I would talk to a lawyer to figure out what the best direction from here is. I think something like %30 of paternity tests result in the child not being related, so pray that she was embracing the CC and don't get married just yet. Finances aside, at the end of the day, if it's your kid, then that should be your main priority now. Statistically, a child raised in a household with a mother and father fair exceptionally better than one who was not. I think you screwed up, but there is growth and success to be had in every failure.

I have a question, were you wearing protection? If so did the condom break? I ask this not to get too personal but if you didn’t want to have a kid in the first place you should have used protection. It isn’t about just the threat of STDs…etc it’s the threat of having an unwanted child with a girl who isn’t legally a US citizen or otherwise. I do realize that condoms break but it’s too much of a risk if not wearing one and it’ll prove that you didn’t want to have children and might look better in your defense later on.

It sucks, but your best bet is to let her go back to Brazil. You tried to do the right thing for her and the child here. She continues to try to use you as a meal ticket.

And not to be a jerk, but let her know that if she takes you to family court for child support, you'll make a call to your friendly neighborhood ICE agent. Don't let her threaten you, when she is the one out of line.

What really sucks is that your child is stuck in the middle. Other than getting full custody, I don't see a way for you to win here. If she stays, you pay dearly. If she leaves, she takes your child. I'd try to get her to leave the kid with me and go home to her family, but depending on the female, that may be impossible. That kid is her meal ticket to get access to your money.

OP: you fucked up once. Don’t fuck this up more. You need to speak with a family law attorney Tuesday. FULL STOP. Don’t have money for a lawyer? Beg, borrow, sell blood. It’s that important! Since she is here illegally now that may be a blessing for you. The kid is also a US citizen and your local court has current jurisdiction over this case. DO NOT let her take the kid out of your county, parish, borough, whatever! If she does and enough time goes by that court then gets jurisdiction. If she does you need to have a lawyer file to have the child returned.

It is possible you can get full custody if she gets deported. Wait on calling ICE until you speak with your lawyer. Another note: if she gets to Brazil with the kid she can request CS via international law (I’m assuming Brazil is a signatory). So don’t think letting her take the kid back absolves you of CS. It seems clear based on her actions thus far that she would do this.

Edit: she’s not getting papers. She fucked up overstaying her visa. She SOL as far as that for many years to come if not ever.

Now you may want to actually take her to court, you could be given custody due to the threats to go back to brazil and he not being a citizen. One way or another you're on the hook for that ... for about 18 years. You got her pregnant, you're the daddy, you're responsible for supporting the child - food, shelter, clothing, medical expenses, etc. If you're not directly doing that for the kid, then you're expected to pay your fair share of that to her for her to be able to provide that for the kid - of course she's quite expected to contribute too ... and if, e.g. you got sole custody ... she'd be the one paying you.

Anyway, that's basically how it works. Don't have to marry anyone you don't want to. You get someone pregnant, you're responsible and have to cover your responsibility ... and you're not the one that's pregnant - that's not your choice. Should'a thought 'o that before getting someone pregnant if you didn't want to be having a kid.

OP, had a similar situation, resolved itself, but I know you're going through hell. Stay strong, end of the day don't marry her. The best move would be not to put yourself in the system willingly. Doesn't sound like she is amenable to an arrangement where you pay her a certain amount without a court order. But if you're able to do that do it....putting yourself on child support is about the dumbest thing anyone can do. Keep receipts, pay her in checks in the memo write CS so there's never any ability for her to act as if it's a gift. That way if she takes you to court you have proof you have tried to help her.

It is a crime that in this day and age a man's consent is not taken to account. Firm believer that equality means if women get the options to abort, adopt, men should have those same rights. The whole you lost your rights because you failed to wear a condom thing is bullshit, hey maybe I lost the right to decide if she has the child. Fair. But I should have the right to financially abort. That will never happen, because why would women willing give up that advantage, not to mention the white knights who think women are helpless.. But I bet there would be a lot less single mothers if their decision wasn't backed by the state.

Worst come to worst tho, set aside 10 percent of your check, and maybe get a light side hustle to make it up. Chances are if you're making above 70-80k it really won't hurt you all THAT much,Check your states website they usually have formulas that calculate the amount you would owe. The more you have your kid the less you have to pay, in theory, if you have 50/50 or sole custody you don't have to give her anything, in fact in the latter case she might owe.

You also have to decide if you want to be a father... Don't let people force you, or guilt you into doing something you don't want to do. You have to legally support it unfortunately, but, you don't have to be a father, it's a tough decision and shouldn't be done lightly, but if you do feel that way do it now that the kid is young enough and won't be AS affected by it. Don't wait till the kid turns 6 or 7 and walk out.

Get a paternity test.
If the child is yours, do the right thing and be a father to that child. Not a Disney dad but a real, qualified father so that the child grows up to be a functioning member of society.
If the child is not yours, ditch the broad and carry on with life.

