursing degree) and a huge chunk of it is gone now. Unless she's planning on quitting her job long-term it doesn't have to be a dealbreaker.

They still are underpaid. Those nurses getting access to extremely well paid salaries are either travel nurses, or nurses working specifically in covid wards. You shouldn't have to do either to not be underpaid, which is still the majority of nurses.

I'm not going to make assumptions about your relationship. Many of them do work out long term, and many do not. Given that the divorce rate is over 50%, it's a crap shoot. I decided a long time ago that I want any potential long term partner to be completely self-sufficient. When they're not, it becomes really easy to question the nature of the relationship. Are they only interested in me for the resources I can provide, or is there a genuine physical attraction and personal connection?

If they’re federal loans, they won’t count your income when figuring the monthly payments unless you’re married filing jointly. If you’re married filing separately, your income isn’t counted. You wouldn’t be responsible for the loans anyway, but your income is figured in if you file jointly. If they’re federal loans, any remaining balance is forgiven when your wife dies. If they’re private loans and you co-signed, you’d be responsible if she died or couldn’t pay.

I urge you to really think about this.

Imagine you have a debt of 100k. You’re with someone for x amount of years, and never mention it although you tell them other really secret details of your life. Then after a large amount of time has passed and your sure this person is madly in love with you, you tell them that you have a 100k debt.

I don’t know the details of your relationship, if she’s been trying to pay this off slowly whilst your together but if she hasn’t been making payments and it’s been growing whilst she was with you. Then you have to consider that a huge driving force in her wanting to be with you, is her being able to share her 100k debt with you.

No respectful man in their right mind, will spend years with a woman before telling her he’s in massive debt. It’s not commendable behaviour.

Honestly you're imagining the worst, we started dating in college and we had talked about our debt early on just not in terms of hard numbers. She makes enough alone to cover her own payments easily so I'm not worried she's trying to leech. Then talk to her about her plan to pay it off. You can help, but not in a direct way. E.g. you can offer advice, help her with financial planning, or you can both decide to live more frugally, with the money she is saving going towards paying off her debt, and your money going towards your savings. For my taste Dave Ramsey is a bit overly conservative in terms of loans, but maybe check out his program for some guidance. I think he is quite good for people who are lacking financial skills, which might apply to your girlfriend.

Thaw same thing happened to me I met a beautiful girl that was a history teacher and got her degree from USC and she wanted to get serious and get married. She literally said, “ We can get married and you have good credit so we can buy a home and later refinance to pay some of my school debt baby”. I knew what was going on immediately and I dumped her real quick. Last I knew she’s living with her mom and they repossessed her car. She had at least 100k in school loans.

They hand out student loans like candy in this country. It's part of the reason tuition and other costs of higher education have skyrocketed. As for the credit cards, as long as you keep paying some of the balance you can keep a line of credit up. Most of the time, you can apply for other credit cards. Banks are more than happy to let people fall into never-ending debt, as long as they keep getting paid back tenfold.

This answer right here. Student loans are guaranteed by the government. (Meaning the government guarantees the bank that the loan will be paid.). So, pretty much anyone with a pulse, capable of wandering into a bank can get a student loan. And the banks don’t have to worry about how much they lend you because the government is going to make sure they get paid. Believe it or not, student loans are one of the few things that don’t go away when you declare bankruptcy.

When this started, it was a good idea, at least in theory. Making it easy for everyone to get a loan so they can afford a higher education has a great many benefits for society. The problem is schools have increased prices substantially because anyone can get a loan. It used to be that you could work during the summer months and be able to afford an education. That just isn’t possible anymore.

Predatory lending. They give out loans to anyone and everyone, then apply exorbitant interest rates to make sure you're basically never paying down the principal. Credit card companies used to do it a lot too - when I was a kid, my cat who had just been chipped ended up receiving a credit card in the mail, it only had a few hundred dollars as a limit, but it was fully functional and required no verification of any sort, and had clearly never been applied for.

