I tried that after my wife said she wanted a divorce and we could work things out and things got worse. Had to lawyer up. I do know of two friends who got it done and just used a mediator. So its possible with the right couple

Amicable split is a myth when money is on the line. Hire a lawyer, understand what you're entitled to, then decide how you want to do it.

I was gaslit about AP. Regardless don't have her back or over for the night or period, quietly change locks, I got to the point of threatening to seek exckusive use from judge which she backed down from re-invasion threats after being gone years and paying nothing. If her name is on deed she can get a locksmith, I had a note posted saying I was exclusive resident for over a year and do not grant X access and would involve participant locksmith in forthcoming legal action.

I have a mediator lined up, hoping to keep it that way. I also have a lawyer paid for to hopefully just check the paperwork, or if needed, take this all to court.

As they say, hope for the best, plan for the worst.

You are going to have to qualify for the mortgage if you want the house in your name only assuming both of you are on the loan. If your name was the only one on the loan you could do a quit claim deed. It is cheaper to do it on your own . However , I’d hire an attorney to atleast draft up the marital settlement agreement and then both of you review , sign , notarized and file in court. This way no mistakes are made

Amicable is great until paperwork gets skipped, I’d stay cooperative but still have a lawyer review everything before you sign, especially with the house and car tied to both your names.

Mediator is actually a VERY good idea. That will ultimately cost you much less and preserve what little relationship is left - over a lawyer - as they tend to get adversarial and expensive quickly. A good mediator knows when to escalate up to a lawyer and will tell you both should that be nessesary. Mediators can help you agree on child support, alimony, and property division, and help you write up and file the agreements and paperwork yourselves (Pro Se Divorce.)

However, if there are kids, child support or alimony, or significant property to divide, and you DON'T agree on obligations and division, then its time to lawyer up.

To start: understand that your wife does NOT have the power and control that you have convinced yourself she does. She is not running the show here and you need to lose the husband mindset. YOu're thinking like you're still married and team. You are not and she is now your legal opponent.

GET A LAWYER. She doesnt have to know. YOu need someone who knows how all this works and you need to get educated. You can get legal advice and use that without telling her you have a lawyer. And WHEN you need one (and you will) you'll have one at the ready and not starting from scratch.

Amicable is both parties agreeing on almost everything with some give and take. Thing is if someone doesn't want to be divorced (or didnt see it coming) right off the bat it is already NOT amicable.

And, of course, once MONEY is involved.... well then its never amicable.

I need to make sure the car gets refinanced in her name only or sold, and that the house she said I can keep is adjusted so it's just my name on the mortgage.

YOU need to do nothing when it comes to action SHE needs to take. Flip side: What 'she said' means F-ALL unless it is in a signed contract.

With the house: HIRE YOUR OWN APPRAISER. They work for you. Once it comes to it you'll find your wife got it appraised and the house will be worth 150% of what you thought so she gets a huge buyout."

Taking over the home: Look into MORTGAGE ASSUMPTION - longer process but you keep your rate.

I was with you on the mediation thing right up until you said you had kids and her behaviors with the affair partner around them. Try for mediation but get that lawyer, if only to put in the strictest stipulation as possible when it comes to the children’s welfare and to be exceptionally clear on who the primary custodian is and the custody schedule.

There’s tons of example of legal language and you can save yourself money by finding it and drafting it up. Every court district in the US has the forms available and they are pretty standardized. So you can pre-fill all of that stuff and save money along with all the various ideas that you want for provisions relating to custody and decision-making around the children. Don’t be afraid to throw in specifics like no overnight non-family guests and be especially strong about right of first refusal belonging only to the biological parents. Good luck with this.

Try to get it done as soon as possible if you can. Most likely someone is going to get in her ear and tell her that she needs to be sure she’s getting her fair share.

We had mediation ready to go. Oh, but wait, “I talked to an attorney and she said we should probably do collaborative.”

Then that attorney really encouraged her to do a full business valuation “just to be sure.”