Get a paternity test. That is the first thing you should do. Secondly, consider whether you want to be involved in the child’s life if it turns out to be yours. If you do want to raise the child, you’ll have to figure out a way to have an amicable relationship with the mother and hopefully she is cooperative. Whether you get married, live together, or separately co parent is up to you. I’ve known a sort of couple that got divorced but choose to live in the same house to make it easier for the children, it made sense for them financially and for the emotional well being of the children. Your child will thrive best in a two parent household but you are not obligated to date a woman you aren’t interested in even if she is pregnant.

It wouldn’t hurt or consult a lawyer to protect yourself if she is planning on suing you for child support, maybe even a family therapist to help navigate this dispute.

In my opinion, her leaving your place and planning on suing your for child support isn’t going to be good for the child or you.

Great things happen in our lives but often not when we want them to happen.

You seem to be forgetting that you are a father and have a child. Being a parent can be a joyous and wonderful thing if you let it. Why not change your outlook on the situation and think about the good things that can come from being a parent. Your son or daughter could be the best thing that ever happened to you.

I’d say forget about the mum issues and think about how you want to go forward as a father. Ask yourself how you’ll feel in a decade and how your son or daughter might feel as they grow up. The current disagreements about money etc. are going to seem extremely trivial in 10 years time and I wouldn’t want you to have lost a potentially wonderful experience as a parent over them.

I know someone who got pregnant at 16 and gave the baby up for adoption. 20 years later when she decided that the time was right and she desperately wanted children she couldn’t conceive. It was very traumatic for her to know that she already had a child that she was unable to parent.

I suppose I’m just saying in a very long winded way that you might try to look at the bigger picture.

Depending on your state you can sign over all parental rights to the child to not pay Child Support. But be aware that you'll never see him again and he may grow up without a proper father figure. Also Paternity Test, no marriage, reason with her and try limited dating, if all fails you can sign your rights away. Whoops!

First: Paternity test! No financial support unless and until it is positive! Do lab, not store bought.

If it is negative, test again to make sure. It may be expensive, but still cheaper than child support.

If it is positive, test again to make sure.

If courts will not accept a test you did as evidence, tell them you will not acknowledge any paternity unless they do a paternity test and accept it as evidence. Get it in writing it will be accepted before you do it.

If it is positive, get a lawyer. If you or your family want custody, you are in a tricky situation here since you are not willing to marry her and her visa is expired.

If she has an in demand qualification and can find a job that either an employer can sponsor a work visa or green card for her, or she has skills that the USA is in need of, she could stay in the USA without your help. If she is able to renew her student visa to keep studying and then graduate, and then get a post qualification work visa to look for a suitable graduate job if the US has those, and then get a green card later, that would be an option too.

If she could start a business and had enough capital, that might be an option.

No idea if the US has working holiday visas, I don't think they do. I do however think you can get a J1 visa to work for a year in the US if you are a recent graduate so she could look into that to buy some time.

Failing all those, her only options to stay LEGALLY in the US would be marrying you, or if she could get a visa to stay on humanitarian and compassionate grounds since her baby will be a US citizen through you if the DNA test is positive.

Then we get into illegal territory like coming in on a B1 or B2 or tourist visa and working illegally and all that jazz which a lot of people do, but will get you jailed, deported by the not so friendly ICE people and banned from the US for like three years.

Anyway: My point is, if you don't marry her, and she cannot get a visa to stay and work on humanitarian and compassionate grounds, it may not just be her choice not to stay in the US if her student visa is expired and she cannot work legally and is worried about being deported.

Now, if the DNA test comes back positive, all this will probably be good for you, IF you and your family were wanting to take full custody, as you could take her to family court, point out to the judge that she's in a precarious situation and it'd be best for the baby to stay with you, at least while she gets her life sorted. You're a US citizen, so is your family, the baby would be through you, the mother is not, so if you wanted full custody at least temporarily, you could have an advantage.

Similarly, if you wanted her to take full custody and have you just pay child support, it'd be a fairly simple solution, you just might not be able to see the child later very easily if you changed your mind.

But if you only wanted visitation or joint custody, I think you're a little bit screwed unfortunately. Brazil as far as I am aware is not a country that cooperates particularly closely with the USA as far as international custody agreements go, so if your ex agreed to joint custody, left and then didn't return, it would be up to the Brazilian government, that is currently headed by Mr Bolsonaro, as to whether they would be willing to cooperate and extradite your child to the USA or not.

First of all: do not ever have unprotected sex if you don't want to be a father.

Second: Lawyer up, and get a paternity test. This reeks of her trying to use you and the child to get your money and gain permanent access to the USA. Once those are secure, she'll probably divorce you for even more payout.
