I'm unfortunately living proof of that fact. Gotta love California. When I went back to get my stuff the cop I made sure I had with me to witness everything even said she couldn't see anything wrong with her, but when I got arrested she was "covered in bruises" according to the arresting officers.

Same... after my ex belted me around the place with a heap of hard/sharp objects and left me severely injured, she ran straight into the arms of the white knight next door (who heard her yelling so assumed she had to be the victim).

Trying not to bore you with too many details, after reviewing her statement (and seeing my injuries when they forced me to take my clothes off so that I could be put into prison clothes) the cops knew something didn't add up. However, this didn't convince them to reverse the charge and slap her behind bars. No... they decided to put me through 8 months of hell (where I couldn't work...etc) by going ahead with an assault charge ('yeah... you must have yelled at her, that's an assault').

Why you would try to nab a guy on a technicality like that (when he'a covered in blood/bruises and she's unharmed) is beyond me. I was found not guilty, but fuck me... worst time in my life, and there's no compensation for people who have been falsely charged. My paychologist bills, legal costs and 8 months worth of pay that I lost would be nice...

I have a friend who had an argument with his fiancee. He ended up locking himself in his car because he was angry and didn't want to hurt her. She called the cops because she got worried and he spent a day and half in jail because when the cops come out for a domestic, they are taking someone back.

Yeah I get why they do it (covering their bums in case they let a guy go and he does something). However, i think the approach needs to change because criminal charges are REALLY serious, and will do irreparable damage to a relationship. If nobody has been hurt and there's either relationship stress or some kind of mental health issue identified, then I think more of a supportive, community-based approach is needed.

My ex (same one) called the cops on me regularly as 'revenge' because she felt betrayed by my actions. After she'd smashed her plate at Christmas dinner (parent's beach house... all the family around) and then ripped down one of the curtains before locking herself in her room, we drove home (at her request - rudely snubbing our extended family during what would tragically be the last Christmas ever with my father and grandmother). She refused to talk to me, was shaking the whole time and then on the freeway pulled a knife on me (a box cutter that was in the glove box because we'd recently moved houses). She stabbed me in the leg multiple times while we were driving along (baby daughter was in the back) so I stopped and said 'GET OUT!!!!' She did a runner (middle of nowhere, featureless Australian country freeway surrounded by dense bush) and claimed she was gonna suicide, so I called the cops in a panic and said 'FIND HER BEFORE SHE KILLS HERSELF!!' I didn't even report that she'd attacked me during a deadly weapon, but she gave me no good will for this. The cops weren't interested in taking her to hospital or referring us to community services, they were just one-eyed about wanting to arrest somebody. I eventually told the cops to get fucked because I didn't want anybody to get a criminal charge, I just wanted to protect my family and have them back to normal.

From then onwards, she would manipulate me by threatening to call the cops with a false claim (and doing so regularly) if I didn't do exactly what she wanted. This was no way to live life and IMO having the cops swooping over us, wanting to arrest me for SOMETHING completely destroyed any trust that existed within that relationship. IMO trust is a really sacred part of a marriage, and the cops should understand this!!!!

Hey bagofqueef we got downvoted, I forgot which subforum I was posting in lol.

It's hard to understand this safe place, I try not to comment here, just come for some of the articles and try to avoid reading comments. Lots of good posters here but the balance is leaning towards safe place insults lately.

I'm no lawyer, but I feel like your lawyer could've at least tried to prove that the cops thought you were innocent on the scene, thus giving you an "innocent" verdict as opposed to "not guilty", where you could've been repayed for your losses. You got screwed. I'm so sorry dude.

There's no such thing as an innocent verdict. By getting the not guilty verdict you retain your presumption of innocence. You don't lose the presumption of innocence until the guilty verdict is handed down, and therefore you can't be given an innocent verdict because that's already the presumption.

You can sue if you think you were charged in bad faith, as your link states, but that's a whole different case that isn't dealt with during the criminal proceedings.

