Essentially in most places the state takes the best interest of the child before paternity, unless paternity is contested ASAP. I think the only precedent for stopping it or winning a suit like this 9 years after the fact ive seen is that the man has to prove or find proof that the wife knowingly knew the child was not hers, and that she lied to the state and the father, which is a high bar to clear.

This is actually in the UK, and the law here is that now he’s proven not to be the father he’s no longer responsible for child support. As for getting the money back that’s gonna be trickier but not impossible as there is precedent. The founder of a large price comparison site sued his ex-wife after finding out that all three of his kids were not actually his. His ex settled so that she wouldn’t have to name the actual father, but he got about £250k back.

As I recall, the cheating wife in that case all of a sudden had an interest in Jewish culture and giving the kids Jewish names. The couple was gentile but she was cheating with a Jewish co-worker, so his lawyers asserted she knew all along and perpetuated the fraud.

It may not be that high of a bar for very long. Imagine 9-years from now, and not having ANY text, Facebook, email, snap, Twitter, WhatsApp, etc messages between friends stating she knew...

I understand the intentions but it’s really flawed once you dig into it.

The mental health of the “dad” is not considered at all. They are expected to raise a kid that isn’t theirs and be reminded of a very hurtful event. Socially impacting their ability to move on with their lives.

This gives an incentive for the biological father to leave, and for the mother to lie (or not be fully truthful)

The biological father should be held accountable as well as the mother.

My kids would have a much better life if Bill Gates were their dad, but I don’t see how that’s his problem.

Basically the courts really don't care if you're the bio father or not, as long as the kid is taken care of they'll take the money from wherever is the most convenient, and wherever there's the most of it. Unfortunately that means the guy gets screwed over more often than not. It's basically "the mom can't pay and won't/can't tell us who the bio father is so you're going to until you can find someone better"

I understand the legal fathers frustration. However, would he just stop acting as a father figure to this boy, who is a victim of his mothers infidelity ? Or would he continue to co-parent ?

The father was probably in this boy’s life for 8 years or so. I imagine it must be difficult to raise a child and then distance yourself from them, knowing that they aren’t yours biologically. Looking at that child will always remind you of your ex wife’s lack of honesty and faithfulness. This is a shitty situation for all parties involved, especially the illegitimate child that’s trapped in the middle. Smh

No, under Sharia law all children born during (and a few months after) the marriage are considered legal children of both parents. DNA tests to disprove paternity aren't allowed in any muslim country.

Adultery (it doesn't specify sex) is supposed to be punished by stoning if it can be proven by four witnesses or a confession. But this very much depends on the country, in many muslim countries only the family law is still sharia (which is what we're talking about). Of the top off my head only in Saudi Arabia and Iran do they have actual Sharia (criminal) law in which you could be stoned for adultery.

Politicians have the power at the end of the day. People are allowed to lobby the people that make rules about them.

Don't blame lobbyists for politicians being corrupt. If they weren't taking money from lobbyists they would be doing other people favors instead.

Other favors that would be far more traceable than anonymous donations. In reality, I am willing to compromise with lobbying groups, but they (both politicians and lobbyists) should be obligated to be completely transparent with who has made the donations.

I also think ranked choice voting would alleviate some issues caused by special interest groups. At its core, lobbying groups want to donate to whoever is the least restrictive on one specific topic, while voters ultimately are often willing to compromise on a couple issues if the candidate overall more represents their views. There are very few instances where people should be single-issue voters, and the current system forces everyone into those systems.

You're sooooo wrong. There have been plenty of cases where if you appear as a father in the eyes of the state then you still owe child support. These cases often result in money that has already been paid not being recoverable by the "father".

Also they state can sue men even if they are not biologically related for social welfare benefits received on the child's behalf by the mother. Men's rights groups have been fighting this shit for ages.

I’m well aware of the various legal issues surrounding parentage and the cases your referring to. But your broad statement saying biological relationship plays no part is simply ignorant. All 50 states have parentage statutes that deal with establishment and disestablishment of the parent-child relationship. Biological relationship plays a significant role in those statutes. Denying a relationship with a child is a common method many mothers use against the father. Its a means of coercion and control over him and his resources and that leverage is used to the benefit of her even in ways that have nothing to with the kid. Hard to prove too if primary custody has been granted.

It isn't right of one parent to deny a relationship between a child and that parent. Not knowing who the father is shouldn't be tolerated either, you better find that dude. I'm a supported of mandatory paternity testing so everyone knows what the fuck is up.

It’s case dependent. Did the biological father know about the child? What if he didn’t but the adoptive father has spent a decade raising “his” child finds out it’s not his? Should the man who gave life or gave a home be the father? It’s a very slippery slope and someone won’t be happy at the end of it and it’s not even their fault. It’s the mothers.

The only way everyone walks away with fair treatment and no feel bad moments is to just paternity test at birth. It becomes crystal clear and cut and dry how things should be and there’s no meeey emotional moments where a court has to proverbially decide who gets hung out to dry.