Yeah, I guess they just got contact lists from some marketing firm, our vet would post mail for the cat to our address with the cat's name, so someone presumably thought this was a natural person and the credit card company saw an opportunity. I believe they banned the practice not long thereafter - this was in the early 90s in Canada, which presumably copied the model from the US.

In most cases that is true, but some courts in community property states will screw you over in a divorce. I have heard of women getting more in spousal support when they are heavily in debt, because of the the pussy pass. In a way, you kinda are stuck with their debt.

See, there's this one simple trick...

It's called an Injured Spouse Allocation.

He is injured by her debt that was acquired before their marriage. He is not obligated to repay her debt and as such, they are not able to touch his portion of tax return refund due to him (if there are any).

Also, as an addition, the ONLY way they can get anything from him is if he is a joint loan borrower or refinanced jointly. If his name isn't on the debt, he'll never have to pay a cent.

This is all true as long as it was debt before the marriage. (Debt after the marriage could be his too in 9 or 10 community property states, add that to the list of why marriage is a sucker bet for men.)

Here's the problem with that - yeah, his portion of the refund will be ok. But her credit will be absolutely fucked because if they file jointly, the household income is what is taken into account for repayment. So unless they're in poverty collectively, she would still have some sort of payment, whether income based or not. And if she goes delinquent or default, her credit is fucked, so unless he's buying everything (which remember, is still going to be considered half hers in the case of divorce), she won't be able to do so much as get a car without a 21% interest rate.

The other thing is that people don't usually see the garnishment coming and don't know about this allocation. And government moves at the speed of death unless actually killing somebody, so it's first getting the garnishment, then filing out the paperwork, thn waiting on approval which can sometimes be as long as 4 months, and THEN waiting on the return of the portion of the refund.

So yeah, you're right that it's not his responsibility except in the exceptions mentioned, but with a joint filing any action is likely to be reactive and it's going to be a bitch.

No, not necessarily. In a community property state assets that were held before the marriage are separate property. Like if he had a house before they married, the house is his separate property. And things like insurance settlements and inheritances are separate property as well.

In regards to Garnishment:

The ability of a creditor to garnish a spouse's bank account depends on the nature of the debt and the state you live in. In most states, an account that's held solely in your spouse's name can't be garnished if the debt is in your name only and was not used for anything that benefited her.

In regards to Student Loan tax refund garnishment if you file as an individual they cannot keep your spouse's tax refund. Even if you do file jointly they may only keep a portion if you file an injured spouse claim form (IRS form 8379).

There are only 9 community property states (Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin). And even in those states there are laws that may or may not protect the spouses pre marital assets.

Does not matter if he signed for it or not, since he is married to her, should the loan fall into arrears and the lender seek payment relief through the courts, his assets are as much accessible as hers, because they are married.

Here where I live in Lithuania loans is shared only after wedding, not before. Even if that loan is taken only on one person(after marriage) by default will be transferred to other half if something happens to person who took loan. Never heard that someone would take responsibility of other loans taken before wedding.

Two reasons. One, the loans are pushed on people too young to know any better. You wouldn't give a jobless 18 year old a $20k loan for anything else, because they have no idea what they are getting in to. All the actual adults around them push them into it, saying it is their ticket to upper middle class, they'll have a job good enough to handle it, etc. But there is no guarantee. Maybe when those adults were kids, but certainly not anymore.

Second, predatory interest rates make it so you could virtually be paying off the loan forever. If you can't get a good enough job, you will simply never be able to touch the principle without starving yourself to death. This locks an entire generation into a form of indentured servitude. Which, is their ultimate goal anyway.

College should be free, and the debt should be cancelled.

