yet another attempt to broaden the definition of sexual assault beyond common sense. of course people who are drunk can consent to have sex. you can't consent when you're incapacitated, which is the law now, and how it should remain.

and notice they don't care how drunk the accused man is. what if he's drunker than the girl? vice-versa? what if she got him drunk? doesn't matter, men are all perpetrators, women all victims.

I would have assumed "incapacitated" in the context of alcohol would mean you're outright passed out or at the very least going in and out of consciousness. At that point if somebody fucks you, yeah, it's probably assault because you were likely to be totally unable to even register the world around you.

Being a bit drunk, or even very drunk but conscious and interacting with the world (with lowered inhibitions etc etc) hardly constitutes "incapacitated". If you're actually able to participate in sex or say "Yes", you are not incapacitated in any meaningful way and choosing to become intoxicated should not then mean all your decisions from that point are disregarded. It's ridiculous.

yes, incapacitated means passed out, or so messed up you can't walk and you don't know what's going on. drunk is just drunk. some colleges use drunk rather than incapacitated to say a woman can't consent, of course it's discriminatory because the man is still held responsible for his behavior when he has drunken sex (i.e., he raped her, not vice versa). any attempt to broaden the definition of sexual assault, feminists will take it.

This proposed legislation is just further proof that women are too dumb to govern themselves, let alone society. Women require all kinds of legal protection just to go through their daily lives. How can an adult infant be given the same rights as an adult male? It's utterly ridiculous. The fact that women are ok with this only further proves the point that women are incapable of leadership.

I'm not sure about the law in all states. But at least here in NY that is the case. Intoxicated does not mean incapacitated. Someone who is intoxicated, via alcohol or drugs, that they knowingly and willingly consumed, is still capable of giving consent. You are only incapable of giving consent when incapacitated (unconscious) or you were unknowingly or unwillingly drugged by someone else.

This makes complete sense, we don't need any other laws than this.

Maybe she'd love a good drive and maybe she'll kill a biker sitting at a stoplight. Not even the PussyPass will save her from that, she'll be charged with involuntary manslaughter or straight up murder for driving intoxicated.

The point is, if she's drunk and she gets in a car she's to be held responsible. What if she and a man are drunk, and she wants to get in his car and drive, should he be held responsible for murder when she hits someone? Or should she be held responsible for murder + wrecking his car and have to pay for that too?

When are women held responsible? Why should it be any different in rape cases?

Locally a woman stole a car while drunk, drove into oncoming traffic killing a man; sentence suspended because (and the judge explicitly said so) she cried in court, demonstrating she was remorseful.

I'm sure just about every lawmaker would like a clear answer to that question as well.

If you ask me, absolutely not, and for the same reasons we hold people responsible for their actions when they get behind the wheel of a car while drunk. She is quite literally asking for it.

That being said, I would advise anyone who she asks not to. She may or may not know what she is doing. As an outsider there is no way to tell. While it's my opinion that giving her what she wants is not a crime, it would be like giving the keys to your drunk buddy because he begged for them. Your actions weren't illegal, but they definitely weren't the right thing to do.

The law can only go so far to protect people from themselves while still giving them agency.

Depends on the guy and the situation. Single college freshman who has had his nose in a book for weeks? Give the guy some credit, that probably wasn't easy. Married guy or guy with plenty of other opportunities for consensual sex on a regular basis? Just being decent. It obviously takes restraint for most guys, as most of us can be aroused just by the sight of an attractive woman in a seductive pose, but most guys also know that women face more risk of marginally greater consequences from unwanted sex (pregnancy, STIs, etc.), but that's rarely what comes to mind when an attractive woman is trying her drunken best to physically arouse you.

haha nope, women should also turn down sex with ultra intoxicated people (assuming they are making this decision only because they are intoxicated) on principle. I did have a friend who had gone about 10 shots and a few beers and some weed and a (100%) sober chick did fuck him. I think she was technically in the wrong (he said later he only regrets that it took him getting drunk to have that happen with her) since he was impaired and she took advantage of that situation. Rape in these cases though would have to fit some specific parameters

No I think you should decline because having empathy for other people makes the world a better place. If you could answer for yourself a) is she so drunk she would fuck anyone? and b) will she regret this later? and you answered yes to both maybe it isn't rape, but you are putting the needs of yourself above the feelings of others. You can say "hey maybe you should sober up a bit" or give her time to make sure she's actually cool with it. If she regrets it the next morning it probably should be technically her fault, but you weren't helping in any way

I didn't bother addressing your question when you asked it in such a ridiculous way. You're conditions were completely irreverent.

However, I think people can consent while being intoxicated.

However, if someone is incapacitated, they don't have the mental facilities to give real consent.

If someone is trying to incapacitate someone to get "consent" from someone who would not do so normally (An even when a little drunk), then yes, I don't have a problem with that being criminal.

Analogously, If I was playing poker, and I deliberately got someone high or drunk in order to play badly or make bets that they wouldn't make, I'd consider that theft.

However, it shouldn't matter who got who drunk. The same rules should apply.

I've seen an incapacitated woman come on to a man, and she clearly was so out of it that she didn't know who he was. It was obvious because it was her brother.

Would that consent count?

The big problem is that ignoring someone's level of intoxication in determining whether they can give consent is that it makes alcohol a weapon to commit rape and get away with it.

And let's not pretend that doesn't happen.

I know it feels like it's the same thing, but it's really not.

Intoxication is not a valid legal defense for a number of reasons - not least because it would be trivial to commit a crime in cold blood and get drunk afterwards as insurance.

