She should have to pay back any and all child support he paid. He can sign away his parental rights if he wants to (some men stay even after they find out it’s not theirs for sentimental reasons). They could also sue for emotional damages if he wishes- that shit is traumatic!

Hmmm. It depends on whether they are currently married, whether the ‘father’ wants to keep parental rights, and the age of the kids.

A case where they are still married and have small kids is different than divorced with adult kids.

The first, I’d be likely to say that the man gets some degree of recompense through divorce assets, and choice of if he wants custody first (assuming he’s fit), but it’s more about allowing a separation in the way that suits him.

In the second scenario, she should repay any child support. The kids are adult, so forcing her to repay won’t hurt the kids welfare, and he has actually been paying out monthly specifically for the kids in a way that isn’t as clear cut in a marriage (and certainly here in the U.K., a step-dad can divorce and not pay any child support, so it’s only the lie that is being punished there and adultery already has certain considerations in law here).

Also, if it can be proved that the real father knew that the child was his, I’d consider him an accomplice and deny parental rights to him. If not, he can petition for parental rights if he chooses.

Edit: I should have added that we are assuming as well that she is proven to have knowingly committed fraud, otherwise it's simply adultery and that's a different thing.

Whatever the punishment is for, say, bankfraud (which probably already includes paying back the money you've received) + a sum for emotional damages + a mandatory visit & questioning from CPS.

These kind of things also cause great emotional damage in children, hence getting CPS involved. The paternity fraud alone shouldn't be a reason to lose her kids or anything, but a woman who lets her children emotionally suffer for financial gain? I want to bet she isn't mother of the year regarding other parental responsibilities either.

She would have to pay back child support of they weren't together anymore. At fault divorce could be applied of they were still together, and the man would be the one being favored in this case, and the woman would have to go to jail for fraud.

Edit: sending the woman to jail is what I'd want to happen. But I know this would create a really bad situation to the kid so I'm not 100% sure about my position on that.

I think parents should have the right to test their child, any time without the mothers permission. If you can't do the time dont do the crime. That in place, I'm not sure what 'punishment' you could have- it's like punishing for having an affair. It's absolute shitty behaviour but not sure how it's a crime, unless they are separated and he has been taken to court for child support, in which case all men should test paternity as a matter of course. If he had paid child support, it should be paid back.

How can you conclusively prove fraud? How does the state prove 100% that the mother had knowledge that the man was not the father and willfully and intentionally sought to decieve him? Because to levy any punishment, you’d have to prove that she knew and deliberately lied versus she believed in the absence of evidence proving otherwise.

The government reimburses that chump for any money that was legally required to be paid outside of a relationship with the mother (sorry dude but if you married her/shacked up with her just because you got her preggers that's your lookout, in that situation a DNA test is something you should have demanded) and then assesses the bio father (if he can be found) for child support from the date of birth of the kid. If the bio father can't be found the DNA stays on file in case he later can be found. The bio father's child support goes first to pay off the cost to the state of having paid out the chump, and then when that is finished the money goes to the mother as child support. If there is still a debt when the kid reaches the age at which it is fully independent under government rules (ie, parental income is no longer an issue in any calculations) then that remaining debt gets recovered from the mother much as a tax debt would.

However, I would allow for the mother to argue something along the lines of contributory negligence on the part of the chump. For example if a couple were "on a break" and then got back together and she clearly got pregnant during that break but the chump didn't see what happened not because it wasn't obvious but because he didn't want to see what happened, well if most reasonable people would see that as a situation in which he should have asked for a paternity test then he should have the % of his outgoings he can get back from the government (and therefore the amount the government can recover from the woman or the bio father) reduced by an amount (maximum of 50%) equivalent to his idiocy and enabling.

Thanks for asking this question. It is really interesting. I'm super pro-kid and don't like punitive laws and also think how horribly traumatic it must be for guys to find out a child isn't theirs specially after supporting Mom and Kid for some time.

Besides being Empress of humankind can I be super scientist inventing a problem solving product? If yes, than the pregnancy test is also a kind of DNA test that when dipped in the supposed father's urine shows if he is indeed a genetic match . . . . not sure this is a great answer but the earlier the truth is known the better I would think.

Also would love some type of Caucasian Chalk Circle test for parents to decide who is the emotional/bonded parent. This would over-ride any DNA test results.