Not necessarily. Sometimes a verdict (or ruling by a judge on appeal) can be a finding of "actual innocence". Usually this is with DNA evidence, or somehow proving that the crime in question never even occurred (suppose video evidence was discovered that showed the crime did not take place).

I'm beginning to think the idea is to stop men reporting violence by women. Nobody is going to prosecute the woman even if she is violent but the man doesn't go to jail if he doesn't call the police. Feminist's actions over the last decades haven't not been about preventing domestic abuse at all, they want to enable violence by women. If no man ever reports a woman they can claim that 100% of domestic abuse is committed by men.

FWIW also if a couple is verbally arguing in some states - loud enough for the neighbors to hear and call the cops - that one of the couple must now go to jail for domestic abuse (treated as a felony in some states) and it's more often than not the guy. So you can get physically assaulted and not fight back and go to jail or you can be screamed at and go to jail. Equality in America.

It's true, last year it happened to me. Me and wife arguing neighbors called the cops, and I was arrested and sent to jail. The cop said to me, "sorry but one of you has to go. It's the law" and his reasoning was, if he took her that there would be Noone there to care for the child come Monday when I had to go to work.

This is what happened to me. My ex was abusive, when the cops showed up, they arrested me despite the fact that I was the one with scratches on my body that I did not know of. They had just been called out because the neighbors heard an argument. Arrested me and didn't even think about arresting her. Once we got to the station, they noticed the marks in better light, took photos but because I was already at the station, they had to charge me. Charges were dropped as the ADA decided that it was obvious I wasn't the aggressor.

Predominant Aggressor laws are generally mandate that a police officer makes an arrest if they believe that domestic abuse would continue. They also allow the officer to judge which party seems more fearful or controlling, which party is making more threats, which party is capable of doing greater harm to the other party (including height, weight, etc), and which party has more defencive wounds or more offencive wounds. See Alabama's law or Wisconsin's law on the topic.

These things mean that any domestic dispute call is likely to end up in an arrest.

Someone had to go to jail, becuase the odds of the anonymous caller having invented it isn't worth the odds that it's real, and someone's getting, or about to be, assaulted. Putting the innocent person in jail for protection for the night is better than letting them protect their spouse/partner and get murdered etc.

If charged and convicted, then that's a felony, but being in custody doesn't mean convicted nor charged.

At least that's what a judge or innocent voter might think when obliviously supporting the law/bill.

Mass here, pops got into argument with mom, sister was scared called police.. cops show up.. arrest my dad.. they said.. they HAVE to take him. i asked them to repeat it and they said they HAVE to take him. I'm pretty sure they need some amount of evidence in order to charge someone with a crime. I'm Canadian but I know police can detain you for 24 hours without charge in this country so technically/legally I see that it's possible but it sounds like a distortion of the spirit of the law, if nothing else, to me.

I'm also worried about risk of abuse. My neighbour stole my paper? Guess where I hear the yelling from or try to prove I didn't.

Yeah, but officers in states with "Predominant Aggressor" laws only need their assessment of the situation as evidence to arrest for Domestic Disturbance calls that turn into alleged mutual domestic abuse/violence calls. That means they take statements form all parties, assess injuries (defencive vs offencive, and severity), potential to cause future harm (including weight and height), reletive expression of fear or control, and any threats made. I assume most of the time, the potential to do harm thing, coupled with traces of sexism in interpreting the injuries and emotions of the parties puts men at a disadvantage.

In Canada police have to determine who the primary aggressor is in the domestic situation and whether charges are warranted before someone is arrested.

That being said it's more often than not the male that gets arrested.

Kids get to know a lawyer and pay a retainer specifically for calling them when shit goes down. If shit goes down it will change your life.

I have a friend who is a victim of this. His ex is a method addict and my friend has been clean since his kid was conceived (so over 4 years now). The kid came home with bruises one night. He took the kid to the hospital, based on a friends advice, and if it wasn't for a nurse some how trusting him and siding with him he would have gone to jail that night for child abuse.