However, in this case, it's not the perpetrator who uses intoxication as defense, it's the 'victim' who is intoxicated. The victim did not commit a crime while intoxicated, it's not a defense, so the comparison is invalid. This is not 'getting away' with something - it's getting exploited while intoxicated.

Obviously, cases involving sex are different than, say, defraudation or physical assault, since it's not uncommon for people to engage in mutually consensual sex after consuming alcohol. That, plus the principle of 'innocent until proven guilty' makes laws like these stupid, especially since they're also likely to be sexist in practice (even if they try to make them gender neutral on paper) which in turn would make them easy tools for false accusations.

Still, the comparison to drunk driving isn't a good one.

Many people intentionally use intoxication to lower their own inhibitions with the specific intent of making it easier to have sex. Even people who have no difficulty getting willing partners do this.

And many others simply happen to enjoy both intoxication and sex, and so sometimes do both at once. Criminalising normal behaviour never works out well.

I agree there are differences but in both cases the central issue is the ability to form the intention to engage in some behaviour. If drunkiness can prevent intent formation where sex is concerned it might well prevent intent formation where a criminal act is concerned. For most crimes it is necessary to prove intent.

I consider myself a women's rights advocate as well as a men's rights advocate. As such, I'm very much for the rights of sex workers - one of the few legit women's rights issues that I am aware of. Ironically, quite a lot of anti sex work lobbying is being done by... feminists...

I think it's ludicrous AND appaling that the French Women's Rights Minister is allowed to curtail the rights of women to be sex workers if they so choose - and still keep her job.

My problem with those laws is similar to false abuse allegations. If there is a $1200 fine for paying for sex, then there is extra risk of seeking police assistance for being ripped off or victim of violence.

legalizing (and regulating it if politicians hate it) prostitution has the same benefits as legalizing drugs: removing violence surrounding it, and not ruining people's lives through prison.

And even if she doesn't press charges the matter will come up in divorce negotiations. For example, the husband will be told that if he contests custody rape allegations will be made in court. This is a cost free win for the wife as most men realize they will always be guilty in the court of public opinion and so give in without a fight.

In Canada at least divorce lawyers are legally obligated to tell female clients that even false allegations can work to win concessions for them without even getting to court.

If you want to make an analogy then it should be that women can be accused of rape if a man is drunk.

But bottom line this law is too silly for words and practically doesn't make any sense. Let's look at this from a practical perspective. And let's take at face value that the proposed law doesn't use driving alcohol levels but really levels where no man/woman could still make any sane decisions.

1) the woman is too drunk to consent and has sex with a guy. In most cases that will mean she is too drunk to go to the police and will sleep it off. By that time her alcohol level will be below a thresh hold of consent.

2) The woman is only slightly drunk and still capable of going to the police. In those cases I would assume that the blood alcohol level would be below the thresh hold and there would be no rape case.

First off I didn't call your statement silly I called the proposed law silly.

The statement is that women can't give consent. This statement in essence always defines the males as initiators of sex while drunk. From that context I can see where you are coming from. *Edit I guess what gets me is the "accidental rape" wording since this precludes men are guilty of something and I think you mean that if a man starts a sexual encounter he can't be held responsible for it either (meaning it wouldn't be rape).

But I think we can both agree on that this proposed law IS silly. It would indicate that ass soon as a woman is drunk she doesn't have any agency anymore and can't be held responsible for anything. It would relegate the men as perpetrators regardless of who initiated any encounter because as previously mentioned women have no agency so by default men are the only ones with agency.

Many countries have anonymity which we do not have in the UK. If am accusation is made a mans name is plastered all over the local and usually national press.

After this even if the case is not taken to court he is listed on a register of potential offenders and the police will warn future female partners that an allegation was made against him. Schools will not employ him even though he has not been found guilty of a crime.

Afterwards the assaulted male files a complaint with the police; the rapist claims that the inebriated man consented. The court is unable to prove otherwise and the rapist gets away with it. Why should the courts assume that women can't consent to sex when drunk, and men can? Wouldn't it make more sense to assume that neither gender can consent to sex when drunk?

The details are more complicated and do not say that someone can not consent if they are drunk, but rather that being under the influence of either drugs or alcohol is something to take into consideration as to whether the victim had the capacity to consent at the time of the act. The reality of the review is a far cry from the substance of the Daily Mail article.

The relevant paragraph from the report seems to be

'If, through drink (or for any other reason) the complainant has temporarily lost her capacity to choose whether to have intercourse on the relevant occasion, she is not consenting, and subject to questions about the defendant’s state of mind, if intercourse takes place, this would be rape. However, where the complainant has voluntarily consumed even substantial quantities of alcohol, but nevertheless remains capable of choosing whether or not to have intercourse, and in drink agrees to do so, this would not be rape. We should perhaps underline that, as a matter of practical reality, capacity to consent may well evaporate well before a complainant becomes unconscious. Whether this is so or not, however, is fact specific, or more accurately, depends on the actual state of mind of the individuals involved on the particular occasion'

So I'm not completely sure how the daily mail came to its conclusion. I think the report says that the discussion of alcohol should be cleared up in law. And that just because one of the parties has drunk a lot of alcohol does not mean that cannot consent.

Courts should be allowed to decide that somebody was too drunk to provide consent. But it shouldn't be an assumption. Demonstrate it, damnit. That's the whole point of the court.

Edit: /u/away654321 cites the actual report, and it reads like they would still have to demonstrate that the intoxication was at a level that removed the ability to consent. So it looks like they would actually have to demonstrate it.
