So the staff failed in their duty of care by allowing an underage patron into the bar. The video evidence exonerating him is ignored. Even though the burden of proof has been flipped so he has to prove he's innocent, that evidence is not allowed. So after all that he gets convicted of 'making out' and receives a sentence worse than many rapists and murderers.

So he got a jury trial. Probably pissed off the judge and the DA. But, beyond that, I have a deep philosophical problem with how the process of discovery is conducted in a criminal trial. Theoretically, the DA needs to produce not only inculpatory, but also the exculpatory evidence in a trial. In reality, there won't be any. The police collects samples and record observations at the crime scene and after. Any evidence that is exculpatory in nature will not be collected. Any evidence that is disputable will not be presented. The labs used by police are also biased, because guess who butters their toast. Definitely not the defendant. They have the samples. They are the ones doing the tests. It may be that the entire sample is used in the process, so the defendant has no way of repeating the procedure. And the jury believes the prosecution a lot more than the defense, because, hey, the DA is only doing his job, win or lose, but the defendant stands to go to pound-you-in-the-ass state prison for a long time, so of course he's going to try to save himself, in their minds.

A lot of states in the US don't even allow a "mistake of age" defense in statutory rape cases, which is absurd because any reasonable person might mistake someone's age when they're in a pub where you're required to show ID to prove you're at least 21 to get in.

The prohibition of the mistake of age defense violates a man's constitutional right to defend himself against an accusation. It's an outrage that it's not allowed in many states.

To play devil's advocate, when she was examined she had bruises on her ankles that she claimed were from struggling when she was allegedly raped.

Also, 12 years is a lot, but it is the absolute minimum time for this offense in this particular state (sad regardless). The guy's attorney tried to lower it relentlessly due to the fact that they only have bruising to corroborate her claim while rape kits found not seminal fluid from him.

All around fucked up. There's lack of evidence from either side to corroborate much of anything but that doesn't mean to lock up a potentially innocent man under the idea "believe all women" or "it's better to lock up 100 innocent men knowing they have the one guilty." Sad, sad situation.