Statistically, women are the aggressor in nonreciprocal domestic violence in more than twice as many cases as men.

Yet, when a man calls to report abuse, he is twice as likely to be arrested as his abuser is. But that's only in the cases where the cops do anything at all. In more than half of those cases, the cops do nothing and just leave, because the laws and policies are about 3 decades behind the actual trends.

Women are absolute shit at conflict you can see them start to prep for it a mile away. If a woman starts to act crazy you read her the riot act, you ditch her or you get fucked. They have episodes of insanity, all of them. I have lived with 4 for long periods. They all did the same exact shit eventually. They feel the relationship has not been tested and push the boundaries in some sort of dominance/reassurance thing that just screams "betrayal" to a male. In the old days men slapped the shit out of them said some soothing words and that was that. A woman had to have a man to survive and be accepted in life so cultural stuff forced crazy bitches to adapt, mostly. Now that behaviour makes you a criminal and a horrible person. So if you are a survivor and do not want to be someone's slave in the catch 22 game of life you adapt. Your mom lied to you and was probably an awful person, welcome to the club.

You then give them one warning and prepare to ditch them. They will inevitably make another play and you shut them down cold. Zero problems, you just have to be a cold hearted mother fucker and never even consider children.

Anything else and you are going to be fucked. You decided to be fucked so, oh well.

I have been in two abusive relationships. Both times they called the cops, both times I had visible injury, both times I was arrested. The first time the crown stayed the [charges] after I showed her a couple recordings of the girl in question going psycho. Still wasn't allowed to go back to the house I had paid rent on two days before and was in my name. The second time the cop didn't recommend [charges] after listening to my story (and putting me through the whole process at the station for a couple hours).

Both times the girls demonstrably lied maliciously and filed false reports. Neither ever faced any repercussions.

Pretty much why I won't date or merry an American. Glad I moved away from there 10 years ago... Still got fucked over in a divorce because my ex emptied my bank account (was in my name, not hers) when I was at work. Can't get that money back as being a foreigner pretty much means you are wrong.

Ex also came to my office, hit me in the head with my business card holder (desk type, heavy glass) and split my eyebrow open... Cops were called, looked at me bleeding, looked at her and basically said there was nothing they can do. FML.

This happened all in Tokyo. Another fun fact, no such thing as joint custody in Japan. Dad always loses the kids, never seeing your kid after a divorce is common.

The whole concept of arresting a normal person in a family argument is a different thing in Japanese culture. The cops are for criminals. By their standards you were a man not handling his woman.

The american woman culture thing is mostly caused by the change in our culture in the last few decades. Women's role has completely changed and mostly been phased out. They used to be an indispensable part of life whose skill and compassion defined our culture. now they are added value fuck dolls that will demand to be paid for her services after leaving if possible. The Violence Against Women Act (VAWA) is federal US law drafted by and lobbied for by feminists. Bernie Sanders was actually a key player in getting it passed. That's my life.

If as a gay man, I can be explicitly threatened by a woman in writing for refusing to date her (such a threat is sexual harassment, though my employer refused to consider it so), and then she can transparently falsely accuse me of sexually harassing her and not be only be taken seriously but believed, then that is rational.

She even made a hand-written confession to her accusations being false, after they told I was gay and she dropped the complaint. Didn't matter. They refused to consider her confession and instead falsely claimed I partially confessed in writing, when I didn't, and accordingly found me partially guilty.

Then she went on to falsely claim we'd been in a relationship and accused me of domestic violence. Though the fact that she couldn't even accurately describe me to police didn't help her. Claiming to have been in a relationship with someone but not even knowing their skin or eye colour is a tough one even for the police to swallow.

So she faked a series of death and rape threat emails and used those to get an Apprehended Violence Order against me. Claimed to have received them, printed them and immediately deleted them. That's why the police couldn't investigate them. Though the police eventually did and proved that she faked them. She confessed to that. But they didn't prosecute her.