People too young to understand loan repayment shouldn’t be given loans. They should get an adult co-signer or should take a few years off, get a job, save for school while figuring out how loans work. Schools seldom guarantee high paying jobs to graduates. He made the money, like 2.5x, granted she worked peon jobs part time, still. After just about 5 years of marriage, and almost 4 years with the car he essentially bought and paid the loan payments, for months she was going on and on that after tax time they were going to pay it off. 3 weeks after it was paid, she moved out. After 4 months she chose divorce over counseling and trying to save the marriage.

Plenty more on that saga afterwards, but yeah... it happens.

Make sure you know what you get yourself into, for both sides. My wife is cool staying home with the kid’s and I am cool with working for our student loans even if they where all hers before we got married. She worked her ass off while I was in College after we got married. Marriage is not a bad thing if you are not stupid about it.

She knows that she will be taken care off if we divorce and that’s just fair since I could not do the job I do without her having my back.

Rarely does it split to that degree, I usually pay for nights out, sometimes she does, we never “split a bill” or determine one can’t go out because of finances. What we do is pool household costs together and she pays 33% and I pay 67%. Note that I said “equitable share”.

We keep our finances outside of household bills separate by choice, you don’t really need to “understand it”, but many couples do it. I cover a lot of the entertainment costs because I make more money, but we each maintain our own accounts and cover our own personal hobbies and expenses.

And legally speaking, in Most states, she has as much right to access whatever money you made together. She Doesn't actually need your consent to access it.

In the case that the article talked about, technically she could take it with zero recourse from her husband. Even if they sign a prenuptial agreement, the bank is definitely not giving that money back once it's paid, so he would have no recourse except to sue her personally, and the judge may even vacate that because they are married, and it is considered a marital asset.

Once you marry someone, anything you had before unless specified, and even with a prenuptial agreement, they are all considered marital combined assets to A lender seeking repayment. In the case of the student loan, if she goes into arrears on the student loan, the lender can absolutely go after her assets, which include her husband's assets because she is married to him. This guy is just selfish for not considering that his assets may be in danger from this.

It actually doesn't matter if it's joint accounts or not, legally speaking my wife can access my individual checking account, she need only prove that she is legally married to me. And goes in the other way, we don't actually need a joint account to be able to both access it, her assets are as much mine as my assets are as much hers. Same goes for dads, even if they were accrued prior to the marriage, the debt collectors and the courts don't care if it was a crude prior to the marriage, now marriage assets are combined, and your income is combined and considered for the repayment.

this is only true for a few "community property" states - Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin.

All other states are common law and you can't access any account without your name on it without power of attorney (or some similar/other legal power granted by a judge)

Yeah it’s not necessarily that government is the only one who can give loans but that government is the only institution that guarantees school loans for students who have minimal chances of success and will likely fail out. Private institutions would never invest in these students because it’s too risky.

The government funding incentivizes taking out loans, potentially failing out of school (or even succeeding/graduating and not finding a job), and not being able to pay them back. Private lenders will always have much much higher standards for borrowers, which is why they are not common.

In Canada, you cannot inherit debt, and it cannot be transferred to you. You would only become responsible for your spouse's debt if it were jointly held. Just because you are married does not make you responsible for paying it back unless you shared the account.

The property division rules apply to unmarried couples who have lived together in a marriage-like relationship for at least two years.

This means that, like married couples, they will generally share any property they acquire during the course of their relationship — but not property brought into the relationship.

I think it's a misconception that failed relationships = male (usually provider) pays up. Though the system does favor females and especially mother's. There have been cases that the female whom is top provider having to pay alimony but those are far and in-between.

The credit card would need to be co-signed by both parties and both parties agreed what it would be used for, specifically paying of spouse debt.

If the female wants to split and the male proves that every attempt was madeto save the relationship or tries to improve it (marriage counseling) , she can't just walk away with half of everything.

There's protection for situations like your scenario, here in Canada anyways

Both people in the relationship should spend an equal amount of time maintaining the house hold.

