Edit: your source says 25%, roughly of women have a mental disorder but classified it as "Any mental illness (AMI) is defined as a mental, behavioral, or emotional disorder. AMI can vary in impact, ranging from no impairment to mild, moderate, and even severe impairment.

Severe mental disorders are measured at 7% So around 18% of women seem to fall into no, mild or moderate impatient categories. Surely no impairment, and probably mild, can't be linked to being intoxicated.

I’ve never heard it as “any amount of alcohol.” That would be absurd—people can’t fuck after a glass of wine with dinner? No one is saying that. A person—male or female—can become so drunk that they don’t know what’s going on (so they can’t consent to it) or are unconscious. Then you cannot fuck that person. A person who, due to some other reason (concussion, severe hallucinations, being asleep) does not know what’s happening or is unconscious can’t consent either. Depression is fine. Glass of wine is fine. Come on, man.

No one is saying that women cannot consent after a glass of champagne.

As far as the “mental illness” - I guess you can look at it that way. Seems a bit odd though. Let’s even take it further, people under 25 can’t consent. They should not be having sex until their frontal lobe is fully formed.

My cousin has severe autism, he's more or less mentally retarded. Yes, it would be exploitative for a normal person to try to hit that.

My best friend had unmedicated bipolar. He was a lunatic during manic episodes. He'd pierce everything on his body, buy crazy shit, and wander the streets unable to remember how to get home. Yes, anyone tapping that would be a bad person if they can detect it is occurring.

Honestly, I'd be shocked if someone could even get with unmedicated depression, they aren't big on leaving the house or socializing. But yes, probably you shouldn't be tapping this.

With that said, notice how I said unmedicated. There's wonderful medications for 2/3 conditions.

But yes, there are some women who are too mentally disabled to consent to sex. Either because they can't communicate clearly and or because they are impaired and don't actually what sex is and what the risks are for it.

Its not a black and white thing. Plenty of disable people can consent to sex, but that doesn't mean there aren't disabled people who can't consent either.

Disabled and the elderly are some of the most common victims outside of children, simply for the fact they can't communicate non consent and can't tell others

Depression and BPD, among others, are not mental conditions that impact ability to give consent, nor are they developmental conditions that leave people in a childlike state (like autism), so I have no idea why they are being referenced here.

Also no one has ever said any amount of alcohol means you cannot consent either. Like… no one in the real world says that. If someone is stumbling around and cannot orient themselves, they’re fading in and out of consciousness, then that would be a situation in which they’ve been so impaired that it affects their ability to consent.

The mental gymnastics people go through on this subreddit is crazy.

I've never come across anyone who's said any amount of alcohol impairs consent. The issue is generally when someone is at least noticeably drunk (and the other person isn't) or plied with alcohol when the other person knows they wouldn't consent otherwise.

Likewise, there are certain mental conditions (although you're probably talking intellectual disabilities more than mental illnesses) where you probably can't consent unless the other person has a similar condition, but saying you can't consent if you have depression or anxiety (which make up the bulk of mental illness) is pretty stupid.

One thing many people don’t understand is that in the vast majority of title IX sexual assault cases, it’s not disputed that the sex was consensual, what’s disputed is whether the woman’s consent was valid. Drinking is the top reason cited in cases I know of but mental health issues and the woman simply not feeling empowered to say no are other reasons that have seen successfully used to invalidate consent.

So, to the OP’s point, drinking while the most popular reason to invalidate consent isn’t the only reason consent can be invalidated.

The logic of the entire position on being unable to consent or be responsible for your actions while intoxicated is fucking ridiculous. Well, first of all your premise is kind of shit.

The law states that a person (male or female) who is incapacitated (someone who is passed out, vomiting, unable to walk, or incoherent) by alcohol or drugs cannot legally consent to sex.

The law does not state a "women who's consumed any amount of alcohol" cannot legally consent to sex.

In terms of mental illness, there's a notable difference in cognitive ability between a mood disorder (like depression or anxiety) and a psychotic disorder (like schizophrenia). Of which both sexes experience identical lifetime rates.

I probably have a lower threshold for mixing drugs/alcohol and sex than most, and I still think it’s fine as long as neither party is intoxicated. That’s where I personally draw the line. If they are showing any signs of intoxication, I get their number or give them mine and don’t hook up at that time.