Easily ended up cost an extra $40,000. And I’m pretty sure I got off cheap.

News flash...she was with dude prior to asking for the separation. That aside, if you can come to an agreement amicably it will be binding once signed off by the judge, but plan to protect yourself. These are all business decisions now and when your idea and her idea of what is fair don't line up amicable fades very quickly.

Get a lawyer that can advise you on what’s in your best interest. Just don’t let them bully you into any specific course of action.

Whether you use the online forms and both come to a settlement agreement on your own, or use a mediator, you should have your own lawyer to advise you through the process.

The notion of “let’s do it amicably and stay friends”, even if she does mean it right, goes out the window pretty soon once you start counting dollars and cents.

Ultimately we agreed in all this stuff ourselves. And then jointly hired one lawyer to file all the paperwork to make sure that the house and other things were appropriately dealt with --- that legal paperwork matched our expectations.

It avoided stress, aggravation, and has made co-parenting more viable. Peace is what's best for my kids.

Behind the scenes, I had done other pre-planning and was ready if things went ruthless. I had determined my BATNA.

My ex said the same thing, but when it came to filing for divorce, she literally went for everything. This is a tactic her lawyer used. Ask for everything and work backwards from there. Probably to see how hard I’d push back or hoping I’d fold.

Listen the best path is mediation but with your own lawyer advising and reviewing. You can have your own attorney even if you do mediation. You pay by the hour for advice to help close gaps. Don’t work with a lawyer that only will take you for a huge divorce trial

Your story reads a lot like mine, except I'm further in and almost fell for the amicable trap. After multiple hours long discussions about how we would do everything and how amicable it would be, she wound up surprise serving me. Then tried to still convince me we could do it amicably, just using her lawyer.

Maybe your ex can actually do it through a mediator, it's probably worth the shot. Just make sure no matter what, you are either using a neutral mediator or you have your own lawyer.

Hear me out.

Depending on your assets, house, income, savings, retirement etc, if you have a lot of assets two things will happen I guarantee you.

1) Lawyers will review the couples assets and depending on how much is there, this will determine the legal battle. Lawyers will work up a theatrical back n forth show to drive costs a.k.a billing. If you’re the bread winner, then the legal fees will fall on you. Much more than that, but I am certain of it

2) It may be to your benefit to go the non-lawyer route while her mind is there. Shes in the “hoe phase” right now. I’m sorry brother, but you said she’s already sleeping around. When I was going through it, I dated so many women in the hoe phase. It was the easiest you know what to get

Figure out your finances, but seriously consider doing this amicably with her. If you have no assets and want to get a lawyer than sure, but you’ll be throwing money away.

Once you get her to sign the MSA, and it’s 30 days or older, it’s for life. She cannot re-nig on it.

Lawyers will take you for a ride depending on your income. The more you make, the more billing and cost assignment to you.

I did this. I just had a lawyer look over the paperwork. They were able to tell me what my total potential liability could be and what a good vs. a bad day in court could look like for me. Ultimately, my ex wife gave me a reasonable deal. I was ready to go full nuclear and fight, but that would have ended so badly for me.

“It’s a trap”. Get a lawyer for your protection. Best advice is to be as “amicable” as possible. Get things agreed on and in writing.

My ex started amicably until she knew that I knew her cheating went back before our separation. Her tone changed within seconds. She fought me every step of the way after that.

Women want to be friendly as long as it’s not exposing that they’re sleeping with someone else at the end. They want to be friendly and control their own narrative about being the victim. As soon as anything jeopardizes that, the switch is flipped.

My ex went from “we just decided it was best for both of us” to “he’s abusing me and I’m afraid to be around him”.

They will do and say anything that they feel keeps them at an advantage. Be ready for that moment. There will come a time where you no longer recognize the person you are divorcing.

Mine told me she wanted to do this, then she hired a lawyer, then she got PISSED when I hired a lawyer. Just hire one, pro se agreements can get messed up.