If she is watching the kids, cleaning the house, cooking, doing most of the chores, he should be helping pay her loans. If they don't have kids, pay a maid to clean, and usually eat out, he should kick her lazy ass to the curb. Money isn't the most valuable thing to have, time is. While each partners financial contribution can be completely one sided and be ok, but should be spending the same amount of time and effort to support the household.

That she is asking the question in the first place makes me think she is in the lazy entitled group.

Even though the loans are from before they are married, because they are married, all of their assets are considered combined marital assets, so if the student loan falls into arrears, the lender can absolutely go after their combined assets, his included. Even if they were to divorce, because the assets were combined for that time period, they could seek to go after him for the amount made during that period.

That’s not true. All of the assets are not considered combined. It depends when they were earned. Everything is not just considered community property at marriage. There’s a whole field of law covering what belongs to who. It’s not that simple.

Once you are married, The Lending institution does not give a fuck if it is yours or your husband's, assets are assets, they are as much legally hers as they are his, and he is as much responsible for that debt as her while they are married. If the loan falls into arrears, meaning it falls behind and they seek repayment relief through the courts, they will not limit themselves to Simply seeking her assets, they will go after Whoever has the money, and since he is married to her, his assets are as much as accessible as her assets.

No. Pre-marital assets and liabilities typically aren't considered part of the marriage contract.

Debt incurred within the scope of a marriage, however, is.

If she had the loans before marriage, they are her responsibility only (legally at least), but if she took out a credit card while married and drove up the debt he could be liable for it.

The "loophole" she's looking for is just that - take out a bunch of credit cards, pay off your student loans with them, and then stick the husband with the bill (either during the marriage or dump it on him as part of a divorce). He might be able to fight it given that it's a pretty clear attempt to roll-over debt, but good luck fighting that in court as a man...

So true, in Tennessee they had an article not long ago about a man that was making 120k a year and he was appealing a judgement for spousal support over $1200 a month for life. The ex wife made 72k a year at the time of the judgement. I believe it was overturned on appeal.

My ex not only racked up debt but did so fraudulently. This is one of those things that should have been worked out before marriage. Also, not enough info on why she isn't working. There is simply not enough information to figure out who the bad guy is here, although the implication is that it is the woman: How much, how long, kids, other debt, is he willing to assist in a mutually acceptable arrangement. The biggest question is why she won't /can't work.

I agree in that her attitude stance in the way she asked her question makes it seem like is a lazy bitch, I think I would also like to know why she’s been out of work. If she’s just being a lazy bottom-feeder because she married someone with a good job and now doesn’t need to, then go play in traffic. But she hasn’t been able to work because they have kids or something and she’s the primary caregiver for those children then I would swing more towards partnership in those debt payments. But again, her tone makes me think the former as well.

I certainly believe that once a couple gets married they collectively own both the "good" and the "bad" that they bring to the marriage. This is why it is a bad idea to marry someone with debt. So, morally speaking it is not "her" debt, but "their" debt. It became that when he said "I do."

That being said, this is likely a situation where she is a deadbeat that won't work and doesn't really contribute to the marriage. Thus, he is drawing a line on her debt to get her off of her lazy butt and start working like him. And that's just fine by me.

This is an issue older single people face. If you're young it might not be that big a deal, since you don't have much in the way of assets. But if you're older and enter into a romantic relationship with someone it can be pretty risky. You have some wealth, maybe you've accumulated a lot of assets over the years. Maybe you're a widow or widower. And now you meet someone. Fall in love. And it turns out they're a financial trainwreck. You just might marry yourself into a goddam nightmare.

Long after my dad died my mom started dating again. She met a guy. Wanted to get married. He seemed like a nice enough guy. But who the hell knows? I made him give me his pertinent information, name, date of birth, SS#, etc. Ran a background check on him. Even had a private detective check up on him.

Turns out he was fine. He had TWO nice pensions. Owned a home outright. Did NOT need or want my mom's money. Etc. But it was still money well spent on my part.