Despite the fact that she was on probation for having attempted to strangle her ex-boyfriend in a hospital. And that she had threatened my life, typing a suicide letter pretending to be me, forging my signature on it and giving it to my boss. My signature she only had because upon falsely accusing me of sexually harassing her, being a man my guilt was assumed and I was immediately instructed to apologize in writing. She specifically insisted on it being a written letter (for my signature) rather than an email.

Most women aren't like her. But the ones who are can effortlessly and safely annihilate a man's life with even the most absurd and unbelievable lies. So absolutely, positively, the best thing you can do is keep to yourself.

That's valid advice to a certain extent. We should try to get to know people well before we truly let them into our lives and try to set good standards for the people we wish to commit ourselves to. But most people have no idea their partner is going to abuse them until it happens. There are sometimes warning signs but they can be difficult to identify if you haven't been in that type of relationship before or are simply blinded by feelings. And getting out of an abusive relationship is easier said than done. It is almost never just physical. It is emotional and verbal abuse and manipulation, which is a big part of why people will take much longer to get out of a bad relationship than would seem logical to outsiders.

What did you do that got her angry? Circumstances play a large part of this. I was divorced a couple of years ago and she and I are still friends. I never gave her anything to rage over, so maybe I'm somehow super unique and special, but I've run into a lot of women who would get mad but not try and destroy your life over it.

As a former cop, I can confirm that at least 50% of the cases I dealt with were a female aggressor. Out of those same cases, women were the most violent and caused the most physical harm as well. They were also more likely to ambush an unsuspecting partner as well. Men were also passed over for domestic violence assistance in any way. All funding was earmarked for female victims only. The system is broken, thanks to Femi-nazis.

Yup. I was stabbed through my hand after coming home from work (mandatory OT) @ 2am for wanting to go to sleep because I had to be awake and out the door by 6am for another full day at school, then work immediately after - rather than do the dishes that she said she was going to do since she wasn't working at the time.

I called the cops, they came wanted to cuff me WITH the knife still in my hand and she never had a hand laid on her.

It was only when whey took me outside and she went on her screaming fit and got aggressive did they believe me. They got an angry confession out of her and hauled her off...so 30+ min trying to convince the people I called for help that I was indeed the one who needed help and who actually called them......equality? If the roles would have been reversed, and she has a knife through her hand, I'm certain I'd have been roughed up and "had trouble" walking down the several flights of stairs and getting into and out of the squad car, taking place all inside 10 minutes before I was enroute to the station.

Being a male and having suffered from domestic violence. I can attest that the system is more for protecting women and not men. Unfortunately statistics and probably a high percentage of what cops see only helps with that.

My personal advice? Even if you are innocent? If you can't afford the worlds best defense attorney - take the plea. You have a very slight chance of winning your case.

I understand the appeal of this sort of thinking but of course it works best with appeals to extreme cases - as you have done here. You want to make compromise lead to that slippery slope of fascism. You know where it doesn't play so well? Its where you start acknowledging all the ways the world forces almost everyone in some way to compromise their personal values in order to make a living.

You might find someone pointing at you and your selfish behavior in some capacity. Then it starts to become where you draw the line. Not so obvious how one does that. I am going to suggest that you may not appreciate how difficult it is to draft laws that can get fair outcome for all the situations to which they apply. Holding police accountable for this as a whole is kind of unfair in my opinion.

Your welcome. It's all too easy to shit on police in particular for being the face of perceived injustice. People don't want see the job in terms of its structure and function.

People need to recognize how the nature of bureaucracy leads to all sorts of instances where the "one size fits all" approach to law is prone to failures. Exceptions abound and nuance can't be always be exercised when it is needed. It seems so absurd to me to make a civil servant in any capacity hold the bag for these problems.

Either people don't understand the DV laws or things are very different outside out my state. DV laws here are not created to favor females over males. People's assumption that I arrest the guy because the girl is crying and has allegations are either misunderstanding of the investigation process or are flat out wrong.

I know coming to a sub like this with what appears to be a differing opinion will only cause the whole to not like the opinion. I was simply trying to explain the process from an involved parties perspective.