I'm sure there are cases where they know, like when it's obvious by looking at the baby or where they've overheard the mother say something, or the mother has told them directly.
That said, there's no way they would always (or even most of the time) know for sure. That would require a blood/DNA sample from the husband and for a test to have been run. It's not (at least in the US) common for the husband to give blood or DNA sample to the hospital while wife is pregnant or delivering, unless it's specifically for the purpose of having a paternity test done which he knows about and has consented to.

Ive heard of a man getting restitution payments from a colombian woman who falsely claimed the child was his for 6 years, and his lawyer fought tooth and nail in Boston. It’s an interesting civil case. I think he should win. Dude assumed the kid was his. He spent money on the kid = actually gave money away to another household. There is an argument for due reimbursement if he can prove that his wife acted in bad faith.

Now, it’s up to the court to make the call what constitutes bad faith. We can all assume that if she KNEW the kid wasn’t his, that’s bad faith, but it is almost impossible to prove, unless she did a DNA test and then not told him.

The interesting part is will the court judge that having an affair shortly before finding out you’re pregnant and then NOT doing a DNA test / not telling about an affair is acting in bad faith?

Of course I knew that going into the relationship and there was no deceit or betrayal. I completely understand the hurt and backlash the man is giving to the woman because she not only tricked him into fathering a child but into most likely changing his entire life around to become a father for a child he isn't even the father of! That's your take on it. I would ask the man how he feels instead of claiming I know how he feels. I would feel a lot of pain about the whole situation and would want to take my exit. The bond wouldn't be severed because the kid doesn't have my DNA, the bond would be severed because I need to get out of the mother's life and for the sake of my mental health need to move on. I'm not going to be any good in the kid's life after my own life has been shattered and I have an overwhelming hatred for his mother.

It wasn't the fathers call to damage the relationship with the kid. The woman did that when she chose to deceive the father and the child. It was her choices that created this situation. Yet somehow its the father who had no choice that is somehow held responsible.

As a someone who learned their mother was a lying whore at 8, I certainly wouldn't hold the "fathers" actions against him. Hell, i would be rooting for him. This idea that the kid will suffer from knowing the truth is a bit overblown.

Imagine you have the love of your life. Imagine their brilliant smile, thoughtful responses, perfect everything. You absolutely love her. She is your world. You get a paternity test done. As they are talking you look over at your child, happy as can be, and you feel silly. Of course it’s your child. The test results will be in tomorrow. So you go home, buy your kid some McDonald’s, and head to bed. You sleep while kicking yourself for being so paranoid. You wife loves you, she wouldn’t... right?

The next day arrives, you wake up looking directly at your wife, she is flawless. Her skin glows. You decide to get up and check your phone. The doctors office called. They left a message: “Hey Mr.James come down to the doctors office to discuss the test results?” Your heart sank, but there is still no way. Maybe the kid has some generic disease they found or something? Who knows. You hop in your car and drive down. When you walk in they pull you aside. “So,’I think you should see this” they hand you a sheet showing a complete mismatch. The kid is NOT yours, not a chance. But how? You have been with your wife for 10 years, happily too. Why.. how... it doesn’t matter you need to go to work. You take the papers and thank the doc. During your shift you are in tears, hardly able to work at all. Everything you do for the family... doesn’t matter. Your shift ends and you go home.

When you go home you confront your wife. She denied all of it. How can she deny it? This is scientific evidence, PROOF that the kid isn’t yours. You show her the papers again. She isn’t having it, she runs to her bedroom and locks the door. You know one of two things is going to happen.

1:She will devorce you and make you pay child support for the next 18 years in a child you are not even fucking related to.

2:She will try to sweep this under the rug, and I can never trust her again. The family will forever be in ruin.

If you don’t want to be fucked, you need to take action now. And action, you will take.

Why is it that the father doesn’t matter here. I get it, the kid deserves financial stability, however the wife FUCKED another dude while married. The wife deserves prison for fraud. Why do we forget about fathers? Why are they the only ones who don’t matter? I recommend anybody who wants to be a father, reconsider. Better yourself, and the world you live in. Make the world a better place instead.

No one should forget about the father. Far be it for me to suggest that. And historically and culturally they have often been sidelined in these matter. My point was simply that the child, as innocent as the "father" must be the number one priority. That is not to say there arent other priorities. Of course there are. The "father" is also a priority. These cases are always very difficult. A child needs its mother too, however flawed they may be. Justice in the fathers eyes may end up punishing the innocent child. As another redditor commented, everyone loses. I dont have any magic solution and every case is unique. I do believe people should be accountable for their actions but justice for all is an unrealistic expectation. What is justice in this context?

The child is not being punished, the mother is being punished. When one person is punished their family also suffers, that's something people with families should consider before they do disgusting things that will lead to punishment.

What is justice in this context?

Mother is punished for deception. Tricked 'father' is compensated for actual and punitive damages. Biological father pays child support. Child receives counselling for the horrible thing his mother has done to him.
