Carruth who is obviously a smaller man tries to intimidate the dad into leaving without his son. How did he think that was going to work?

Chad wasn't going to back off, Carruth and his partner essentially provoked the entire incident to seemingly wind up Chad and show contempt to the legal process.

Chad understandably, is upset by this. And having someone like Carruth get in your face and act like a hard man is just going to wind anyone up. The whole custody issue has nothing to do with Carruth . He's irrelevant, what he didn't like was the fact that Chad was an important part of his son's life and this upset Carruth for whatever reason.

Carruth then shits his pants and goes to grab a rifle 'to show that he's a man'.

Chad didn't back down, as he had a legal, court sanctioned order to see his son at that time. What was he supposed to do? Walk away from his son, because Carruth would keep running around the back to get his rifle every other fortnight?

He (presumably it's the same man) has been in trouble before by possessing prohibited weapons.

So watching this clip it appears that on the face of it it's murder 1 or murder 2 but going through the Texas laws this might be a "justified" killing.

If she's a judge, which is something I didn't know until now, then it's absolutely possible that she knew which boxes had to get checked off for it to be either "justified" or to set up Kyle to take the fall for handling her problem.

Let me start this off by saying that I feel for Chad and this is a sad look into how our country operates when it comes to custody.

That being said it seems a lot of people here are having trouble separating law from feelings. Look the intention doesn't really matter, you have the right to bare arms and the right to protect yourself and your property. Kyle was well within his rights to brandish a weapon at any point in time and when Chad grabbed the gun saying "I'll take that gun and kill you with it" That made a very strong argument on Kyle's side to prove his life was threatened at the time. I firmly believe 9/10 courts would find this to be self defense.

I also firmly believe Kyle and the mom are pieces of shit.

Anger? Maturity wins out every time. If he has a standing court order and she is being volatile, won’t turn over the minor child, is attempting to agitate said situation then return to your vehicle , drive a couple blocks away (out of line of sight) and use your cellphone to call police.

The police have zero authority to enforce custodial agreements BUT if her behavior is volatile and potentially puts the minor at risk police can take action at that juncture. When an ex is not following the custody order, it behooves one to take the higher rode and either file . Or have an attorney file, a motion with the family court to either revise the custodial agreement or compel the ex to abide by the standing agreement under threat of imprisonment or fine. Most people are unwilling to risk their liberty or wallet in these cases. Any negative outbursts will be used against the offending parent. Courts like to see calm , consistent behaviors in the best interest of the child. Her status as a judge is meaningless. Most judges are appointed and all governed by a judicial overwatch committee.

The gun being brandished would have made a strong compelling argument for full custody and restraining orders against the boyfriend. He had the winning hand! I will say this is not premeditated murder. Almost impossible to prove. I will say this falls under Manslaughter or Felony Murder.

Parental Kidnapping is considered a felony in the state of Texas. Considering he was spouting off "I get him at 3:15" and threatening to subpoena everyone makes me think there was already a pre-existing custody arrangement in place.

Violating a court-ordered custody arrangement is considered parental kidnapping. If such court order existed. Seriously it's quite baffling how stupid Texas laws have to be to consider this self-defense.

Okay, Not a lawyer, and this is not legal advice. As I understand the laws in Texas.

Kyle (navy blue shirt the shooter)

Chad (light teal shirt the shot)

If the following - This is Kyle's home or his name is on the lease. Kyle has his home posted no trespassing, and or verbally warned Chad to leave. (as seen in the video)

Once Kyle told Chad to leave it was criminal trespass. Once Chad grabbed the rifle and slung Kyle away it was done for Chad.

If I was on the Jury in a criminal case Kyle would walk. Civil and if there is a conspiracy to commit murder here I don't know. But Chad should have left, contacted the court or whatever you do when your ex screws up your visitation, and then came after them that way. If he had Chad would still be alive today.

It;s obvious by the video these people set the bio dad up. They knew the law and did everything they could to justify killing him being technically right by the law. Every action had an air of snarkiness and smugness to it.

Bio dad could have left, and that is what I would advise anyone in this kind of situation to do. However, there was no reason to believe anyone was in any danger, either immediate or soon to be. The bio-dad got right in his face (which WOULD have been the time to shoot, as the guy is advancing in a possible threatening way) as if to say, "you're not seriously going to shoot me because I'm standing here demanding my rights...just quit with the bull poop".

Then, after he had the ability to get away from any danger (real or perceived), the shooter turns and aims carefully at a stationary target to kill. Deadly force is only to be used in a situation of mortal danger. A threat to your life or another's. He was not protecting anyone from anything except his woman from not getting her way.

This is too complicated to just go, "they clearly set him up." I was in the middle of a divorce case in which my wife's ex had legal visitation rights, but was so toxic and harmful to the kids that we did all we can to keep him and his new lady friend away from them.

I'm really not picking sides here. I'm just saying that this post is some conspiratorial bullshit. I don't know what the social context of this divorce was, so I have no way of knowing what I personally would've done if I were on either side. I have enough experience in divorces involving kids to know that passing judgement quickly on either side is an error.

Wherever the truth is, this isn't a "men's rights" issue. This is a divorce issue. I feel the most sorry for those kids, for being forced into this drama. They don't deserve this nonsense at that age. Both parties could've been more forgiving, just for the sake of those kids.

That was not self-defense. Chad didn’t have a gun or any type of deadly weapon. Nor did he make threats of violence against anybody. At most, Chad was guilty of trespassing and disorderly conduct. You can’t threaten to use deadly force against someone for that. You call the police. Chad closed the distance with Kyle as a tactical move to defend himself from being shot. When Kyle fired into the ground, Chad tried to take the gun away and was justified in doing so since Kyle showed intent to cause death or serious bodily harm. A struggle ensues, Kyle breaks away from Chad. Chad doesn’t pursue him. Kyle fires at point blank range killing him. This was MURDER! This scumbag Kyle needs to go to prison for the rest of his life.

There is a reasonable self defense case that could be made for kyle. And assuming he can afford quality legal defense, he could walk. After being commanded to leave to leave, blue shirt Trespasses on kyles domicile, and probably meets the legal definition of assault in Texas, Blue shirt also pulls up on the rifle with the back of his hand, and throws kyle off of his property.

Like The case is a clusterfuck. and Kyles warning shot will probably bite him in the ass, as warning shots are always stupid, always.

Kyle and the ex wife should definitely be charged with the felony over the custody dispute, but Kyle was within his rights to use lethal force against him after he tried to grab the gun, in my opinion
