My former sister-in-law is the same thing, but not in family law. Guided my ex through it and did a shitty job.

Your problem is going to be that she’ll get emotional about it all and will come at you with everything she’s got.

Just find yourself a reputable divorce attorney and let them do the work, tell them all the information you have, and let them get prepared to go to battle. When your ex finds out how your lawyer is, she’s going to investigate them without doubt. Make sure there’s no conflict of interest and make sure that your lawyer is actually involved! My friggin lawyer didn’t even show up for the divorce! Honestly, he sent some 23-year-old kid, it was pretty insulting. The one court date that led up to the divorce, My attorney didn’t show up at all! I had to sit there and defend myself.

I had a year long divorce with my ex pulling every trick in the book. Cps, endless accusations, ppos, cops, she dated a cop, legal fees, stop paying a mortgage. Etc. Thank God for the no nonsense, fact and evidence based judge that hammered all her lies in the end. So my point is "your judge is everything!!!"
Keep your mind fresh and don't dwell. The mental battle during the process is fucking tough! Hang in there. Gets much better

Just because she’s a lawyer doesn’t make her a family law expert, unless that is what she does. If it isn’t just get your own that is highly rated/reputable and you should be fine

If she's not a divorce lawyer, should be fine but you should get a lawyer from outside your county to represent you if you want to be on the safe side. Another problem is that she will get favorable billing from her lawyer as a professional courtesy, probably. So she can effectively throw more lawyer time at the case than you.

Lawyers are the worst clients and actually fuck their cases up by meddling much more often than achieving a better result. The only advantage (theoretically) is that she will be able to make better and faster decisions because she's versed in legal concepts. But most lawyer-clients will spend a bunch of time second guessing their lawyers - especially if she views her practice area as "above" the lowly divorce lawyer - which all lawyers do.

If you are certain divorce is the BEST course of action for you, your kids, and STBX, then pull the plug asap. What I’m afraid is if she sensed your thoughts of divorce, she could already be building bogus case against you!

Lies like violent behavior, drugs, alcohol, gambling, etc…and go for characteristics assassination.

Ha, I think that for the most part you’ll be fine. My ex-wife’s father and her brother were both (pretty badass actually) family law attorneys. But in another state. The thing is, there are pretty clear guidelines for child support, dividing marital property, etc. It’s actually pretty hard to get a judge to go way outside of the guidelines, but exceptions certainly exist. Hopefully you and your wife can keep things relatively amicable, but mine did try to go a little crazy with trying to get more than her fair share (going outside of the state guidelines for child support, alimony, etc). Fortunately the judge was reasonable and the divorce decree pretty much followed the guidelines in my case.

Talk to an attorney before she even gets a hint of divorce, if the cat is not already out of the bag. My ex talked to an attorney well ahead of time and then lied to me saying she wanted to reconcile (when she really didn’t) so that after a three month period of separation and “working on ourselves” when she filed for separation legally I had been out of the house for 3 months and she won primary custody of our kids. She also manipulated me very early on into sleeping with her (by feigning sorrow and apology) after I found out about an affair so that I was unable to file an at fault divorce on grounds of adultery. She had the absolute advantage of time to set up and spring a plan.

Is she a family law lawyer? Probably not. A lot of lawyers get crushed by their own hubris and arrogance. Plus courts don’t like feeling that one side is beating up on the other.

Don’t worry about it. Get an experienced family law lawyer. If there’s a disparity in income or you lack access to funds, a fund can be created for you. Don’t make any admissions. If there’s any doubt, have communications channeled through your lawyer.

I’m telling you this as a litigator myself who is going through a divorce. I had to hire my own lawyer because this isn’t my area.

Sounds like she probably makes the big bucks too. Deal with her how you’d deal with a pawn shop. Ask for unreasonably high alimony and negotiate from there.

P.s. I have no idea what the divorce process looks like and have only been in trouble with the law.

Seriously, though. Check out Martindale.com, your state bar website (to check for discipline and who is in your area), and talk to lawyers in the family law field that you know can be discrete. They generally know who the top firms or individuals are in the area or region. Key question is “who would you want representing you in a divorce”.

No doubt you are going to be at a disadvantage to some degree on rules of the court and such, but you negate that in getting a bad ass yourself. Is she in the family law field? If not, then you may not be at much of a disadvantage.

Easy. You should know her pretty well by now. Higher the attorney that you know that she likes and respects.

She’s not going to want to come off, looking like an asshole against her peers. She has to work with these people for the rest of her life. She will generally seek their approval, unless she’s a total jerk

Do not hire the attorney that she has lost to or is frequently battling in court with and complains about.