No. Creepy is when your 70+ year old mom gets scammed by some clown she met on some dating app. Cleaned out by some professional scammer. Fucked over and ripped off my someone.

And as it turned out, he was totally OK with it. Told me I'd done the right thing. Joked about it, even, saying "Well, he couldn't have been too good of a private detective, since he didn't find out about my sex change operation!"

In the end they did get married. He and my mom had some really happy years together. But I'm glad as hell I checked him out.

If I die before my wife, and I probably will, I'll be leaving her a shitpile of money. I don't want her to get lonely later in life, like my mom did, understandably want companionship, and get taken advantage of by one of the many, many thousands of people out there who prey on widows. So I've told my son that when I die, if my wife wants to get remarried, he's to do the same thing for me. And he will. And my wife is totally fine with it.

So, to recap, my mom didn't think it was creepy. The man she married didn't think it was creepy. My wife doesn't think it's creepy. My son doesn't think it's creepy. The only one so far who thinks it's creepy is some guy I don't even know. Screw that guy.

I am an at home husband. My wife and I were similarly educated, with similar work experience and similar paying jobs, but I stopped working early because our daughter and my father needed a lot of time. We have our own separate accounts from which we put equal amounts into a bill paying account for all the expenses of the family, and we continued this arrangement even after I stopped working. Wife kept working. Dad died, and the family as a whole had gotten used to me being around all the time dealing with childcare and household issues, so I didn't go back to work. Wife does not want me to go out of town or make plans that interfere with my household or childcare duties, so over time I'm becoming pretty resentful about this as she continues spending her time making money which is largely unshared, while I spend my time taking care of family issues which are shared and which I get paid $0 for. I think it's unfair of someone to bring a liability into a relationship, then complain somebody else didn't absorb it for them. Despite my unequal and possibly very unfair relationship w.r.t. time and income, I am repulsed by this attitude; it seems like she's trying to find some trap to use her spouse. She should get a job and pay her debt. However, if she is pressured into childcare and homemaking and primarily spends her time on those services to the family, then I agree that Hubs better pay up. The working spouse can use the child as hostage and that's a powerful weapon.

Taking care of children IS a job, but not mentioned her and it is kind of strange that commenters were jumping the shark to make an excuse for how the husband was wrong. When ONE parent stays home to take care of the children vs both of them paying child care, that is work. I guess I am not a Neanderthal and expect it only to be the wife's problem to figure out child care. IF they had kids and they made the mutual decision that she (or he) take time off work to take care of the kids, the working outside the home partner has the obligation to the other that stayed home....

I’m guessing there’s an “oooopsie baby” in the equation because marriage should be an all in situation - you should already have vetted the “she/he’s the one for me” question and go forward as a team with consolidated goals and outlooks to achieve your life bliss…. If there’s a question of debt and loans and one partner not being part of the equitable commitment to going forward as a team, then there should be no marriage in the first place. The obvious “get a job” answer gets complicated w/ kids in the mix - but equally she can get a job and transfer at least 50% of the cost of child care on the dad - so if there’s a will there’s a way.

I paid my wife’s student loans with my first big bonus after we were married. I could’ve bought a Ferrari or something stupid, instead I just clicked “pay” on the online form and she was free from that burden.

I love my wife.

She didn’t ask me to do it. She didn’t expect me to do it. But it was the right thing to do. That’s what being a man means.

She works in her field and makes solid money now, and the money she used to have to pay for her loans goes instead into a 529 for our children. She’s paying it forward. They won’t have student loans because of her.

Worst advice. It worked for you, doesn't mean the odds are great. Over 50% divorce rate in the US and majority of divorce proceedings initiated by women. I know atleast 2 men who helped their S/O to pay off debts and we're divorced later.

This marriage arrangement is strange to me. My wife and I both work full time and we split everything. I literally make a spreadsheet with all the outstanding bills on payday, take the sum and divide by two. Then we both pay that to clear the sheet and the rest is play/savings.
